Abstract

The rapid development of information, media and communication technology has changed the behavior of people and their environment to become more global and open. The advancement of information and communication technology has had various impacts, both positive and negative impacts, because on the one hand it contributes to the improvement of welfare, progress and human civilization, but on the other hand it becomes an effective means of illegal acts. One of the consequences of digital technology advances is the widespread spread of fake news or hoaxes in the community. By using the library research method, this research will become one of the writings that become a reference for the community to avoid the spread of hoax news. The ITE Law has provided a provision that perpetrators of hoax news spread will receive criminal sanctions based on a quo Law and also the Criminal Code. Therefore, the role of social media literacy is the most appropriate solution to dealing with this problem.

Abstract

Perkembangan Cryptocurrency sebagai aset digital mendorong pemerintah Indonesia melakukan peralihan kewenangan pengawasan dari Badan Pengawas Perdagangan Berjangka Komoditi (Bappebti) kepada Otoritas Jasa Keuangan (OJK) dan Bank Indonesia (BI). Penelitian ini bertujuan untuk menganalisis landasan yuridis peralihan kewenangan tersebut dan mengkaji potensi tumpang tindih kewenangan pengawasan antara OJK dan BI. Metode penelitian yang digunakan yakni penelitian hukum normatif dengan pendekatan perundang-undangan, historis, dan konseptual. Hasil penelitian menunjukkan bahwa pengalihan kewenangan pengawasan Cryptocurrency memiliki dasar hukum yang kuat melalui UU Nomor 4 Tahun 2023 yang ditegaskan dalam Peraturan Pemerintah Nomor 49 Tahun 2024, dan diperkuat dengan regulasi turunan yang dikeluarkan oleh OJK. Namun demikian, pembagian kewenangan antara OJK dan BI, khususnya terkait aspek pengawasan sektor jasa keuangan dan stabilitas makroprudensial, berpotensi menimbulkan tumpang tindih kewenangan. Penelitian ini menyimpulkan bahwa harmonisasi kewenangan melalui pembagian fungsi yang jelas, penguatan koordinasi kelembagaan, dan integrasi kebijakan lintas sektor menjadi kunci dalam menciptakan sistem pengawasan Cryptocurrency yang efektif dan berkelanjutan di Indonesia.
