Abstract

This research discusses and examines how the disruption of Palestinian food supply as a result of genocide committed by Israel against Palestine and the implications that occur as a result of the Genocide. This research is studied from the perspective of humanitarian law, specifically from the 1949 Geneva Convention, which previously explained the importance of food supply which is closely related to food security. This research aims to find out that in the conflict there are attitudes and behaviors of Israel that are contrary to the norms of international humanitarian law, as well as knowing whether the norms of humanitarian law are applied in the conflict and what legal consequences arise from the conflict to Palestine and Israel. The result of the discussion of this research is that Israel has violated several provisions of the Geneva Convention of 1949 concerning the protection of civilians in time of war.

Abstract

Indonesia will hold presidential and vice-presidential elections, however, currently, the election mechanism for presidential and vice-presidential candidates only accommodated nominations through political parties and also still uses the provisions of the Presidential Threshold. Indonesia is a country that adheres to a democratic system which of course strongly adheres to the principle of people's sovereignty which guarantees the rights of all its citizens, and should also accommodate the mechanism of presidential nomination through individual or independent channels. Thus, blocking the rights of some citizens who wish to nominate themselves through non-political party channels, indicates that democratic principles have not been implemented properly. Based on this background, the formulation of the problem, how is the accommodation of individual candidates in the presidential election and the elimination of the presidential nomination threshold in Indonesia and the solution as a democratic country from the perspective of the 1945 Constitution? The type of research used is juridical-normative research, in designing the format of the mechanism for the recruitment of candidates for president and vice president in the electoral system in Indonesia, it must be by democratic principles, this is based on the preamble of the 1945 Constitution as the highest law in Indonesia that adheres to the principle of people's sovereignty. To implement democratic principles well in general elections, Indonesia needs to apply a two-door recruitment mechanism format, which is a format that provides two kinds of doors as a nomination pathway. Based on this, it is necessary to immediately implement and realize a two-door nomination mechanism, namely through political parties and also through individual or independent channels in the Presidential Election and it is also necessary to remove the Presidential Threshold to carry out democratic elections. and justice to maintain peace and prosperity.

Abstract

The existence of a consumer protection law and the ratification of the CRPD by the Indonesian government is expected to guarantee the safety and comfort of consumers, including persons with disabilities. Therefore, the problem of comparative regulation and institutional, as well as the supervision of the implementation of public services for persons with disabilities, is raised in Indonesia and Australia. Australia was chosen as a comparison because this country already has a comprehensive protection system for persons with disabilities and is fully committed to providing public service facilities. This research is a prescriptive normative research using secondary data consisting of primary legal materials and secondary legal materials. This study concludes that similar to Indonesia, the formation of regulations and policies in Australia in the public service sector for persons with disabilities has reached a technical level and is carried out in a coordinated manner between the center and the regions. The basic difference is that the institutional system that handles the planning, implementation, and supervision of public services for persons with disabilities in Indonesia is separated into various ministries and/or agencies so that it requires strengthening synergies at the central and regional levels so that the implementation of public services is guaranteed optimally.

Abstract

Discrimination against women's rights, especially in the right to marry, still occurs in Indonesia, contradicting existing legal regulations, one of which is the Piti Rambang tradition in Sumba. Women's rights are part of human rights (HAM), and as universal rights based on equality, the recognition and protection of human rights should be fulfilled for all individuals, both men and women. The state clearly plays an important role in this, and therefore, every country has the primary obligation based on human rights. This disparity forms the basis of this research problem, namely how the state’s primary obligation in the right to marry applies to the Piti Rambang tradition. This research uses normative legal research that describes the primary obligations of a state related to discrimination against women in an Indonesian custom, specifically Piti Rambang. This tradition violates the right to marry for Sumbanese women, and the state is obliged to respect, protect, and fulfill human rights. The state is expected to ensure the fulfillment of its obligations and to prevent discrimination from the Piti Rambang tradition.

Abstract

Penelitian ini bertujuan untuk mengidentifikasi bagaimana peraturan hukum di Indonesia dalam menangani perdagangan orang dan eksploitasi ekonomi lintas negara serta apa saja faktor-faktor yang menyebabkan terjadinya perdagangan orang sebagai bentuk kejahatan ekonomi transnasional di Indonesia. Melalui pendekatan normatif dengan metode pendekatan perundang-undangan dan konseptual, kajian ini menelaah instrumen hukum nasional seperti KUHP, Undang-Undang No. 21 Tahun 2007 tentang Pemberantasan Tindak Pidana Perdagangan Orang (UU TPPO), serta konvensi internasional yang telah diratifikasi Indonesia. Hasil penelitian menunjukkan bahwa meskipun Indonesia memiliki kerangka hukum yang relatif komprehensif, pelaksanaannya masih menghadapi berbagai hambatan seperti lemahnya koordinasi antar lembaga, kurangnya pemahaman aparat penegak hukum, serta ketakutan korban untuk melapor akibat ancaman dan stigma sosial. Kajian ini menekankan pentingnya pendekatan terpadu dalam pencegahan, perlindungan, dan penindakan terhadap pelaku kejahatan perdagangan orang. Selain itu, penelitian ini juga menyoroti perlunya reformasi struktural dan peningkatan kapasitas kelembagaan guna menjamin perlindungan hak asasi manusia secara menyeluruh dan efektif.

Abstract

Access of Indigenous children to education remains a problem when there is discrimination in learning, treatment, and the use of the language and culture in schools. This impacts on the achievement of education for all. Discriminatory fulfilment of the right to education for Indigenous children is not only experienced by developing countries, but in fact indigenous children in developed countries experienced the same thing. The Ainu tribe children in Japan still experiences discrimination in the world of education, but in contrast to the Anak Dalam tribe in Indonesia, the Indonesian Government has sought to obtain their rights. The role of the government in fulfilling the right to education is very important as the entity responsible for upholding human rights. The government's role in inclusive education raises the issue of the rights of indigenous children in the fields of culture and education to a more real significant and realistic.

Abstract

The increase in religious-based conflicts is the result of the use of religion by officials of the ruling Indian government who want to attract sympathy and support from the Indian population who are Hindu, which is the most widely followed belief in India. Since 2014, the government's policies have been perceived by the Indian and international community to marginalize Indian Muslims, particularly with the Citizenship Amendment Bill (CAA 2019). This paper discusses the racism that arises due to the differentiation in beliefs in Indian citizens. The research conducted in this paper is normative legal research using the library method. The results of the analysis are discussed with reference to the International Covenant on Civil and Political Rights. It can be concluded that the sectarian conflict in India due to the Citizenship Law is a form of discrimination that is contrary to Article 18 of the International Covenant on Civil and Political Rights, so there needs to be a further process in upholding religious rights in India.

Abstract

The right of diplomatic immunity has been contained in the 1961 Vienna Convention on Diplomatic Relations to support the performance of diplomats' duties, but the implementation of this right is often not in line with its designation. As the action of Secretary II Hyon Kwang Song, a diplomatic official of the North Korean Embassy in Malaysia who was involved in the murder of the North Korean leader's brother, Kim Jong Nam. Based on that, this research discusses the action of Hyon Kwang Song who abused the right of diplomatic immunity and the juridical effort made by Malaysia and North Korea in resolving this case. The research technique used normative legal research through descriptive secondary materials and deductive inference. The results of the analysis show that Hyon Kwang Song's action is a form of abuse of diplomatic immunity so that Malaysia declares Hyon Kwang Song as persona non grata or a person who is denied existence, but on the other hand North Korea tries to protect Hyon Kwang Song and does not impose any penalty on the diplomat due to political interest. The conclusion is that diplomatic relations are inseparable from political interest and abuse of diplomatic immunity often occurs and political interest influences the settlement of this case which has resulted in the termination of diplomatic relations between Malaysia and North Korea.

Abstract

Perusahaan-perusahaan terinspirasi untuk berinovasi dengan munculnya teknologi digital. Salah satu cara mereka melakukannya adalah dengan menggunakan blockchain dalam platform kontrak pintar. Berasal dari mata uang kripto, teknologi ini memungkinkan eksekusi transaksi secara otomatis menggunakan kode yang diubah menjadi bahasa hukum. Untuk lebih memahami penggunaan teknologi blockchain dalam perjanjian komersial Indonesia, penelitian ini akan melihat kontrak pintar sebagai instrumen hukum digital dan validitas teknologi blockchain dalam mendukungnya. Untuk menganalisis ketentuan hukum yang relevan, penelitian ini menggunakan metode yuridis normatif. Temuan-temuan ini menunjukkan masa depan teknologi yang menjanjikan dalam merampingkan dan mempermurah proses transaksi. Agar dapat berfungsi sebagaimana mestinya dan memberikan perlindungan hukum yang memadai, implementasinya memerlukan perubahan hukum dan penerimaan masyarakat.

Abstract

Abstract: The Class IV Port Authority and Harbor Office (KSOP) of Muara Angke plays a crucial role in overseeing maritime safety at Muara Angke Port, North Jakarta. With the increasing maritime activities, the challenges faced in enforcing safety regulations have become more complex. This study aims to analyze the obstacles encountered by KSOP in ensuring navigation safety and to recommend strategic measures to enhance oversight effectiveness. The findings of this research indicate that challenges include limited human resources, weak law enforcement, and a lack of public awareness regarding the importance of maritime safety. Strengthening regulations, promoting safety awareness, utilizing modern technology, and collaborating with related agencies are necessary steps to create a safer maritime environment and prevent maritime disasters. Through these measures, it is expected that KSOP Class IV Muara Angke can enhance its authority and foster a better safety culture among maritime stakeholders.Keywords : Maritime Safety, KSOP Class IV Muara Angke, Port Supervision.
