Abstract

The study cases were selected based on their relevance and complexity in the context of legal considerations in post-divorce child custody. Decision Number ---/Pdt.G/2023/PN Smn was chosen because it provides an in-depth understanding of the legal framework and factors considered in post-divorce child custody cases. This research will use a qualitative approach with a case study design. This approach was chosen to understand in depth the legal considerations used in determining child custody after divorce. Researchers will study legal documents such as court decisions, judge's considerations, and statutory regulations related to determining child custody after divorce. Post-divorce child custody can be a difficult and controversial issue, especially in cases involving an unexpected and disorganized divorce. In this research the author focuses on the context of legal considerations in post-divorce child custody in Decision Number ---/Pdt.G/2023/PN Smn. This research uses a qualitative approach with a case study design. The research results show that court decisions can influence various aspects of children's lives, including economic stability, parenting patterns, and interactions with the social environment. Therefore, judges must consider all these aspects carefully and comprehensively to ensure that the decisions taken truly prioritize the best interests of the child.

Abstract

Indonesia's legal efforts to prevent statelessness in children born to unregistered mixed marriages between Indonesian citizens (WNI) and foreign nationals (WNA) are an important concern because the unclear status of the marriage causes children to lose the administrative basis for obtaining citizenship. The research method used is normative juridical with a legislative and case approach, one of which is the case of Efa Maulidiyah in Malaysia. The results of the study show that children of Indonesian mothers still have civil relations based on Article 43 paragraph (1) of Law Number 1 of 1974 and Constitutional Court Decision Number 46/PUU-VIII/2010, so they are entitled to Indonesian citizenship based on the principle of ius sanguinis in accordance with Article 4 letter (d) of Law Number 12 of 2006. To overcome administrative obstacles, the Indonesian government implemented Permenkumham Number 6 of 2025 as a mechanism for confirming the citizenship status of children born to mixed marriages and strengthening legal protection for Indonesian children abroad.

Abstract

Pertumbuhan urbanisasi di Indonesia mendorong pembangunan hunian vertikal, namun sering memunculkan sengketa hukum terkait status tanah, khususnya Hak Guna Bangunan (HGB) di atas Hak Pengelolaan (HPL). Penelitian ini menganalisis kedudukan yuridis HGB atas HPL dalam sistem hukum pertanahan Indonesia, dengan fokus pada sengketa kepemilikan di Apartemen Mangga Dua Court, di mana pembatalan perpanjangan HGB oleh Badan Pertanahan Nasional (BPN) menimbulkan ketidakpastian bagi pemilik unit. Dengan menggunakan metode yuridis normatif dan analisis kualitatif berbasis literatur, penelitian ini menemukan bahwa HGB atas HPL diakui secara hukum berdasarkan UUPA dan PP No. 18 Tahun 2021, namun bergantung pada persetujuan pemegang HPL sehingga berpotensi dibatalkan. Perlindungan hukum bagi pemilik rumah susun terhadap ketidakterbukaan status tanah oleh pengembang diperkuat oleh UU Rumah Susun dan UU Hak Tanggungan, yang mengakui Hak Milik atas Satuan Rumah Susun (HMSRS) sebagai hak mandiri. Penelitian ini menyimpulkan bahwa harmonisasi regulasi dan peningkatan kesadaran hukum diperlukan untuk menjamin kepastian hukum dan perlindungan konsumen dalam pengelolaan tanah.
