Abstract

In Article 2 paragraph (1) of Marriage Law, it has been stated that the provisions and conditions for a valid marriage are marriages that are conducted according to the laws of each religion and belief. Interfaith marriage is a delicate religious topic that has a lot to do with someone spiritual views. Every religion in the world has its own laws governing marriage as a religious matter. The research method used is normative juridical research. This research used laws and regulations regarding to interfaith marriage, including Civil Code, Law number 1 of 1974 on Marriage, and Law No. 23/2006 on Population Administration. Based on research result, when associated with legal issues in the marriage that occurs, it can be interpreted that interfaith marriages can only be registered in civil registry, but it does not mean that it is religiously valid. Interfaith marriages are also associated with human rights, freedom in human rights to marry and build a family remains subject to the rules or Law Number 1 of 1974, this is clearly seen in the Human Rights Law in Indonesia Article 10 paragraphs (1) and (2) which state that this freedom must be in accordance with statutory regulations.

Abstract

The land ownership by an individual or a group have right to freely use it. According to the philosophy of customary law, rights are the authority, power and ability of people to act on objects. There are many cases of ex-western land rights that have not been converted after 20 years of the UUPA has been in force. For instance, a case that occurred is the ex-western land of Eigendom Verponding number 3529 in Jember district. The judge has tried to determine. The main problem of this study is the way to recognize and prioritize priority rights in the process of converting Eigendom land into property rights. Juridical analysis used to examine the priority rights in the process of converting Eigendom Verponding land into property rights (case study of case determination no. 337/pdt.p/2013/pn.jr). This problem was studied using a normative method, with a case approach and legislation. The conclusion of this study is that priority rights are used in solving land problems to obtain land rights, determine ownership rights, obtain compensation due to the abolition or cessation of land use and utilization rights, and determine the subject of rights who have the right to manage the land properly.

Abstract

WeTV is the owner of copyright in computer programs, which has been regulated in Law No. 28/2014 on Copyright. However, there are irresponsible people who violate it by duplicating, distributing and selling WeTV subscription accounts through Shopee marketplace and taking advantage of the benefits personally. It becomes an issue related to copyright protection based on the law on an application program that is being misused by other parties. The method in this research is normative juridical research, which conducts research by analyzing and a series of formal legal rules, including laws and regulations, and literature that contains theoretical concepts. The result of this research that WeTV is an intellectual work in a computer program that is protected by copyright. The sales transaction of WeTV subscribed accounts on the Shopee marketplace by “Mavelstore.id” has a non-authorized method in accordance with the terms and conditions of WeTV. Unauthorized distributors copy without permission from copyright holders and benefit from sales through the Shopee marketplace. The account was found to have committed acts of piracy that caused losses to the WeTV copyright holders. The seller has shared account actions by changing the provision that 1 (one) WeTV user account can only be used by 1 (one) user, to 1 (one) WeTV user account can be used by multiple users. The existence of moral and economic loss is provided an order for the infringement of the creation through the formal procedure of copyright protection efforts against the illegal sales of WeTV accounts through internal legal protection and external legal protection.

Abstract

Marriage is an internal bond between a man and a woman as husband and wife with the aim of forming a happy and eternal family. However, domestic harmony requires sustained effort and mental and material preparations. When conflicts in marriage are not resolved, divorce is often an option. This research aims to understand the practice of implementing decisions related to child custody after divorce in Mondoluku Village, Wringinanom, Gresik. The method used is qualitative with data collection techniques through interviews, observations, and document studies. The results showed that many divorced couples do not implement court decisions related to child custody, which has a negative impact on children’s welfare. The obstacles involved a lack of understanding of the law and economic constraints. Efforts from relevant parties, such as community leaders and local government agencies, in providing legal education and mediation have been implemented, but their effectiveness still needs to be improved. Therefore, this research is able to offer a comprehensive overview of child custody protection after divorce, which requires better coordination and increased resources to ensure children’s welfare. The research highlights that determining child custody involves various administrative and procedural steps, requiring cooperation among families, courts, and social institutions to prioritize the child’s best interests. It also points out challenges such as inadequate public understanding of custody, limited resources, and the psychological effects on children, which impact the effectiveness of custody implementation after divorce.

Abstract

Land registration is a critical government activity aimed at recording and maintaining physical and juridical data for land parcels, ensuring legal certainty for land rights holders. In Jombang Regency, despite 76.7% of 592,744 land parcels being titled, 100% titling has not been achieved. The government introduced the Complete Systematic Land Registration (PTSL) program, facilitated by Ministerial Regulations, to accelerate this process and provide legal certainty. However, the implementation of PTSL in Jombang Regency faces significant challenges, making it an important area for study. This research aims to analyze the implementation of the PTSL program in Jombang Regency, focusing on the challenges faced and the obstacles affecting its effectiveness in achieving legal certainty and reducing land disputes. This research uses an empirical juridical approach with a sociological juridical focus, drawing on primary data from interviews with the Jombang Regency Land Office and secondary data from laws and regulations related to land registration and PTSL, including Law No. 5/1960 and various government and ministerial regulations. This research revealed several technical constraints impacting PTSL implementation in Jombang Regency. These include a lack of human resources, limited timeframes for completion, insufficient public awareness regarding administrative requirements, and challenges in socialization and counseling. Further obstacles involve difficulties in retrieving and collecting juridical data, issues with physical data measurement due to terrain, and problems with certificate submission. Additionally, legal issues, particularly those related to inheritance and lost proof of ownership (Letter C), significantly impede the process.
