Abstract

This study aims to describe the role of the Sharia Supervisory Board (DPS) towards sharia compliance and to analyze the application of sharia compliance in murabaha contract financing products. The research method used is normative legal research with a qualitative approach. In this study, researchers examined concrete legal regulations and substantial regulations accompanied by supporting literature in the form of literary sources that were relevant to the research object being discussed. The results of the study show that the existence of the Sharia Supervisory Board (DPS) is to guarantee and supervise Islamic banks so that they remain in the corridors of Islamic law. The role of the Sharia Supervisory Board (DPS) is very crucial in the implementation of sharia compliance in Islamic banks in Indonesia. The role of the Sharia Supervisory Board (DPS) at the technical level of banking operations is very important considering the duties, responsibilities and authorities they have. The Sharia Supervisory Board (DPS) in carrying out their duties can be active or responsive. The Sharia Supervisory Board (DPS) must actively supervise, collect data, analyze and correct various findings of sharia non-compliance in an Islamic bank. Financing with a murabaha contract that has been practiced by Islamic banking has deviated from several provisions in the DSN MUI Fatwa and there is a conflict with the legal terms of a sale and purchase agreement with a murabaha contract, namely the bank fully represents the customer to buy and receive goods from suppliers and gives the right to carry out deed of sale and purchase for and on behalf of the customer himself directly with the supplier. Islamic banks should first buy the object before the object is sold to the customer and also in this practice only one sale and purchase transaction, namely between the supplier and the customer. Based on DSN MUI Fatwa No. 04/DSN-MUI/IV/2000 concerning Murabahah, murabahah financing must occur in two sale and purchase agreements.

Abstract

The implementation of the new MABIMS criteria in 2022 stipulates that the new crescent moon can be considered visible if it has a height of at least 3 degrees and an elongation angle of at least 6.4 degrees. The change in criteria for the height of the crescent moon further distances the unification between the Government and Muhammadiyah. This research aims to analyze the implementation and impact of the implementation of the new MABIMS criteria on the unification of determining the beginning of the lunar month in Indonesia. The research uses reckoning analysis data to determine the start of Ramadan, Shawwal and Zulhijah in 1443 – 1452H. This type of research is field research. The research results show that the reason for changing the MABIMS criteria was driven by astronomical considerations, namely that the shape of the crescent moon produced by the old criteria was too thin and easily obscured by twilight light. Then, the implementation of the new MABIMS criteria resulted in a greater difference in the criteria for crescent height, namely 0 to less than 3 degrees. Data on calculating the height of the hilal from 1443 AH - 1452 AH shows that there were 13 times the height of the hilal which did not meet the criteria for the new Imkanur Rukyat MABIMS but met the criteria for the shape of the hilal. [Penerapan kriteria MABIMS yang baru pada tahun 2022 menetapkan bahwa hilal baru dapat dianggap terlihat jika memiliki ketinggian minimal 3 derajat dan sudut elongasi minimal 6,4 derajat. Perubahan kriteria tinggi hilal justru semakin menjauhkan adanya penyatuan antara Pemerintah dengan Muhammadiyah. Penelitian ini bertujuan menganalisis implementasi dan dampak implementasi kriteria MABIMS baru terhadap penyatuan penentuan awal bulan Kamariah di Indonesia. Penelitian menggunakan data analisis hisab penentuan awal Ramadan, Syawal dan Zulhijah tahun 1443 – 1452H. Jenis penelitian ini adalah field research. Penelitian ini yang menggunakan pendekatan kualitatif. Hasil penelitian menunjukkan bahwa alasan perubahan kriteria MABIMS didorong oleh pertimbangan astronomis, yaitu bentuk hilal yang dihasilkan oleh kriteria lama terlalu tipis dan mudah terhalang oleh cahaya senja. Kemudian, implementasi kriteria MABIMS baru mengakibatkan selisih kriteria tinggi hilal lebih besar yakni 0 hingga kurang 3 derajat. Data hisab tinggi hilal dari tahun 1443 H- 1452 H menunjukkan bahwa terdapat 13 kali tinggi hilal yang tidak memenuhi kriteria Imkanur Rukyat MABIMS baru namun memenuhi kriteria wujudul hilal].

Abstract

Tujuan dari penelitian ini adalah untuk mengetahui tingkat persentase dispensasi nikah di Kecamatan Wara Timur dan mendeskripsikan secara mendalam optimalisasi implementasi dispensasi nikah berdasarkan UU No. 16 Tahun 2019 serta mengetahui dan mendeskripsikan faktor penghambat atau kendala dalam implementasi dispensasi nikah tersebut. Metode penelitian yang digunakan adalah pendekatan kualitatif. Dalam penelitian ini peneliti menggunakan teknik pengumpulan data berupa wawancara disertai literatur pendukung yang diperoleh dari beberapa sumber kepustakaan yang relevan dengan kajian ini. Hasil penelitian menunjukkan bahwa tingkat persentase yang melakukan pengajuan dispensasi nikah di Kecamatan Wara Timur hanya sekitar 20% yang sebagian besar alasannya dikarenakan hamil di luar nikah. Adapun implementasi dispensasi nikah di Kecamatan Wara Timur telah sesuai dengan aturan yang telah ditetapkan dalam UU No. 16 Tahun 2019. Dimana pengajuan dispensasi nikah disini diajukan oleh orang tua pihak pria dan/ atau orang tua pihak wanita yang dilakukan karena alasan sangat mendesak dan disertai bukti-bukti pendukung yang cukup. Faktor penghambat atau kendala dalam implementasi dispensasi nikah ini ialah terkait masalah waktu. Maksudnya, waktu penetapan pernikahan dimana jarak antara sidang di pengadilan dengan tanggal pernikahan sangat berdekatan yang mengakibatkan proses pengadilan belum selesai namun waktu pernikahan telah tiba sehingga saling berbenturan waktu.
