Abstract

Divorce not only entails property division but also raises significant concerns regarding child custody. Courts often intervene to determine which parent is better suited to care for the child after divorce. This research aims to explore the legal implications of divorce on child custody rights and understand the factors influencing custody decisions between fathers and mothers, both individually and jointly. Employing descriptive analysis with a normative approach, the study utilizes secondary data from primary, secondary, and tertiary legal sources. Findings suggest that divorce can result in the loss of child custody rights due to neglect of parental obligations and immoral behavior, which may have contributed to the divorce. Additionally, judges consider various factors in determining custody, including the child's welfare, emotional connection with parents, and parental responsibilities. Factors such as parental presence in the child's life, financial support, and emotional interactions with the child influence custody decisions. Therefore, it is recommended that parents maintain positive relationships with their children, prioritize family unity, and actively fulfill their duties in providing protection, affection, and proper education.

Abstract

Peningkatan kesejahteraan masyarakat pedesaan seringkali melibatkan pembentukan Badan Usaha Milik Desa (BUMDes), yang bertujuan untuk mengidentifikasi dan mengembangkan potensi ekonomi desa. Secara konseptual BUMDes didirikan untuk meningkatkan kemandirian dan perekonomian desa melalui peningkatan Pendapatan Asli Desa (PAD). Program Kemitraan Masyarakat (PKM) dilakukan di Desa Naimana Kecamatan Malaka Tengah untuk mengembangkan usaha keripik singkong, mengingat singkong merupakan komoditas andalan yang potensinya belum tergali. Meski menghadapi tantangan kelembagaan, PKM bertujuan untuk meningkatkan pendapatan masyarakat melalui diversifikasi produk, seperti keripik singkong. Meskipun survei menunjukkan adanya permasalahan dalam pengelolaan BUMDes akibat persaingan antara pengurus lama dan baru, namun kegiatan produktif masih dapat dilakukan. Dengan demikian, PKM ini diharapkan dapat meningkatkan kesejahteraan masyarakat desa Naimana melalui pemanfaatan potensi ekonomi lokal.

Abstract

This research aims to examine the relationship between the increase in encroachment on conservation forests and the classification of forests based on their ownership status, as well as assess the East Nusa Tenggara BBKSDA's responsibility in addressing conservation forest encroachment. This research uses an empirical legal research method. All collected data is then qualitatively analyzed to describe the problem and answer the research objectives. The results show that land ownership claims, boundary disputes, and a lack of community understanding regarding conservation forest status are the primary causes of encroachment. Although the East Nusa Tenggara BBKSDA has taken various proactive steps to address conservation forest encroachment, the issue has not yet been fundamentally resolved. Therefore, it is recommended that the Local Government and East Nusa Tenggara BBKSDA take concrete measures to tackle the ambiguity of land ownership status, which is one of the root problems of conservation forest encroachment. These measures could begin with reviewing and updating data related to land boundaries and ownership status, followed by mediation between the government and the community to resolve border disputes fairly and transparently. Furthermore, it is essential for traditional institutions and local communities to actively participate in this process actively, utilizing local knowledge and traditions in determining fair and mutually recognized land boundaries. The Local Government and BBKSDA must also enhance efforts to socialize and educate the community about the importance of conservation forests, including the long-term benefits of forest conservation for environmental sustainability and the local economy. These efforts should be carried out through effective communication appropriate to the local cultural context so that the community can accept and value the importance of conservation forests.
