<![CDATA[Tujuan penelitian menganalisis bentuk perlindungan hukum dan mekanisme proses penyelesaian kasus kepemilikan hak atas tanah dalam hukum pidana. Penelitian ini menggunakan tipe penelitian hukum empiris. Penelitian ini dilakukan di Direktorat Reserse Kriminal Umum Kepolisian Daerah Sulawesi Selatan. Untuk mengumpulkan data dengan cara wawancara dengan pihak terkait Hasil penelitian bahwa pada prinsipnya perlindungan hukum dalam hal kepemilikan hak atas tanah adalah diwujudkan melalui diberlakukannya Undang-Undang Pokok Agraria No.5 Tahun 1960 mengenai Hak milik yang dipunyai seseorang atas tanah, dan juga terdapat di pasal 167 ayat (1) KUHP berupa ancaman yang dapat dikenakan kepada seseorang yang melawan hukum menduduki tanah milik seseorang. Faktor yang menjadi kendala kurangnya Sumber Daya Manusia yakni penyidik kepolisian dalam hal melakukan proses penyelesaian kepemilikan hak atas tanah, serta tidak sepahamnya apparat negara yakni, polisi dan jaksa dalam menangani suatu masalah tindak pidana termasuk penyerobotan tanah. The research objective is to analyze the forms of legal protection and mechanisms for the process of resolving land ownership cases in criminal law. This research uses the type of empirical legal research. This research was conducted at the General Criminal Investigation Directorate of the South Sulawesi Regional Police. To collect data using interviews with related parties. The results of the research are that in principle legal protection in terms of ownership of land rights is realized through the enactment of the Basic Agrarian Law No. 5 of 1960 concerning property rights that a person has over land, and is also contained in the article 167 paragraph (1) of the Criminal Code in the form of threats that can be imposed on someone who unlawfully occupies someone's land. Factors that hinder the lack of human resources are police investigators in carrying out the process of resolving ownership of land rights, as well as disagreement between state officials, namely the police and prosecutors, in handling criminal matters including land grabbing.]]>
