Abstract

Every high state institution in the Republic of Indonesia has the authority contained in the 1945 Constitution of the Republic of Indonesia. The authority granted by the constitution is a binding authority for high state institutions. The strengths and weaknesses of the authority of high state institutions influence the constitutional law system in Indonesia. Authority between high state institutions is a reflection of the checks and balances in the democratic system in Indonesia. The People's Consultative Assembly (MPR) of the Republic of Indonesia has become the highest state institution after the 1945 Constitution of the Republic of Indonesia, where this institution is called the highest state institution. As a high state institution, the MPR has the authority to amend and enact the constitution. The MPR's authority is also stated in Law No. 17 of 2014 concerning MD3 in article 4, which is more ceremonial in nature. Strengthening the authority of the MPR is very necessary as a high state institution to create balance and corrections between state institutions. It is hoped that the MPR institution will not be a complementary high institution in the Indonesian constitutional system.

Abstract

The global impact of the Covid-19 pandemic has been substantial, particularly affecting the health and economic sectors across all countries. The virus's swift spread has resulted in heightened domestic activities, influencing the economy and disrupting businesses, employment, and overall social life. The Indonesian government has officially acknowledged the pandemic as a national crisis and emergency. In summary, the Covid-19 pandemic has deeply affected various facets, encompassing health, the economy, social interactions, and employment. To address this crisis, the government has implemented measures to mitigate its effects and safeguard the safety and welfare of the workforce. This study uses a method of normative jurisprudence with a legal approach (Statute Approach) and a case approach. (Case Approach). The library materials used in this writing are laws, court rulings, books, journals, websites and so on related to Covid-19, termination of employment, and force majeure. The findings of this research indicate that a company undergoing the challenges of the Covid-19 pandemic doesn't automatically qualify for force majeure; the company is required to demonstrate that the pandemic significantly impacts the viability of its operations, necessitating certain actions. Additionally, the rights of the workers must be upheld in such cases, ensuring their well-being and satisfaction. In legal proceedings, judges are tasked with enforcing the law in accordance with the principles of justice and the rule of law.

Abstract

The state has the responsibility to protect and promote labour in Indonesia, which is a human right in accordance with the constitution. Article 27 Paragraph (2) of the 1945 Constitution states that every citizen has the right to work and a decent life. However, labour problems continue to increase, caused by the lack of employment, the large number of workers, the low quality of workers‘ education, and the lack of supervision of workers’ rights, which reduces people's welfare. Laws in Indonesia, such as Law No. 13/2003 on Manpower and Law No. 11/2020 on Job Creation, aim to provide legal certainty and prevent arbitrary actions by employers. The regulation of labour relations is based on a work agreement that confirms the rights and obligations of all parties. Therefore, this study finds out the legal arrangements for Termination of Employment (PHK) before and after the existence of the Job Creation Law. In addition, this research also aims to analyse the legal protection of workers affected by layoffs, especially due to Force Majeur conditions after the existence of the Job Creation Law. This research uses a normative approach with qualitative juridical analysis. The data used is primary data as well as supporting data to assess the legal aspects related to termination of employment in the context of labour law in Indonesia.The new law, Job Creation, has caused controversy and dissent in the community. Previously, the layoff process required a determination from a dispute settlement institution, but with the Job Creation Law, companies can conduct layoffs with notice to workers. Legal protection for workers affected by layoffs, especially due to force majeure conditions, is important. Industrial Relations Court judges do not require a criminal court verdict for employers who conduct layoffs due to urgent offences. There are differences between Law Number 13 Year 2003 and Law Number 11 Year 2020 on Job Creation, especially in the mechanism of layoffs due to urgent violations, which are considered to violate the principle of presumption of innocence. Therefore, legal protection for workers needs to be adjusted to the principle of presumption of innocence.

Abstract

Perlindungan hukum terhadap pekerja kontrak di Indonesia masih menjadi perdebatan seiring dengan perkembangan regulasi ketenagakerjaan, terutama setelah diberlakukannya Undang-Undang Cipta Kerja. Penelitian ini bertujuan untuk menganalisis perlindungan hukum bagi pekerja kontrak di Indonesia melalui pendekatan Systematic Literature Review (SLR). Dengan mengkaji berbagai literatur, penelitian ini mengidentifikasi permasalahan utama dalam sistem Perjanjian Kerja Waktu Tertentu (PKWT), seperti ketidakpastian kerja, sistem kontrak berulang, serta minimnya jaminan sosial. Hasil penelitian menunjukkan bahwa regulasi ketenagakerjaan di Indonesia masih cenderung menguntungkan pengusaha dibandingkan pekerja kontrak, yang berakibat pada tingginya tingkat ketidakpastian kerja. Selain itu, kebijakan terbaru yang menghapus batas maksimal PKWT semakin memperburuk kondisi pekerja kontrak karena tidak adanya peluang untuk menjadi pekerja tetap. Oleh karena itu, diperlukan revisi kebijakan ketenagakerjaan yang lebih berpihak pada perlindungan pekerja, peningkatan pengawasan terhadap implementasi PKWT, serta peran aktif serikat pekerja dalam memperjuangkan hak-hak pekerja kontrak. Dengan demikian, diharapkan perlindungan hukum bagi pekerja kontrak dapat ditingkatkan guna menciptakan kesejahteraan tenaga kerja yang lebih baik di Indonesia.

Abstract

Sektor pertambangan di Indonesia merupakan salah satu industri dengan tingkat risiko kecelakaan kerja yang tinggi. Penelitian ini bertujuan untuk menganalisis bentuk perlindungan hukum yang diatur dalam peraturan perundang-undangan bagi pekerja yang mengalami kecelakaan kerja di sektor pertambangan dan mengkaji tanggung jawab pemberi kerja terhadap pekerja yang mengalami kecelakaan kerja menurut ketentuan hukum yang berlaku. Metode penelitian menggunakan pendekatan yuridis-normatif dengan analisis peraturan perundang-undangan dan konsep hukum yang relevan. Hasil penelitian menunjukkan bahwa perlindungan hukum bagi pekerja tambang diatur melalui dua pendekatan utama yaitu preventif dan represif. Perlindungan preventif meliputi kewajiban perusahaan menerapkan Sistem Manajemen Keselamatan dan Kesehatan Kerja (SMK3), menyediakan alat pelindung diri, dan mematuhi kaidah teknik pertambangan yang baik. Perlindungan represif mencakup sanksi administratif, penghentian operasi, dan ancaman pidana bagi pelanggaran keselamatan kerja. Tanggung jawab pemberi kerja pasca kecelakaan meliputi pemberian pertolongan pertama, pelaporan kepada otoritas terkait, pembiayaan pengobatan dan rehabilitasi, pemberian kompensasi, serta larangan pemutusan hubungan kerja selama masa pengobatan.

Abstract

Penelitian ini membahas kepastian hukum pada perjanjian kerja laut dalam memenuhi kesejahteraan awak kapal Nusantara Regas Satu. Dengan menggunakan metode yuridis normatif dan pendekatan perundang-undangan, penelitian ini bertujuan untuk mengidentifikasi hak-hak awak kapal yang diatur dalam Undang-Undang Nomor 17 Tahun 2008 tentang Pelayaran dan menjelaskan bentuk kepastian hukum yang diberikan kepada mereka. Hasil penelitian menunjukkan bahwa perjanjian kerja laut harus memenuhi standar kesejahteraan, termasuk upah layak, jaminan sosial, dan kondisi kerja yang aman. Meskipun terdapat regulasi yang mengatur, masih ada tantangan dalam implementasi dan penegakan hukum yang konsisten. Penelitian ini diharapkan dapat memberikan kontribusi dalam memahami pentingnya perlindungan hukum bagi awak kapal serta mendorong peningkatan kesejahteraan mereka.

Abstract

This study aims to trace the contradictions of sentencing arrangements in child sexual abuse crimes in Aceh after the enactment of Qanun No. 6 of 2014 with Law No. 35 of 2014 on Child Protection. The regulation of child sexual abuse punishment in jinayat law in Aceh has different interpretations from other laws and regulations, including Law No. 35 of 2014 on Child Protection. So the essence of the deterrent effect for perpetrators that should be part of the goal of criminalization is not so achieved. In addition, Qanun Jinayat also has the potential for impunity for the government with Article 9 and Article 11 Qanun No. 6 of 2014 on the reasons for justification and forgiving reasons. The method used in this paper is a normative juridical method, using secondary data or library data. The study results showed that in Aceh, there had been a dualism of the legal regulation of child sexual abuse. The provisions of qanun jinayat are still many shortcomings in providing protection and rights for children as victims, so law enforcement tends to choose positive laws. It is recommended that the Aceh government to harmonize the law between jinayat law provisions and positive laws relating to sexual harassment.

Abstract

of Supreme Court Decision Number 678 K/Pdt.Sus-PHI/2024 examines the application of force majeure in the case of unilateral termination of employment (PHK) between PT Lion Mentari Airline and a foreign worker, Isfarano Neal Brouwer, related to the COVID-19 pandemic. This study analyzes the application of labor law, the protection of workers' rights, and the obligations of employers in crisis situations. The results show that the Supreme Court affirmed the employer's obligation to provide compensation even if the reason for the layoffs is force majeure. Abstract

Penelitian ini menganalisa mengenai Putusan Nomor 6/PDT.SUS.GUGATAN LAIN-LAIN-AP/2020/PN.NIAGA.JKT.PST. Tujuan penelitian ini adalah: 1) Memahami bagaimana perusahaan asuransi bertanggung jawab kepada pemegang polis sebagai kreditor preferen dalam konteks kesalahan.; dan 2) Menyelidiki bagaimana mekanisme pergantian kurator berdasarkan Putusan Nomor 6/Pdt.Sus.Gugatan Lain-Lain-Ap/2020/PN.Niaga.Jkt.Pst. PT Asuransi Jiwa Bumi Asih Jaya. Penelitian ini menggunakan metode deskriptif analisis untuk menggambarkan kondisi atau keadaan saat ini terkait dengan objek penelitian. Penelitian ini masuk dalam kategori penelitian normatif, yang melibatkan penelitian terhadap kasus-kasus yang terkait dengan mekanisme pergantian kurator berdasarkan Putusan Nomor 6/Pdt.Sus.Gugatan Lain-Lain-Ap/2020/PN.Niaga.Jkt.Pst. PT Asuransi Jiwa Bumi Asih Jaya. Hasil penelitian ada dua, yaitu: 1) Perusahaan asuransi, dalam kasus PT Asuransi Jiwa Bumi Asih Jaya, bertanggung jawab kepada pemegang polis yang dianggap sebagai kreditor preferen akibat kesalahan yang dilakukan oleh perusahaan. Namun, tanggung jawab ini belum sepenuhnya terpenuhi sesuai dengan prinsip proporsionalitas.; 2) Dalam proses kepailitan PT Asuransi Bumi Asih Jaya, penggantian kurator diatur oleh Pasal 71 Undang-Undang Kepailitan dan PKPU (UUK-PKPU). Proses ini melibatkan permohonan yang diajukan oleh kurator, debitor, atau hakim pengawas. Permohonan ini melalui beberapa tahap, termasuk pengajuan kepada Panitera Pengadilan, Hakim Pengawas, dan Majelis Pemutus
