Abstract

Pengadilan Tata Usaha Negara (PTUN) memiliki peran penting dalam sistem hukum administrasi di Indonesia, namun kewenangannya terbatas pada pengujian legalitas formal keputusan administratif. Hal ini menciptakan celah hukum karena PTUN tidak dapat menangani tindakan substantif pemerintah yang merugikan warga negara, yang dikenal sebagai onrechtmatige overheidsdaad. Penelitian ini bertujuan untuk menganalisis kewenangan Pengadilan Tata Usaha Negara dan mengidentifikasi kebutuhan reformasi yuridis untuk memperluas yurisdiksinya dalam menangani tindakan administratif yang melawan hukum. Penelitian ini menggunakan metode penelitian hukum normatif dengan pendekatan perundang-undangan. Hasil penelitian menunjukkan bahwa kewenangan Pengadilan Tata Usaha Negara masih terbatas pada pengujian aspek prosedural, sementara tindakan substantif yang merugikan warga negara tidak dapat diadili secara efektif. Peraturan Mahkamah Agung Nomor 2 Tahun 2019 memberikan perluasan kewenangan, namun implementasinya belum optimal. Implikasi dari penelitian ini adalah peningkatan perlindungan hukum bagi warga negara dan peningkatan akuntabilitas pemerintah dalam menjalankan kebijakan publik. Abstract

 This research examines the legal certainty surrounding the time limits for resolving disputes over the results of Village Head elections through the State Administrative Court. The absence of clear regulations on the deadlines and mechanisms for addressing these disputes has led to various issues, including legal uncertainty, inequality in treatment, and perceptions of injustice among stakeholders. To address these concerns, this study adopts a normative juridical approach, relying on an extensive literature review of legal principles, norms, doctrines, and regulations. The findings reveal that disputes regarding Village Head election results must be submitted within three days of receiving notification or a formal decision from the Regent or Mayor. The State Administrative Court (PTUN) is then required to issue a ruling within 14 working days from the date the case is officially recorded in the case register. Moreover, the court’s decisions are final and binding, meaning no further legal actions or appeals are permitted. This process ensures that disputes arising from Village Head elections are resolved definitively and conclusively, providing a legally certain outcome while upholding the principles of justice and fairness in election-related matters.

Abstract

 The implementation of the Omnibus Law in Indonesia, particularly the Job Creation Omnibus Law, has raised several challenges related to the principles of the hierarchy of legislation and legal certainty. The Omnibus Law, which combines various regulations from different levels of law without regard to hierarchical order, has the potential to create legal uncertainty, undermine the legal order, and reduce protections for workers' rights and the environment. This study aims to examine the compatibility of the Omnibus Law method with the principles of Indonesia's hierarchy of legislation and identify its impact on legal certainty. This research employs a normative legal method with approaches that include legislation, conceptual analysis, and comparison, as well as analyzing data from various primary and secondary legal sources. The research findings indicate that the Omnibus Law does not fully align with the principles of the hierarchy of legislation outlined by Hans Kelsen and Hans Nawiasky, and it creates regulatory overlaps that disrupt the legal system's stability. The implications of this research emphasize the importance of adjusting the Omnibus Law concept to better align with Indonesia's legal framework, as well as the need for more detailed implementing regulations to minimize legal uncertainty across various sectors.

Abstract

Transformation service digital public in West Java is growing rapidly and increasing efficiency service , but also gives rise to complexity risk related personal data protection community . Publishing Constitution Personal Data Protection (PDP Law) becomes runway law important For strengthen right privacy citizens and​ organizing data governance in the sector public . Research This aim analyze implementation of the PDP Law in service West Java digital public with review three dimensions Main : regulatory , institutional , and technical-operational . Research methods use approach descriptive qualitative through studies documents , review regulations , and interviews with the apparatus involved in data management . Research results show that implementation the beginning of the PDP Law provides a number of impact positive , such as increasing awareness institutional to importance personal data protection , improvements procedure data management through implementation principle data minimization , as well as update policy privacy on a number of digital platforms. However , the findings also identified various challenges , among others, have not yet composition regulations derivatives at the level area , the minimum officials Data Protection Officer (DPO), inequality standard security application , limitations literacy apparatus , as well as weakness mechanism monitoring and reporting incident data leak . Novelty research This lies in the approach integrative that combines analysis regulatory , institutional , and technical-operational in a way simultaneously , so that produce greater understanding​ comprehensive about dynamics implementation of the PDP Law at the level area . This study give contribution important for development of a more public data governance model accountable , adaptive , and sustainable in support digital transformation of government .
