Abstract

ABSTRACT This study aims to examine legal justice in the application of police discretion to stop the investigation of criminal acts of traffic accidents at this time, the problems and solutions of legal justice in the application of police discretion to stop the investigation of traffic accidents from the perspective of Law No. 2 of 2002. This approach method uses sociological juridical approach with qualitative methods supported by primary and secondary data. With the research specification is descriptive analytical, so that the deepening of the problem is very necessary. The results of this study concluded that: 1) In practice, Article 18 of Law Number 2 of 2002 concerning the Indonesian National Police which is the basis for police discretionary actions has not been used as a legal umbrella, although in practice many investigators have done so. 2) From the aspect of legal substance, in practice, discretion is applied to the field of traffic or other matters that have not touched the task of investigating and investigating criminal acts. From the structural aspect, it can be seen in the administrative practice of internal police investigations that have not accommodated, stopping criminal investigations on the legal basis of police discretion. Meanwhile, from the cultural aspect, the Police leadership has paid attention to the rise of traffic accidents with the category of minor and moderate accidents where the perpetrator and the reporter have peace and forgiveness and compensation is available to stop, but it has not become a legal product that can be used as a legal umbrella. national. Abstract

Peran Dalam Undang-Undang Dasar Negara Republik Indonesia Tahun 1945 Pasal 28 F disebutkan bahwa setiap orang berhak untuk berkomunikasi dan memperoleh informasi untuk mengembangkan pribadi dan lingkungan sosialnya, serta berhak untuk mencari, memperoleh, memiliki, dan menyimpan informasi dengan menggunakan segala jenis saluran  yang tersedia. Untuk memberikan jaminan terhadap semua orang dalam memperoleh informasi, perlu dibentuk undang-undang yang mengatur tentang keterbukaan informasi Publik. Kepastian dan perlindungan hukum ini diperlukan, mengingat hak untuk memperoleh informasi merupakan hak asasi manusia sebagai salah satu wujud dari kehidupan berbangsa dan bernegara yang demokratis.Undang-Undang Dasar 1945 mengamanatkan bahwa negara melalui aparaturnya wajib melayani setiap warga negaranya dalam memenuhi kebutuhan dasar untuk meningkatkan kesejahteraan masyarakat. Semua kepentingan publik harus dilaksanakan oleh pemerintah selaku penyelenggara negara, yaitu dalam berbagai sektor pelayanan, terutama yang menyangkut tentang hak-hak sipil dan kebutuhan dasar. Warga negara menginginkan penyelenggaraan negara yang good governance, yaitu pemerintahan yang efektif, efisien, transparan, akuntabel, dan bertanggung jawab.Permasalahan yang dialami oleh bangsa Indonesia sekarang ini semakin kompleks dan sarat. Oknum-oknum organisasi pemerintah yang seharusnya menjadi panutan rakyat banyak yang terjerat masalah hukum. Eksistensi pemerintahan yang baik atau good governance yang selama ini sangat didambakan oleh masyarakat masih jauh dari harapan, bahkan hanya di angan-angan. Konsep good governance muncul karena adanya ketidakpuasan pada kinerja pemerintah dalam melaksanakan urusan publik. Kata Kunci: Negara, Masyrakat, Good, Governance

Abstract

This study aims to strengthen the capacity of the management of Islamic Boarding Schools (Pondok Pesantren) in understanding the core substance of Law No. 18 of 2019 concerning Islamic Boarding Schools, specifically at Pondok Pesantren Nurussalam Walisongo Gomang. This law is crucial for advancing and protecting the existence of Islamic boarding schools in Indonesia. Therefore, a thorough understanding of this law is essential for the management of boarding schools to run their organization effectively and support the quality of education provided. This research employs a qualitative descriptive approach with a case study method. The study was conducted at Pondok Pesantren Nurussalam Walisongo Gomang, located in District X, Y Regency. The research sample includes the management of the boarding school, such as the head of the boarding school and several other administrators who are directly involved in the management and operations of the pesantren. Data collection techniques used include in-depth interviews, participatory observation, and documentary studies related to the implementation of Law No. 18 of 2019 at the boarding school. The results of the study show that the management of Pondok Pesantren Nurussalam Walisongo Gomang has a relatively good understanding of the core substance of Law No. 18 of 2019. However, there are still areas that need improvement, particularly in the technical aspects of implementing the regulation, such as funding and human resource management in the pesantren. Intensive and routine training related to this law is needed to address these shortcomings. Additionally, establishing discussion forums and consultations with competent authorities could also strengthen the understanding of the pesantren management. Strengthening the capacity of the management in this regard is not limited to theoretical understanding but also practical application in the daily activities of the pesantren. By fully understanding the regulation, the management can be more effective in carrying out their duties, improving the quality of education, and strengthening the pesantren’s position in the national education system. Overall, this study contributes to the development of the capacity of the management of Islamic boarding schools, specifically in understanding and implementing Law No. 18 of 2019. In the future, it is expected that there will be synergy between the government, pesantren, and the community to enhance the role of pesantren in producing morally upright and high-quality generations.
