Abstract

The act of shackling is mostly carried out by their own family on the grounds that they are afraid of hurting local residents or their family. This article discusses the history of the development of the Mental Health Law and the Development of Shackling of People with Mental Disorders in Indonesia. This study uses a normative legal problem approach. The type of data used is secondary data obtained through literature studies. Data analysis was carried out using a qualitative descriptive method. The conclusion is that the Development of the Law on Mental Health continues to develop with the hope of continuing to protect and provide services to patients with mental disorders, as well as improving legal services for perpetrators of shackling in accordance with Article 86 of Law Number 18 of 2014 with the threat of criminal penalties for perpetrators of shackling People with Mental Disorders. Abstract

The purpose of this study is to analyze criminal acts related to the phenomenon of bullying among children in school environments, focusing on the delinquency of children aged 12-18 years in the form of physical violence such as bullying. This research particularly emphasizes the role of educators in handling bullying, which impacts the understanding of both the physical and psychological effects of bullying. This study uses a normative research method. Bullying that is considered a 'joke' can have a domino effect and have fatal consequences. Education by educators and parents, counseling or socialization, and the role of the community are very important to prevent and overcome bullying. The research findings reveal that bullying constitutes a criminal offense categorized within the realm of violence against children, with various underlying factors contributing to its occurrence. It is noteworthy that approximately 341 victims of physical bullying, involving severe assault resulting in serious injuries or fatalities, have been documented. Tujuan penelitian ini adalah untuk menganalisisTindak Pidana yang berkaitan dengan fenomena perudungan anak di lingkungan sekolah, dengan fokus pada kenakalan anak usia 12-18 tahun dalam bentuk kekerasan fisik seperti perundungan. khususnya peran tenaga pendidik dalam menangani tindakan perudungan yang berdampak pada pemahaman dampak dari perudungan fisik maupun psikologisPenelitian ini menggunakan metode penelitian normatif. Perundungan yang dianggap sebagai ‘gurauan’ dapat memberikan domino effect dan berakibat fatal. Edukasi oleh tenaga pendidik dan orang tua, adanya konseling ataupun sosialiasi, peran dari masyarakat sangat penting untuk mencegah dan menanggulangi perundungan.  Hasil penelitian menunjukkan  Kejahatan perundungan merupakan suatu tindak pidana yang tergolong ranah kekerasan terhadap anak dengan dilatarbelakangi berbagai macam faktor penyebab. Tercatat kurang lebih 341 korban perundungan anak golongan kekerasan fisik berupa penganiayaan menimbulkan luka berat hingga meninggal dunia.

Abstract

 The purpose of this study is to examine and analyze efforts to resolve alleged medical errors through mediation as a Restorative Justice approach and developments in several developed countries such as America, Japan, and Canada as a basis for comparison. This research needs to be discussed more deeply because the dispute should be mediated through a Restorative Justice approach as a reference for legal reform in Indonesia, this approach aims to "restorative" not only patients, but also health service providers, and the community. In accordance with health regulations in Indonesia, mediation is required in the event of an error or negligence by health workers before other legal channels are taken. The research method used is a normative juridical approach with legislation, concepts, and comparisons. The results of the discussion of this research provide an alternative settlement or fair medical law enforcement. In addition to contributing at the theoretical level as well as in developing the theory of settlement and law enforcement in the medical field, it is also hoped that this can be a prospect for law enforcement of medical disputes in Indonesia.Penelitian ini bertujuan untuk mengkaji dan menganalisis upaya penyelesaian dugaan kesalahan medis melalui mediasi melalui pendekatan Restorative Justice serta perkembangan di beberapa negara seperti Amerika, Jepang dan Kanada sebagai dasar perbandingan. Penelitian ini perlu dibahas lebih dalam karena seyogyanya sengketa tersebut dilakukan mediasi melalui pendekatan Restorative Justice sebagai acuan pembaharuan hukum di Indonesia, pendekatan tersebut bertujuan merestorasi tidak hanya bagi pasien, namun juga penyedia layanan kesehatan, dan masyarakat. Sesuai regulasi tentang kesehatan di Indonesia mewajibkan mediasi apabila terjadi kesalahan atau kelalaian oleh tenaga kesehatan sebelum ditempuh jalur hukum lainnya. Metode penelitian yang digunakan adalah yuridis normatif dengan pendekatan perundang-undangan, konsep, dan perbandingan. Hasil pembahasan penelitian ini memberikan alternatif penyelesaian atau penegakkan hukum medis yang berkeadilan. Kebaharuan penelitian ini dengan melihat penerapan di beberapa negara maju dalam penyelesaian sengketa medik sebagai acuan perkembangan hukum dan gambaran penyelesaian di negara lain.  Penelitian ini bertujuan untuk mengkaji dan menganalisis upaya penyelesaian dugaan kesalahan medis melalui mediasi melalui pendekatan Restorative Justice serta perkembangan di beberapa negara seperti Amerika, Jepang dan Kanada sebagai dasar perbandingan. Abstract

This article aims to examine the reduction of criminal penalties as a form of reward or incentive for justice collaborators. This is prompted by the pro and con debate over the verdict of the Panel of Judges in the case of Barada Richard Eliezer, who was sentenced to 1 year and 6 months for the planned murder of Brigadir Nofriansyah Yosua Hutabarat. The legal issue revolves around the absence of clear criteria for the extent of such leniency, as it remains within the prerogative of the judge. This research is conducted using normative legal research, involving an analysis of all relevant laws and regulations related to the legal issue under investigation. These include the Supreme Court Circular Letter Number 4 of 2011 on the treatment of crime reporters (whistleblowers) and justice collaborators in specific criminal cases, and the Republic of Indonesia Law Number 31 of 2014 concerning Amendments to Law Number 13 of 2006 on Witness and Victim Protection. The research results suggest the need for consistency in judicial decisions regarding the extent of sentence reduction for justice collaborators. The author recommends considering the Italian regulations in dealing with organized crime, where defendants who are willing to become justice collaborators, thereby assisting in uncovering criminal groups and providing necessary evidence, may receive reduced prison sentences. A life sentence can be replaced with a prison term of 12 to 20 years, and other sentences can be reduced by one-third to two-thirds. According to the author, this reduction can be determined based on the maximum criminal penalty they face, as stipulated in Article 199 of the Draft Criminal Procedure Code (RUU KUHAP).

Abstract

Since 2020, the criminal justice system in Indonesia has been awarded two sentencing guidelines which can be found in Supreme Court Regulation Number 1 of 2020 concerning Sentencing Guidelines Article 2 and Article 3 of the Corruption Eradication Law and Articles 53 to 56 of the National Criminal Code. However, based on the Academic Text of the National Criminal Code, it is stated that the term sentencing guidelines is a term that is still open to review, because it contains various meanings, so it is still open to developing the term. This article discusses the projection of the concept of sentencing guidelines in the criminal justice system in Indonesia by establishing an independent state institution that has the authority to create and evaluate a sentencing guideline such as the United States Sentencing Commission (USSC) which applies in the criminal justice system in the United States by using law comparative method. The research results show that the concept of sentencing guidelines in Indonesia and the United States both have a rationale for responding to the phenomenon of sentencing disparities and the two countries have their own methods. There are similarities and differences between the sentencing guidelines in Indonesia and the United States. In the equation there is one variable, namely, the variable of the judge's relationship with the sentencing guidelines. Then, in the differences section there are four variables, namely, orientation variables, institutions or stakeholders, form and scope. Then, regarding the need for the formation of an independent state institution that has the authority to create and evaluate a sentencing guideline, it becomes rational in the criminal justice system in Indonesia because predictability in imposing a range of sentences is a fulfillment of the value of law certainty, so that the more the sentence can be predicted, the greater the law certainty for convicts can be fulfilled. Apart from that, this independent state institution also has the authority to provide recommendations to legislators regarding the rationalization of the range of sentences imposed which so far has not been properly rationalized

Abstract

The rising trend of LGBT (Lesbian, Gay, Bisexual, and transgender) cases in the world, include Indonesia is triggering worries about increasing demand of sex reassignment surgery (transgender). On the other hand, the issue about sex reassignment surgery is a very controversial issue, especially Indonesia. By looking to the existing data and facts, Indonesia can not deny that there are LGBT people in Indonesia. Criminal law should be responsive to the facts in society, including the controversial issie like sex reassignment surgery. This article discusses about sex reasignment surgery viewed from Indonesian criminal law perspective by using doctrinal research method. This article was written by reviewing regulations, especially Law of the Republic of Indonesia Number 17 of 2023 concerning Health and Law of the Republic of Indonesia Number 1 of 2023 concerning the Criminal Code as the main reference. This study aims to look at criminal law regulations regarding sex reassignment surgery in Indonesia as well as to review the function of criminal law as a tool for balancing between public interests and individual interests. The findings of this study show that the criminal policy applied to regulate sex reassignment surgery is in the form of criminal sanction for every doctor who performs sex reassignment surgery without therapeutic purposes. This study also shows how important it is to ensure the conditions under which the sex reassignment surgery in Indonesia is performed in order to protect the doctors carrying out the work.
