Abstract

Pengangkutan merupakan salah satu bagian penting dalam kehidupan masyarakat karena selain berguna untuk mempermudah aktivitas sehari-hari, pengangkutan juga berpengaruh terhadap pertumbuhan ekonomi dan infrastruktur pada suatu wilayah. Saat ini semakin majunya ilmu pengetahuan dan teknologi juga berdampak pada berkembangnya metode pelayanan dalam dunia pengangkutan. Salah satunya ialah munculnya layanan transportasi berbasis online. Salah satu perusahaan transportasi online yang terkenal di Indonesia adalah Grab. Permasalahan dalam penelitian ini adalah bagaimana pengemudi transportasi online (Grab) mendapatkan perlindungan hukum yang sesuai dengan Undang-undang Nomor 13 Tahun 2003 tentang Ketenagakerjaan. Dengan adanya transportasi online menjadi fenomena yang luar biasa terutama bagi masyarakat yang berada di kota-kota besar. Karena mereka melaksanakan langsung dampak dari keberadaan transportasi online tersebut. Hubungan hukum yang timbul dari perjanjian antara pengemudi transportasi online (Grab) dengan PT. Grab Taxi Indonesia. Dilihat dari bentuknya merupakan perjanjian kemitraan. Perjanjian kemitraan ini merupakan perjanjian kemitraan yang termasuk kedalam perjanjian kemitraan jenis baru dengan pola bagi hasil sebagaimana diatur dalam Pasal 26 huruf f Undang-undang Nomor 20 Tahun 2008 tentang Usaha Mikro, Kecil, dan Menengah. Tidak ada perjanjian kerja yang timbul dalam hubungan kemitraan antara PT. Grab Taxi Indonesia dengan pengemudi Grab karena ada salah satu unsur yang tidak terpenuhi yaitu unsur upah, dengan demikian pengemudi bukan merupakan pekerja karena tidak terjadinya hubungan kerja antara PT. Grab Taxi Indonesia dengan pengemudi Grab yang ada hanya hubungan kemitraan dimana kedua belah pihak memiliki kedudukan yang sama sebagai mitra. Sehingga pengaturan dan masalah-masalah yang berkaitan dengan perlindungan kerja tidak dapat menggunakan Undang-undang Nomor 13 Tahun 2003 tentang Ketenagakerjaan.

Abstract

Economy and environment are variables contained in the principles of sustainable development which underlie legal regulations related to the environment in various countries in the world. Nevertheless, there is still environmental pollution and damage that occurs, such as air pollution caused by industrial activities from fertilizer factories that produce ammonia-based fertilizer which pollutes the air in residential areas around the factory, which shows an imbalance between the economy and the environment. On the one hand, this economic activity is an effort aimed at creating community welfare, but on the other hand, this activity causes disruption to the community in obtaining a good living environment. The results of this research show that ammonia gas is a compound produced from the fertilizer industry process which is toxic and pollutes the environment. Ammonia is a poisonous gas, colorless and has a distinctive odor which can cause problems with human health and even death. However, the ammonia gas that spreads to residential areas around the factory is caused by wind blowing towards the settlement and this is not dangerous, because the wind blows the levels of ammonia gas to decrease. However, the presence of an ammonia-based fertilizer factory does not necessarily mean that society is free from the threat of this gas, because there have been several incidents of ammonia gas leaks in various parts of the world which have caused material losses and claimed many lives.

Abstract

Study This discusses the implementation execution decision of the Court Industrial Relations (PHI) Bandung-related dispute Termination Connection Work (PHK) through mechanism bankruptcy. PHI decisions often face​ constraints in implementation, especially in unsolved layoff disputes that can quickly be executed. Bankruptcy is one of the instruments used​ to ensure workers' rights are fulfilled when the Company has financial trouble. Research This is to study how the bankruptcy process can be used as a road alternative for finishing layoff disputes and challenging the law's implementation. The research uses a legal normative approach supported by case PHI Bandung decision studies. Research results show that although Bankruptcy can become a practical solution, it requires synergy between the court and curator so execution can run optimally.

Abstract

The work of the Corporate Social Obligation organization is required in the financial success of the local region in order to aid the community's economy, which combines diverse points of view. so that business in society is not perceived as a danger to the environment and solely has an interest in obtaining profit. The effect of the Corporate Social Responsibility program must be accountable in strengthening the community's economy, according to Government Regulation Number 47 of 2012 concerning Social and Environmental Responsibility of Limited Liability Companies. The author poses the following questions: "How does the Company's Corporate Social Responsibility Influence in Improving Community Welfare?" and "What is the Role of Company Corporate Social Responsibility as Corporate Responsibility in Building the Community's Economy?" This is an issue that must be addressed. The research approach used in this study is normative writing with qualitative methodologies, with some normative law concerns. The use of a company's corporate social responsibility idea not only improves the company's reputation, but it must also be able to deliver advantages to the nation's people across all sectors and the economy.
