Abstract

Based on article 15 paragraph 1 of the Law on the Position of Notaries, article 1313 of the Civil Code and article 1320 of the Civil Code and also the principle of freedom of contract, a notarial deed can also be called an agreement with perfect evidentiary power. The legal consequences that arise if there is a violation in the formation of a notarial deed can be seen from two sides. Firstly, the legal consequences are seen in terms of the formal and material requirements of a notarial deed based on Law on the Position of Notaries Number 2 of 2014 concerning amendments to Law Number 30 of 2004 concerning the Position of Notaries. Of all the legal consequences listed in the UUJN, it only reduces the quality of an authentic notarial deed, turning it into a deed that has the power of proof as a private deed. Second, look at the conditions required in Article 1320 of the Civil Code. If the category of subjective requirements is not fulfilled, the result can be cancelled, which means that the cancellation must be requested before a judge. The category of objective requirements means that if they are not met, the legal consequences will make the agreement null and void. In this way, a notarial deed as an authentic deed can turn into a private deed and can also become null and void. The methodology used is normative with a statutory approach and a conceptual approach. The purpose of this writing is to determine the legal consequences of notarial deeds that are not made in accordance with legal provisions.

Abstract

Penyalahgunaan narkoba di kalangan remaja Indonesia telah menjadi isu kritis yang memerlukan perhatian serius dari berbagai pihak. Penelitian ini bertujuan untuk mengkaji dampak penyalahgunaan narkoba terhadap kesehatan fisik dan mental remaja, serta bagaimana hal ini mempengaruhi perkembangan sosial dan akademis mereka. Metode penelitian melibatkan studi literatur komprehensif dan survei yang dilakukan terhadap 500 remaja dari berbagai latar belakang di beberapa kota besar di Indonesia, termasuk Jakarta, Surabaya, dan Medan. Hasil penelitian menunjukkan bahwa penyalahgunaan narkoba berdampak signifikan terhadap kesehatan fisik remaja, termasuk penurunan fungsi organ vital, peningkatan risiko penyakit menular seperti HIV/AIDS, dan masalah gizi. Secara mental, remaja pengguna narkoba cenderung mengalami gangguan psikologis seperti depresi, kecemasan, dan gangguan tidur. Selain itu, terdapat bukti kuat bahwa penyalahgunaan narkoba berkontribusi pada perilaku agresif dan peningkatan risiko bunuh diri di kalangan remaja. Dampak sosial dari penyalahgunaan narkoba juga sangat merugikan. Remaja yang menggunakan narkoba seringkali mengalami kesulitan dalam menjalin hubungan sosial yang sehat, mengalami isolasi sosial, dan cenderung terlibat dalam aktivitas kriminal seperti pencurian dan kekerasan. Penelitian ini juga menemukan bahwa prestasi akademik remaja pengguna narkoba menurun drastis, ditandai dengan rendahnya nilai akademik, absensi yang tinggi, dan peningkatan angka putus sekolah. Penelitian ini menyoroti pentingnya dukungan dari keluarga dan komunitas dalam pencegahan dan rehabilitasi penyalahgunaan narkoba di kalangan remaja. Program edukasi yang menargetkan remaja dan orang tua mengenai bahaya narkoba terbukti efektif dalam meningkatkan kesadaran dan pengetahuan tentang risiko yang terkait dengan penyalahgunaan narkoba. Selain itu, program rehabilitasi yang holistik, yang mencakup dukungan psikologis, medis, dan sosial, sangat diperlukan untuk membantu remaja pulih dari kecanduan narkoba.

Abstract

Outsourcing in Indonesia has its advantages and disadvantages. It can create jobs and help reduce unemployment, but it also often creates problems between workers and companies. Every individual needs a job to earn a decent living, in accordance with the principles of the state. The government should ensure the welfare of its citizens by providing employment opportunities, as stipulated in the law. However, in practice, workers often lack adequate protection, especially with types of employment contracts such as non-permanent contracts that are favoured by employers because they reduce wage costs. Contracts such as non-permanent contracts can make workers feel anxious about the stability of their jobs and wages. Government intervention is considered essential to protect workers' rights. Law No. 13 Year 2003 regulates non-permanent contracts, and although it was revised by the Omnibus Law and Law No. 6 Year 2023, many people felt there were no significant changes. There is debate over the article that allows outsourcing of some jobs. In some cases, such as what happened at PT BM Tbk, there were violations of the law's provisions regarding PKWT, which made the employment relationship unclear. This research aims to understand more about the legal relationship of workers in outsourcing companies and the implications of Law No. 6 of 2023, as well as its impact on termination of employment. Therefore, this study aims to discuss the implementation of the legal relationship of workers in outsourcing companies after the enactment of Law No. 6 of 2023 as well as the termination of employment of workers in these companies, in comparison with Decision No. 524 K/Pdt.Sus-Phi/2022.This research uses the normative legal method, also known as doctrinal legal research, to understand the law as rules in legislation. The method is descriptive analytical, explaining current conditions based on facts. The approach used includes the analysis of relevant laws. The data used is secondary data from the literature, including primary, secondary, and tertiary legal materials, collected through documentation. Data analysis was conducted in a qualitative descriptive manner to answer the research problem. The research shows that the legal relationship between workers in outsourcing companies and layoffs after Law No. 6 of 2023 still does not provide legal certainty and justice. This is due to the uncertainty in the law and the unfairness of workers' positions. Three factors that impede justice are the lack of application of the principle of judicial independence, the vacuum of norms, and the utilisation of legal weaknesses by employers. The author suggests revising the law by involving the community and reminding outsourcing companies to follow the law for the sake of legal certainty and justice for workers.

Abstract

In conclusion, the procurement of goods and services by the government plays a critical role in driving Indonesia's development. As we have seen, this process not only contributes to economic growth through essential infrastructure projects but also fulfills the government's obligation to meet the needs of its citizens. Collaborations between the government and Micro, Small, and Medium Enterprises (MSMEs) are vital in ensuring that these efforts are effective and mutually beneficial. By fostering partnerships based on trust and shared goals, both the government and MSMEs can strengthen their capabilities to support national progress. Ultimately, a strategic approach to procurement will pave the way for sustainable development, benefiting all layers of society while enhancing the overall resilience of Indonesia's economy.This research is a normative juridical research with a statutory approach. The author uses secondary data using primary, secondary, and tertiary legal materials. The method of analysis used is qualitative method. The author concludes that the form of MSME Partnership cooperation is regulated in Law No. 11 of 2020 concerning Job Creation, including partnership patterns such as Inti-plasma, subcontracting, franchising, and others, which are also explained in Government Regulation No. 7 of 2021. Legal protection for MSMEs is regulated in several laws, and partnership cooperation provides good protection through coaching and development that includes financing, infrastructure, training, and market access. If there are any disputes related to the partnership, the responsibilities and problem solving are clearly stipulated in the agreement.

Abstract

This study examines the Comparative Analysis of Outsourcing Legal Regulations in Indonesia and the Philippines. Unlike Indonesia, which absolves the Employer Company of responsibility for fulfilling the rights of outsourced workers, the focus of outsourcing regulations in the Philippines—from the Labor Code to Department Order No. 174 Series of 2017—is the protection of outsourced workers' rights. The guaranteed protection of outsourced workers’ rights has proven successful as a foundation for the Philippines to foster a healthy outsourcing climate, which has become one of the catalysts for economic development in the Philippines, evenduring the pandemic. This study is a normative juridical research conducted through legal comparison using a Statute Approach and a Comparative Approach. The legal materials utilized in this research consist of primary, secondary, and tertiary legal sources. Data collection was conducted through document studies from 2023 to 2024. Based on the collected data, this study employs a qualitative approach for data analysis. In Indonesia, outsourcing is regulated by Law No. 13 of 2003 on Manpower, Law No. 6 of 2023 on Job Creation, and their implementing regulations. Meanwhile, the Philippines regulates outsourcing through DOLE 174, Republic Act No. 11199 of 2019 and its amendments, as well as related rules that emphasize the welfare protection of outsourced workers and legal certainty for investors. Worker protection in the Philippines focuses more on workers' fundamental rights and occupational safety, with policies requiring outsourcing companies to ensure their workers receive protection aligned with national standards.

Abstract

The increase of corruption now could not be categorized as common crime anymore but it had been an extraordinary crime. The way to wipe it out could not be done commonly too. It also demanded an extraordinary way. Law enforcement to remove the corruption done conventionally so far had various obstacles. Thus, extraordinary method of law enforcement was needed by forming a special committee that had a wide and independent authority and free from any power. The committee was KPK that was formed officially based on regulation No 30 year 2002. The normative role and function of KPK was doing investigation and prosecution on the case of corruption involving apparatus of law upholder, state operator, and other people who dealt with corruption case and dealt with nation loss at least Rp1.000.000.000,- (one billion rupiah). Besides having several strong points, in the practice of removing corruption, KPK also had many challenges; some of them were the working area of KPK that was too wide, the problem of relationship inter institution of corruption removing, and KPK socialization had not touched society.

Abstract

Retaliatory criminal law is a fundamental paradigm in the criminal justice system that emphasizes appropriate retribution against perpetrators of crimes. This study comprehensively examines the concept of retaliatory criminal law, its implementation in the Indonesian legal system, and its implications. Through a normative juridical approach and comparative analysis, this study reveals that although retaliatory criminal law has strong philosophical legitimacy, its implementation faces various challenges in the context of modern criminal law developments. The New Criminal Code (Law No. 1 of 2023) demonstrates a paradigm shift from pure retribution to a neoclassical approach that integrates corrective, restorative, and rehabilitative elements. This study finds that the implementation of supervisory punishment as an alternative to sentencing reflects the evolution of a more humanistic concept of retaliatory criminal law. However, technical challenges in its implementation, especially for law enforcement officials such as prosecutors, require comprehensive supporting regulations. The study's conclusions demonstrate the need to balance the goal of retribution with aspects of victim recovery and perpetrator rehabilitation to achieve more holistic justice.

Abstract

This study aims to examine the effectiveness of Indonesia’s legal framework in protecting victims of domestic violence through a normative juridical approach combined with a comparative method. The research analyzes the implementation of Law No. 23 of 2004 on the Elimination of Domestic Violence and Law No. 12 of 2022 on Sexual Violence Crimes, comparing them with international instruments such as the Domestic Abuse Act 2021 (United Kingdom), the Violence Against Women Act 2022 (United States), and the Istanbul Convention 2011 (Europe). Findings reveal that Indonesia’s legal norms are conceptually comprehensive but remain limited in practice due to structural, cultural, and institutional barriers. Weak coordination among implementing agencies, the insufficient number of Regional Technical Implementation Units for Women and Children Protection (UPTD PPA), and low public awareness continue to hinder effective victim protection. The study recommends harmonizing domestic legislation, strengthening local service institutions, and adopting a victim centered justice approach aligned with international best practices to enhance the protection of women’s rights in Indonesia.

Abstract

Indonesia sebagai negara agraris dengan potensi sumber daya alam melimpah menghadapi tantangan serius dalam ketahanan pangan akibat pertumbuhan penduduk yang pesat dan perubahan iklim. Program Food Estate dirancang sebagai upaya strategis pemerintah untuk mengatasi krisis pangan melalui pengembangan pertanian terintegrasi di kawasan perdesaan guna meningkatkan produksi pangan, mengurangi ketergantungan impor, dan mendorong transformasi ekonomi pedesaan. Penelitian ini bertujuan menganalisis sejauh mana implementasi Program Food Estate telah sesuai dengan Undang-Undang Nomor 18 Tahun 2012 tentang Ketahanan Pangan serta dampaknya terhadap transformasi sosial dan perekonomian nasional. Metode yang digunakan adalah yuridis normatif dengan studi literatur yang mengkaji peraturan, dokumen resmi, dan yurisprudensi terkait. Hasil penelitian menunjukkan bahwa program ini menghadapi kendala seperti ketidakselarasan dengan kebutuhan lokal, konflik agraria, serta risiko lingkungan yang berpotensi menghambat keberlanjutan proyek. Implikasi penelitian menekankan perlunya evaluasi kebijakan dan penyesuaian strategi yang mengutamakan keberlanjutan lingkungan dan keadilan sosial agar manfaat ekonomi dapat dirasakan secara optimal. Penelitian ini memberikan kontribusi penting dalam pengembangan kebijakan ketahanan pangan dan pembangunan berkelanjutan di Indonesia.

Abstract

Studi ini melakukan analisis yuridis terhadap pembayaran imbalan jasa kurator dalam kasus kepailitan yang dibatalkan oleh pengadilan. Melalui pendekatan yuridis normatif dengan studi statuta dan kasus, serta analisis dokumen putusan, pembahasan difokuskan pada landasan hukum, kriteria penentuan imbalan, dan implikasinya bagi kreditur dan debitur. Kurator tetap berhak atas imbalan jasa meski status kepailitan dibatalkan. Hal ini diatur dalam Undang-Undang Nomor 37 Tahun 2004 dan Permenkumham Nomor 18 Tahun 2021, di mana besarannya bergantung pada nilai aset, tingkat kesulitan tugas, serta kontribusi kurator selama proses kepailitan. Temuan utama menunjukkan bahwa dalam 3 dari 5 putusan kepailitan yang dibatalkan (60%), pengadilan tetap memberikan imbalan kepada kurator dengan besaran antara Rp50.000.000 hingga Rp150.000.000, tergantung kontribusi kurator dan jumlah aset yang sempat dikelola. Prinsip keadilan dan kepastian hukum menjadi landasan utama dalam pertimbangan hakim. Namun, penelitian juga mengidentifikasi adanya celah hukum yang dapat menimbulkan sengketa antara debitor dan kreditor, terutama dalam hal besaran imbalan dan peran kurator pasca pembatalan. Oleh karena itu, disarankan adanya revisi regulasi untuk mengatur secara eksplisit ketentuan imbalan jasa pasca pembatalan kepailitan, memperkuat peran pengadilan dalam mediasi, serta mendorong akuntabilitas kurator melalui pelaporan dan dokumentasi yang transparan.
