Abstract

Masalah KDRT antara laki-laki dan perempuan berkelahi misalnya, ketika mengetahui bahwa kedua orang tersebut adalah suami-isteri, kekerasan terhadap perempuan dalam rumah tangga yang dimaksudkan mencakup segala bentuk perbuatan yang menyebabkan perasaan tidak enak (penderitaan), rasa sakit, luka, dan sengaja merusak kesehatan, Beberapa korban yang mengalami kekerasan dalam rumah tangga (KDRT) ini kerap kali takut untuk melaporkan kejadian yang dialaminya, terlebih perempuan yang dikarenakan mendapat tekanan atau ancaman. Hasil penelitian ini adalah, Kekerasan baik yang dialami oleh isteri dan atau anak sebagia korban bentuk kekerasan dalam rumah tangga yakni: 1) Kekerasan fisik dan non fisik, yaitu: 2) Bentuk kekerasan seksual yang dialami oleh korban adalah berupa adanya pemaksaan atau pemerkosaan terhadap isteri sendiri untuk melakukan hubungan intim. 3) Kekerasan psikologis bersifat sangat merendahkan, seperti: bodoh, tidak guna dan sebagainya, 4) Kekerasan penelantaran keluarga terjadi ketika laki–laki atau suami tidak mempedulikan keluarga dalam rumah tangga; suami tidak memberikan nafkah kepada isteri dan anak. Secara konkrit pola penyelesaian menurut adat terkait kekerasan dalam rumah tangga (KDRT). 1) Penyelesaiannya dengan adat yaitu pada umumnya pola penyelesaiannya dilakukan dengan mendahulukan wujud formal/acara (hukum formal. Maksudnya bahwa pola penyelesaiannya pada umumnya diselesaikan secara kekeluargaan, baik diselesaikan ditingkat intern keluarga dan ditingkat lurah atau kecamatan maupun ditingkat kepolisian. Sesungguhnya banyak kasus kekerasan dalam rumah tangga (KDRT) yang tidak dilaporkan atau tidak dicatat. 2) Penyelesaian menurut negara yaitu pola penyelesaian menurut negara terhadap kekerasan dalam rumah tangga secara Negara dilakukan pihak kepolisian dengan memproses hukum pelakunya hingga pengadilan menjatuhkan vonis.

Abstract

The importance of living a healthy life, keeping the body fit in worship is everyone's dream, including the elderly. However, a special problem for the elderly is the natural process of aging which has an impact on the physical, mental and social relations of the elderly. Therefore this study seeks to find solutions related to achieving a healthy life for the elderly from an Islamic perspective. This study uses qualitative research methods that are descriptive analysis, data sources obtained through interviews and documentation, data analysis techniques through data reduction, data display, and data verification. The analytical knife in this study uses a triangulation technique. The results of these findings indicate the importance of practicing the concept of a healthy and happy life based on the directions and instructions of the Koran and hadith. Abdullah Nasih Ulwan provides alternatives and ways that lead to a healthy and happy life even in old age through five pillars: al-Qudwah, al-'Adah, al-Mauidha, al-Mulahadah and al-Uqubah.

Abstract

This study aims to determine and analyse the utilisation of assets earned by Indonesian migrant workers (PMI) and its impact on their relationships in Tanjung Mas Jaya Village, East Mesuji Subdistrict, Mesuji Regency. The method used was a descriptive qualitative approach with field research in the form of case studies. Informants were selected purposively based on certain criteria, including migrant workers, their spouses, parents-in-law, and neighbours who had relevant experience, particularly related to the misuse of migrant workers' earnings. Data collection techniques included primary data in the form of interviews and documentation, as well as a literature study from secondary sources. The results of the study show that (1) the assets earned by migrant workers are often used by their spouses without prior agreement, contrary to the intended purpose of sending funds, such as for children's education, home renovations, or business capital. The causes include a lack of communication, the absence of a written agreement, and the influence of social pressure and the consumptive lifestyle of spouses in their home country; (2) the impact of this misuse on family relationships, namely the emergence of domestic disharmony, divorce, and psychological effects on children.

Abstract

Unregistered marriages remain prevalent in several rural areas in Indonesia, despite the implementation of mandatory marriage registration regulations. Previous studies have generally focused on the legal validity aspects of such marriages, while empirical research examining their impact on children’s access to rights at the local level remains limited. This study aims to fill this gap by analyzing the driving factors and impacts of unofficial marriages on the fulfillment of children’s rights in Wonosari Village, Mesuji Timur District, Mesuji Regency. This research is a field study employing a descriptive qualitative approach. Data were collected through in-depth interviews, direct observation, and document analysis involving couples in unofficial marriages, parents, community leaders, and local government officials. The findings reveal that economic vulnerability, premarital sexual activity, and environmental and family pressure are the primary factors driving the occurrence of unofficial marriages. Children born from such unions face significant obstacles in obtaining legal identity documents, accessing formal education, and securing adequate legal protection. This situation places both children and women in a socially and juridically vulnerable position. While these unofficial marriages are considered religiously valid, they lack legal force. This study provides an empirical contribution by presenting local evidence regarding the linkage between unofficial marriages and the fulfillment of children’s rights. Consequently, it underscores the importance of policy interventions, including simplifying marriage registration procedures, improving access to civil registration services, and strengthening collaboration among the government, religious institutions, and community stakeholders in protecting children’s rights.
