Abstract

Foreign investment plays a crucial role in driving a nation's economic growth. It involves capital investments by international investors into various sectors of a country's economy. In qualitative research on policy and law, data collection methods often include the analysis of official documents such as laws, government regulations, financial reports, and previous studies related to foreign investment and economic development in Indonesia's new national capital. Law No. 25/2007 concerning investors also reflects the significant impact of foreign investment on Indonesia's economic growth. Foreign sinvestment can stimulate growth through several mechanisms, such as increasing investment in sectors with a high multiplier effect, creating jobs, facilitating technology and management knowledge transfer, and enhancing the competitiveness of domestic products in the global market. The legal aspects of economic development play a key role in regulating and protecting foreign investments. Legal protection of intellectual property rights, ownership rights, and safeguarding investments from potential risks provides added security for foreign investors. Keywords: Investment, Policy, Economy

Abstract

Economy and environment are variables contained in the principles of sustainable development which underlie legal regulations related to the environment in various countries in the world. Nevertheless, there is still environmental pollution and damage that occurs, such as air pollution caused by industrial activities from fertilizer factories that produce ammonia-based fertilizer which pollutes the air in residential areas around the factory, which shows an imbalance between the economy and the environment. On the one hand, this economic activity is an effort aimed at creating community welfare, but on the other hand, this activity causes disruption to the community in obtaining a good living environment. The results of this research show that ammonia gas is a compound produced from the fertilizer industry process which is toxic and pollutes the environment. Ammonia is a poisonous gas, colorless and has a distinctive odor which can cause problems with human health and even death. However, the ammonia gas that spreads to residential areas around the factory is caused by wind blowing towards the settlement and this is not dangerous, because the wind blows the levels of ammonia gas to decrease. However, the presence of an ammonia-based fertilizer factory does not necessarily mean that society is free from the threat of this gas, because there have been several incidents of ammonia gas leaks in various parts of the world which have caused material losses and claimed many lives.

Abstract

Abstrak Dalam kasus yang melibatkan anak perusahaan PT Pupuk Indonesia (Persero), yaitu PT Rekayasa Industri (Rekind), perusahaan berhasil mencapai kesepakatan perdamaian (homologasi) dengan para kreditornya melalui mekanisme PKPU. Proses restrukturisasi ini memperoleh dukungan dari mayoritas kreditor, di mana 100 persen kreditor separatis dan 98,99 persen kreditor konkuren menyetujui kesepakatan tersebut. Penelitian ini menggunakan pendekatan yuridis normatif dengan metode kualitatif, berfokus pada analisis norma-norma hukum dalam UU Kepailitan dan PKPU serta penerapannya dalam kasus konkret PKPU PT Rekayasa Industri. Persetujuan PKPU menciptakan forum legal yang terstruktur untuk penyelesaian utang-piutang, memfasilitasi negosiasi antara debitor dan kreditor di bawah pengawasan pengadilan, yang pada akhirnya meningkatkan efektivitas dan efisiensi penyelesaian permasalahan finansial perusahaan. Perjanjian perdamaian yang disahkan ini memberikan kerangka hukum yang jelas bagi PT Rekind dalam memenuhi kewajibannya kepada kreditor. Sesuai Pasal 286, jika PT Rekind lalai melaksanakan perjanjian perdamaian, para kreditor dapat mengajukan pembatalan perjanjian tersebut, yang berfungsi sebagai mekanisme kontrol untuk memastikan komitmen PT Rekind tetap terlaksana. Kata Kunci: Perdamaian, Dampak, Pembayaran, Utang.   Abstract In a case involving a subsidiary of PT Pupuk Indonesia (Persero), PT Rekayasa Industri (Rekind) successfully reached a peace agreement (homologation) with its creditors through the Suspension of Debt Payment Obligations (PKPU) mechanism. This restructuring process received support from the majority of creditors, with 100 percent of secured creditors and 98.99 percent of concurrent creditors agreeing to the settlement. This research employs a normative juridical approach with a qualitative method, focusing on analyzing the legal norms within Law No. 37 of 2003 on Bankruptcy and PKPU and their application in the concrete case of PT Rekayasa Industri’s PKPU. The approval of the PKPU establishes a structured legal forum for debt resolution, facilitating negotiations between debtors and creditors under court supervision, thereby enhancing the effectiveness and efficiency of corporate financial problem-solving. The ratified peace agreement provides a clear legal framework for PT Rekind to fulfill its obligations to creditors. In accordance with Article 286, if PT Rekind fails to adhere to the terms of the peace agreement, creditors may request the annulment of the agreement, serving as a control mechanism to ensure that PT Rekind fulfills its commitments. Abstract

Abstrak Sektor pertanian memegang peranan strategis dalam pembangunan, terutama dalam menjamin ketersediaan pangan bagi Masyarakat. Dalam konteks sektor pertanian di Indonesia, PT Pupuk Indonesia berperan sebagai salah satu korporasi utama dalam penyediaan pupuk bersubsidi yang sangat penting bagi petani. Namun, keberadaan pupuk bersubsidi yang seharusnya memberikan manfaat kepada petani sering kali menjadi sasaran penyimpangan. Kasus penyimpangan distribusi pupuk bersubsidi yang melibatkan PT Pupuk Indonesia dan oknum-oknum terkait mengundang perhatian besar dalam ranah hukum bisnis. Berdasarkan analisis komprehensif, dapat disimpulkan bahwa penyimpangan distribusi pupuk bersubsidi merupakan tipikor yang serius, sebagaimana diatur dalam UU No 31/1999 juncto UU No 20/2001. Pelanggaran Pasal 3 UU tersebut mencakup penyalahgunaan wewenang, pengayaan diri atau pihak lain, dan merugikan keuangan negara. Analisis kasus penyimpangan distribusi pupuk bersubsidi dalam Putusan No. 28/Pid.Sus-TPK/2022/PN Srg mengungkapkan dampak hukum dan sosial yang signifikan. Secara hukum, terdakwa Mahdi dijatuhi hukuman penjara 1 tahun 3 bulan dan denda Rp. 50.000.000,- atas pelanggaran Pasal 3 Jo. Pasal 18 UU No. 31/1999 jo. UU No. 20/2001 tentang Pemberantasan Tipikor. Kata Kunci: Bersubsidi, Bisnis, Korupsi, Penyimpangan. Abstract The agricultural sector plays a strategic role in development, especially in ensuring food availability for the community. In the context of the agricultural sector in Indonesia, PT Pupuk Indonesia plays a role as one of the main corporations in providing subsidized fertilizer which is very important for farmers. However, the existence of subsidized fertilizer which is supposed to provide benefits to farmers is often the target of irregularities. The case of irregularities in the distribution of subsidized fertilizer involving PT Pupuk Indonesia and related individuals has attracted great attention in the realm of business law. Based on a comprehensive analysis, it can be concluded that irregularities in the distribution of subsidized fertilizer are a serious criminal act of corruption, as regulated in Law no. 31 of 1999 jo. UU no. 20 of 2001. Violations of Article 3 of the Law include legitimate protection, enrichment of oneself or other parties, and harm to state finances. Analysis of cases of irregularities in the distribution of subsidized fertilizer in Decision Number 28/Pid.Sus-TPK/2022/PN Srg reveals significant legal and social impacts. Legally, the defendant Mahdi was sentenced to 1 year and 3 months in prison and a fine of Rp. 50,000,000,- for violation of Article 3 Jo. Article 18 Law No.31/1999 jo. UU no. 20 of 2001 concerning Eradication of Corruption Crimes. Keywords: Subsidies, Business, Corruption, Deviations.
