Abstract

The definition of abuse (violence) is not only interpreted physically, but also mentally and even passively (neglect). It can be known, it is undeniable that on the other hand, Abuse in its implementation cannot be separated from the element of violence. Violence can be interpreted as wrong treatment, cruel treatment. In this regard, the problem is: how to enforce the law against sexual violence against children and how obstacles are to the implementation of law enforcement against sexual violence against children. The method used in this study uses a normative juridical method, namely research that focuses on finding legal norms, legal principles and legal doctrines to answer the legal issues to be studied. The results of this study found that the form of law enforcement used in this case uses a preventive method which prevents a person from committing a criminal act for the first time and also in the implementation of law enforcement there are still inhibiting factors that make the implementation of this law enforcement not run optimally, namely internal factors and external factors. Therefore, professional law enforcement is needed and also who can involve other stakeholders so that this law enforcement can run better.

Abstract

This study aims to analyze criminal liability as a murder perpetrator who suffers from paranoid schizophrenia and its relation to the reasons for criminal elimination in accordance with Article 44 of the Criminal Code to ensure legal justice. The methodused in this study is normative judicalwith an approach to laws and cases from the court, after the legal materials  that have been successfully collected are then systematically  arranged and analyzed using a qualitative approach. The result of this study indicate that fraud that caused paranoid schizophrenia who commits the crime of murder can be subject to criminal sanctions or actions (double track system). In dciding such cases, the judge must prioritize the aspect of justice by concidering the opinionof a psychiatrist who observes whether the cognitive function is disturbed or not when commiting the crime of murder, if it is disturbed by characteristics such as hallucinations and delucions that cause the punishment to be unable to distinguish reality, fantasy and loss of self control , then it can be ordered in article 44 of the criminal code as a reason for forgiveness by eliminating responsibility, while if the cognitive function is not disturbed, it can beaccounted for, ther it can be accounted for criminally.

Abstract

Background. Thuggery is increasingly prevalent in every social activity. Not only does it cause fear in the community, but the practice of thuggery is also the cause of the decline in the level of public trust in Law enforcement. The study formulates the problem by examining how the modus operandi is often used in the practice of thuggery in Indramayu Regency and how law enforcement can overcome the practice of thuggery. Purpose. This study aims to analyze the modus operandi used in thuggery activities and understand and evaluate law enforcement's effectiveness in thuggery. Methods. The research method used is Empirical Jurisprudence. Direct observation was carried out in areas with a relatively high level of thuggery in Indramayu Regency. Result. The study's results show that one mode of thuggery often encountered in Indramayu Regency is Illegal Levy under the pretext of selling mineral water. Conclusion. Law enforcement consists of several aspects, such as the legal factors themselves, law enforcement factors, facilities and facilities factors, community factors, and cultural factors.   Implementation. Law enforcement is strengthened by increasing legal awareness in the community and implementing stricter sanctions to reduce the practice of thuggery in the future.

Abstract

Structural inequality poses a persistent challenge within the criminal justice system, shaped by social factors such as poverty, race, and gender. Restorative justice offers an alternative to retributive models by emphasizing the restoration of relationships through inclusive dialogue among victims, offenders, and communities. This study evaluates the effectiveness of restorative justice in addressing structural inequality, utilizing qualitative methods including literature analysis and case studies from various countries, such as Indonesia. The analysis draws on academic journals, policy reports, and legal documents, alongside practical examples of restorative justice implementation. Findings suggest that restorative justice can promote a more inclusive justice system by empowering both victims and offenders and facilitating community involvement. However, challenges persist, including institutional bias, resource limitations, and resistance from the conventional justice system. To enhance the effectiveness of restorative justice, the study recommends institutional reforms, context-sensitive mediator training, and increased policy and resource support. Furthermore, fostering synergy between formal legal mechanisms and local, community-based approaches is crucial for addressing the root causes of structural inequalities. Overall, while restorative justice demonstrates significant potential, its success depends on overcoming systemic barriers and ensuring sustained commitment from all stakeholders.

Abstract

Penelitian ini bertujuan untuk menganalisis fenomena keterlibatan anak dalam promosi judi online, serta untuk mengeksplorasi penerapan kebijakan hukum pidana, khususnya melalui pendekatan restoratif dalam menangani permasalahan tersebut. Penelitian ini menggunakan metode penelitian hukum normatif, dengan mengkaji norma-norma hukum yang berlaku, terutama yang terkait dengan Undang-Undang No. 11 Tahun 2012 tentang Sistem Peradilan Pidana Anak (UU SPPA). Penelitian ini juga mengidentifikasi faktor-faktor sosial, psikologis, dan digital yang mempengaruhi anak untuk terlibat dalam promosi judi online. Hasil penelitian menunjukkan bahwa anak-anak sangat rentan terhadap pengaruh lingkungan digital, termasuk promosi judi online yang sering disebarkan melalui media sosial dan platform daring. Anak-anak yang terpapar pada konten semacam ini sering kali dipengaruhi oleh teman sebaya dan kurangnya pengawasan dari orang tua. Selain itu, pendekatan restoratif yang diatur dalam UU SPPA menawarkan solusi yang lebih baik dibandingkan dengan penghukuman pidana. Diversi, sebagai pengalihan penyelesaian perkara anak dari proses peradilan pidana, terbukti lebih efektif dalam memberikan pemulihan dan rehabilitasi bagi anak-anak. Oleh karena itu pentingnya kebijakan yang lebih adaptif terhadap perkembangan teknologi digital, serta perlunya peningkatan literasi digital untuk orang tua dan masyarakat. Pendekatan hukum yang berfokus pada pemulihan dan rehabilitasi akan lebih membantu anak-anak dalam menghadapi dampak negatif dari keterlibatan mereka dalam promosi judi online.

Abstract

The author focuses on the problems that occur related to the illegal sale of alcoholic beverages in Kuningan Regency, where in addition there is already a Regional Regulation that regulates the control and supervision of alcoholic beverages. The purpose of this study is to find out how the Implementation and obstacles to Regional Regulation Enforcement in the Illegal Sale of Alcoholic Beverages in Kuningan Regency. This research uses qualitative research methods and descriptive methods on enforcement theory according to Soerjono Soekanto. Data collection techniques are carried out using interview, observation, and documentation techniques. The findings obtained by the author in this study are that there are still many people who sell alcoholic beverages without a license. that in the Regional Regulation the control and supervision of alcoholic beverages is still not running optimally because there are still many inhibiting factors both from the community and Satpol PP as well as the main actors in the enforcement of the Regional Regulation. Therefore, to maximize the process of enforcing local regulations, Satpol PP is recommended to increase human resources, facilities and infrastructure, and budget. In addition, it is also necessary to hold socialization again to all people of Kuningan Regency.
