Abstract

Visual communication design education in Indonesia has long applied studio-based teaching methods influenced by the history of the European design education system. In studio-based learning, students are required to master competencies formed from; personality competence, technical competence, communication competence, methodological competence, and social competence. In the studio room, student knowledge is developed by conducting training guided by lecturers. The studio trained technical exercises such as sharpening hand skills, processing taste, and shape. The studio also forms students' understanding of the design's concept. Gradually the quality in designing can be formed. With the Covid-19 pandemic, studio-based teaching methods have been forced to be carried out online. This article seeks to describe the forms and processes of change in learning in studios that use digital technology as a result of the pandemic conditions. By taking some examples of cases of application of learning in the design studio, the presentation intends to reflect a new learning style rooted in studio-based learning in visual communication design education and to present ideas that become material for further research for the development of learning methods in the field of design in the future.

Abstract

The trade of products bearing well-known marks often encounters various issues, primarily arising from acts of passing off perpetrated by business actors acting in bad faith. Well-known marks, which enjoy a strong reputation, are frequently exploited by irresponsible parties seeking to boost sales and profit from the unauthorized use of such marks. However, such practices can cause significant harm to the owners of well-known marks by misleading the public and damaging the reputation that the marks have painstakingly built over time. In this context, this legal research adopts a normative legal approach, also known as doctrinal legal research, which focuses on the study of literature and secondary legal materials, including both primary and secondary legal sources. Based on the findings of the research, the regulation of trademarks in Indonesia is clearly stipulated in Trademarks and Geographical Indications Act. One of the preventive measures to address acts of passing off against well-known marks is the registration of the mark through a formal application process, which grants legal protection to the mark in accordance with the provisions of Trademarks and Geographical Indications Act. With valid trademark registration, passing off actions against well-known marks can be deterred, as the registered marks enjoy stronger legal protection. Owners of registered well-known marks are entitled to file lawsuits in the Commercial Court against parties that use similar marks without authorization or legitimate rights, whether for goods or services of a similar nature or otherwise. This is aimed at safeguarding the interests of well-known mark owners from potential losses caused by trademark infringements. Lawsuits brought by the owners of well-known marks may include various legal claims, such as claims for damages and requests for injunctions to cease activities related to the trademark infringement. The conclusion of this research indicates that passing off arises from the bad faith of business actors who are solely focused on profit-seeking motives.

Abstract

Penelitian ini bertujuan untuk mengetahui tetkait bagaimana perlindungan menggunakan merek terkenal dalam kasus Pierre Cardin tanpa izin pemilik merek berdasarkan Putusan No.49L/Pdt.Sus-HKI/2018.  Adapun hasil penelitiannya yakni sebagai berikut.  Putusan PN No. 15/Pdt.Sus-Merek/2015/PN.NIAGA/JKT.PST Jo Putusan Kasasi No. 557K/Pdt.Sus-HKI/2015 mengenai merek terkenal Pierre Cardin tidak mempertimbangkan Undang-Undang No. 20 Tahun 2016 tentang Merek dan Indikasi Geografis secara normatif.  Hal ini dikarenakan hakim dalam pertimbangannya wajib mempertimbangkan Konvensi Paris sebagai dasar hukum internasional yang telah diratifikasi oleh Indonesia.  Lebih tepatnya pada Pasal 16 TRIPs.   Penelitian ini menghasilkan suatu kesimpulan bahwa pendaftaran merek Pierre Cardin yang telah didaftarkan oleh Alexander Satryo Wibowo (WNI) telah diatur dalam Pasal 76 ayat (1) jo Pasal 83 ayat (1) UU Merek.  Metode penulisan yang dipakai yakni berupa penelusuran literatur hukum normatif yang terdiri atas beberapa asas hukum terkait, sistematika hukum, dengan menggunakan pendekatan peraturan perundang-undangan atau statute approach. Kesimpulan yang didapat adalah hakim telah memberikan mispersepsi yang salah dalam mempertimbangkan dan memutus perkara tersebut hingga tafsiran tersebut tidak sesuai dengan yang terdapat dalam Kovensi Paris. Maka dari itu, kami ingin mengulasnya menjadi suatu artikel hukum dengan judul Analisis Yuridis Perlindungan Menggunakan Merek Terkenal Pierre Cardin Tanpa Izin Pemilik Merek Menurut Putusan Peninjauan Kembali Mahkamah Agung Nomor 49L/PDT.SUS-HKI/2018.
