Abstract

Hukum islam merupakan hukum yang bersifat universal dan bisa diterapkan dalam pembangunan hukum nasional, hukum islam tidak serta merta memaksakan pemahaman kepada kaum non muslim untuk menjalankannya, hukum islam menghormati perbedaan pemahaman dalam menjalankan agama masing-masing menurut kepercayaan masing-masing. Temuan penelitian ini menunjukkan bahwa hukum Islam telah tercermin dalam sistem hukum nasional. Jika peraturan yang tercantum dalam Undang-Undang dapat dilaksanakan dengan baik dalam kehidupan berbangasa dan bernegara maka akan dapat meredam akan peredaran dan penyalahgunaan narkotika. Hal ini akan dapat berjalan dengan baik manakala ada kerja sama yang baik dari berbagai pihak yakni antara masyarakat dan penguasa. Upaya kerja sama ini sangat penting untuk dilakukan dalam rangka mewujudkan kehidupan yang tertib aman, dan sejahtera sebagaimana yang dipaparkan dalam pasal undang-undang dasar 1945 dan pancasila sebagai dasar negara. Selain kontribusi tehadap Undang-undang yang secara substansial tersebut di atas, terdapat beberapa produk perundang-undangan yang sifatnya mencantumkan hukum-hukum secara tekstul yang bersumber dari Al-quran dan hadis Nabi.

Abstract

In the application of akad muarakah, Shariah Financial Institutions (SFIs) agree to melt some of the assets they own jointly with customers to implement a specific venture. The proceeds of the effort will be shared between LKS and the customer based on the percentage of contributions made, both cash and non-cash. Such a practice is commonly known as the term yield sharing. To provide a sense of security for all parties involved in this practice, the National Shari'ah Council (NSN) which is part of the Indonesian Ulema Assembly (MUI) has issued fatwa MUI No. 8/DSN-MUI/IV/2000. In the Fatwa has been discussed about everything related to muarakah starting from ijab qabul, capital specifications, division of labor to profits and losses that all parties must bear. To accommodate muarakah transactions, the Indonesian Accounting Association (IAI) has issued Financial Accounting Standards Statement (PSAK) number 106 in 2007 which regulates in detail the accounting of muarakah transactions. MUI fatwa no 8/DSN-MUI/IV/2000 is certainly one of the foundations of the formation of PSAK 106 on muyarakah.

Abstract

This study aims to analyze the implementation of caning punishment and its influence on the level of public legal awareness. The research employs a socio-legal approach with a descriptive-analytical method. Data were collected through a literature study of legislation, related qanun, as well as Islamic law and national law literature, supported by empirical data from social conditions in the community. Data analysis was conducted qualitatively to illustrate the relationship between the application of caning punishment and changes in legal behavior among the public. The results of the study indicate that caning punishment has an impact on public legal awareness, particularly in terms of compliance with the norms of Islamic Sharia law. This punishment creates a deterrent effect and functions as a means of legal education in a social context. However, its effectiveness is greatly influenced by the public’s understanding of the purpose of the punishment, the consistency of law enforcement, and the approach employed by law enforcement officers. If caning emphasizes only the repressive aspect without being balanced with legal guidance and education, the resulting legal awareness tends to be superficial and temporary. This study concludes that caning punishment can contribute to enhancing public legal awareness if it is applied proportionally, fairly, and in alignment with humanitarian values and local wisdom. Therefore, strengthening the educational aspect and legal socialization is necessary so that caning is understood not merely as a sanction but also as an instrument for moral and social development within society.
