Abstract

Keadilan restoratif di Indonesia telah diterapkan dalam tindak pidana umum dan tindak pidana anak. Penerapan keadilan restoratif dalam tindak pidana umum melalui Peraturan Kapolri, Peraturan Jaksa Agung dan Peraturan Mahkamah Agung, sedangkan keadilan restoratif dalam tindak pidana anak melalui Undang-Undang Nomor 11 Tahun 2012 tentang Sistem Peradilan Pidana Anak. Permasalahan penelitian adalah bagaimana model keadilan restoratif yang diterapkan dalam tindak pidana umum dan tindak pidana anak? bagaimana penerapan model keadilan restoratif yang diterapkan dalam tindak pidana umum dan tindak pidana anak dalam praktek pengadilan  di indonesia? Penelitian ini merupakan penelitian hukum normatif, yaitu penelitian yang menggunakan bahan pustaka atau data sekunder yang terdiri dari bahan hukum primer, bahan hukum sekunder sebagai data utama. Hasil penelitian menyimpulkan model keadilan restoratif yang nampak diterapkan dalam tindak pidana umum dan tindak pidana anak adalah model Dual Track System Selective yakni memiliki dasar pertimbangan jalur penyelesaian melalui pendekatan restoratif secara selektif dengan parameter yang jelas dalam perkara-perkara tertentu yang berdampingan dengan jalur sistem peradilan pidana. Penerapan model keadilan restoratif dalam tindak pidana umum dan tindak pidana anak diterapkan sejak tahap penyidikan, penuntutan dan pemeriksaan pengadilan. Penerapan keadilan restoratif tindak pidana umum tidak disertai dengan penetapan pengadilan guna memperkuat kesepakatan penyelesaian yang adil bagi para pihak, sedangkan keadilan restoratif dalam tindak pidana anak diperkuat dengan permintaan penetapan pengadilan.

Abstract

Political parties fulfill the criteria as corporations in the Corruption Crime Eradication Law. Political parties that benefit from the results of criminal acts of corruption have not been held criminally responsible for their administrators or members. This paper examines the rationale for criminal accountability of political parties in criminal acts of corruption committed carried out by the management or members and their criminal law policies. This paper is a type of normative juridical research in a broad sense. The basic idea of criminal accountability for political parties in acts of corruption must consider six things, among others; blameworthiness, need, moderation, inefficiency, control costs, and the victim's interests. For future reforms, it is necessary to regulate the formulation of the main types of punishment that are structural or institutional in nature.

Abstract

Child marriage is a serious issue that has yet to be addressed by Indonesia. This practice severely affects the rights of the child and also Indonesian society as a whole. From a human rights perspective, child marriage is a form of gender-based violence. The causes of early marriage in Indonesia include pregnancy out of wedlock, which is also supported by westernized social life as well as the influence of the media, low education, economic factors and patriarchal culture. Meanwhile, other South Asian States such as India are influenced by economic violence against Muslim women perpetrated by their husbands. This practice in India has a detrimental impact on Muslim women's access to health services, educational attainment, social mobility, and employment opportunities. Furthermore, Bangladesh is affected by family poverty, while Pakistan is affected by financial shocks and school dropout rates. Although multiple factors causally affect the prevalence of child marriage, Indonesia and other South Asian States have shown that protective laws may help to lower the rates of child marriages and adolescent fertility. This article analyzes Indonesia's legal framework in efforts to protect child marriages and compares it with other South Asian States. The main issue of this paper is that early marriage violates the children's rights and both the Indonesian government and the international community should be obligated to combat early child marriage. The methodology employed by this article is a qualitative method of comparative legal case study, where secondary data such as books, articles, reports, online web sites, and court cases are analyzed. This article concludes that existing evidence shows that Indonesia and other South Asian states still lack in enforcement and monitoring delays to ensure the rights of the child and protect women. Alternative legal protection should be applied in order to ensure that women and children can gain access to higher education and hold their life in their own hands

Abstract

Penelitian ini menghadirkan analisis yuridis terkait pemidanaan terhadap anggota militer yang terlibat dalam tindak pidana perzinahan.Studi kasus berfokus pada Putusan Nomor 2-K/PMT-II/AU/I/2023. Kasus ini dilaporkan oleh istri sah anggota militer tersebut, yang melibatkan pertemuan di sebuah kafe di palangan, Yogyakarta pada bulan September 2021. Terdakwa kemudian terlibat dalam hubungan pacaran dan intens berkomunikasi melalui telepon dan aplikasi WhatsApp dengan saksi-saksi terkait. Masalah dan tujuan : (1) mengapa Majelis Hakim memilih menjatuhkan pidana berdasarkan Pasal 284 ayat (1) ke-1 huruf a KUHP dan bukan Pasal 281 ke-1 KUHP dalam Putusan Nomor 2-K/PMT-II/AU/I/2023. (2) Apakah penjatuhan pidana penjara selama 7 bulan terhadap terdakwa oleh Majelis Hakim dalam Putusan Nomor 2-K/PMT-II/AU/I/2023 sudah memenuhi rasa keadilan atau belum?. Metode penelitian ini menggunakan tipe penelitian hukum normatif, sifat penelitian bersikap deskriptif dan analisis, data penelitian ini menggunakan data primer serta data sekunder, analisis data dilakukan secara kualitatif, cara penarikan kesimpulan menggunakan deduktif yaitu menarik kesimpulan khusus dari pernyataan umum. Kerangka konsepsual : (1) Hukum Perkawinan, (2) Tindak Pidana Zinah, (3) Peradilan Militer. Cara pengumpulan data yaitu menggunakan sumber data dari Perpustakaan Nasional dan juga Perpustakaan  Fakultas Hukum Universitas Trisakti dengan menggunakan metode survei literatur data sekunder. Penelitian ini mengevaluasi putusan Pengadilan Militer Tingkat Pertama terkait kasus perzinahan. Kesimpulan penulis menyoroti bahwa Terdakwa mengakui kesalahannya, menyesali perbuatannya, dan meminta maaf kepada istrinya. Majelis Hakim Pengadilan Militer Tingkat Pertama disalahkan karena keliru menerapkan hukum terkait dakwaan alternatif. Penulis berpendapat bahwa pandangan mereka sesuai dengan Pasal 284 ayat (1) ke-1 huruf a KUHP. Oditur Militer Tinggi menuntut hukuman penjara selama 9 bulan, tetapi Majelis Hakim Tinggi menganggap pidana 7 bulan sudah memenuhi rasa keadilan. Penulis berpendapat bahwa pidana seharusnya maksimal 9 bulan, sesuai dengan tuntutan Oditur Militer Tinggi. Evaluasi ini mengajukan pertimbangan terhadap keputusan pengadilan dan memberikan perspektif terkait keadilan dalam penjatuhan hukuman.

Abstract

On several occasions, Indonesian competition authorities have attempted to apply Article 14 to adjudicate violations related to vertical integration practices; however, these attempts were invalidated at the objection and cassation levels. The criteria utilized include the concepts of unfair business competition and public harm, as these terms are instrumental in determining the impacts of violations concerning vertical integration. This research aims to examine the legal approaches employed by Indonesian competition authorities in addressing vertical integration, with a particular focus on the technology sector. The findings indicate that the criteria for assessing whether vertical integration constitutes a violation of unfair business competition vary among Indonesia, the United States, and the European Union. In Indonesia, the emphasis is on preventing the exclusion of access to essential raw materials or significant buyers, utilizing the Rule of Reason approach. In contrast, the U.S. evaluates public detriment by balancing fairness and competitive benefits, whereas the EU focuses on market dominance and its potential to reduce competition. Despite these variations, all three jurisdictions share a common objective of enhancing consumer welfare and promoting competitive market conditions, with specific regard to differing regulations on online sales restrictions.

Abstract

Narcotics abuse is a complex legal problem because on the one hand it is seen as a criminal act, but on the other hand, narcotics can also be used for medical recovery purposes as regulated in Law Number 35 of 2009 concerning Narcotics. The difference between the use of narcotics in the context of medical recovery and the illegal abuse of narcotics often does not receive adequate attention in judicial practice, especially in the evidentiary mechanism in trial. The formulation of the problem raised in this study is "What is the strength of the evidence of expert testimony in the Denpasar District Court Decision Number 1050/Pid.Sus/2022/PN Dps?" This study uses a normative legal research type with a descriptive nature. Data analysis was conducted qualitatively with deductive conclusions drawn. The results of the discussion and conclusions indicate that expert testimony in this case has valid, formal evidentiary power. The use of drugs included in certain categories should be accompanied by a letter or official document proving that the person concerned has permission to use the drugs. The absence of this document demonstrates the importance of expert testimony in providing evidentiary power, particularly in assessing whether the act constitutes drug abuse
