Abstract

The land ownership by an individual or a group have right to freely use it. According to the philosophy of customary law, rights are the authority, power and ability of people to act on objects. There are many cases of ex-western land rights that have not been converted after 20 years of the UUPA has been in force. For instance, a case that occurred is the ex-western land of Eigendom Verponding number 3529 in Jember district. The judge has tried to determine. The main problem of this study is the way to recognize and prioritize priority rights in the process of converting Eigendom land into property rights. Juridical analysis used to examine the priority rights in the process of converting Eigendom Verponding land into property rights (case study of case determination no. 337/pdt.p/2013/pn.jr). This problem was studied using a normative method, with a case approach and legislation. The conclusion of this study is that priority rights are used in solving land problems to obtain land rights, determine ownership rights, obtain compensation due to the abolition or cessation of land use and utilization rights, and determine the subject of rights who have the right to manage the land properly.

Abstract

Tulisan ini membahas perbandingan antara Tindakan Administratif Keimigrasian (TAK) dan pendekatan pidana dalam penegakan hukum keimigrasian di Indonesia. Dalam konteks meningkatnya mobilitas lintas negara dan potensi pelanggaran keimigrasian, pemerintah Indonesia lebih sering menerapkan TAK karena dinilai lebih efisien, cepat, dan proporsional dibandingkan dengan proses pidana yang kompleks dan memakan waktu. Penelitian ini menggunakan pendekatan normatif empiris, dengan mengkaji peraturan perundang-undangan yang berlaku serta implementasinya di lapangan. Hasil kajian menunjukkan bahwa TAK menjadi instrumen utama dalam penegakan hukum keimigrasian, sebagaimana diatur dalam Pasal 75 Undang-Undang No. 6 Tahun 2011 dan diperkuat dengan Peraturan Menteri Imigrasi dan Pemasyarakatan Nomor 2 Tahun 2025. Meskipun demikian, pendekatan pidana tetap diperlukan untuk pelanggaran berat seperti penyelundupan manusia dan penggunaan dokumen palsu. Oleh karena itu, sistem hukum keimigrasian idealnya memadukan pendekatan administratif dan pidana secara proporsional, dengan menjunjung asas keadilan, efektivitas, dan penghormatan terhadap hak asasi manusia. Penelitian ini merekomendasikan penguatan kapasitas kelembagaan, integrasi data antarinstansi, serta penyusunan regulasi yang jelas untuk membedakan pelanggaran administratif dan pidana secara tegas.

Abstract

This Community Service Program (PKM) was implemented to improve the digital marketing capacity of the Ayra Berkah Kerupuk MSME located in Kaliwadas Village, Adiwerna District, Tegal Regency. This MSME was founded in 2006 and focuses on independently producing various types of crackers. Despite having a distinctive taste and a loyal customer base, product marketing remains limited because business owners do not yet understand optimal digital marketing strategies and do not yet have business legality. The objective of this activity is to assist partners in developing their business identity and utilizing digital platforms as promotional media. Methods used in this program include identifying partner needs, digital literacy training, and direct technical assistance. Forms of implementation include creating business logos and banners, training on the use of social media such as Instagram, Facebook, and TikTok, and creating a WordPress-based website as a digital storefront. In addition, the team also assisted in the legal process through the registration of a Business Identification Number (NIB). The results of the activity indicate that partners are beginning to understand the importance of visual imagery and digital promotion in expanding market reach. Partners are now able to manage social media accounts and websites independently. This program also had a positive impact on the students involved, improving their soft skills in communication, teamwork, and problem-solving in the field. Overall, the PKM program successfully empowered partner MSMEs through an educational and participatory approach to utilizing digital technology.
