Abstract

The policy regulation is one of the government instruments or tools and means used by the government, including state administration officials in criminal justice in carrying out government tasks and other judicial actions. The existence of this policy regulation is a consequence of the welfare law state which imposes a very broad task, namely for the attainment of the people's welfare in accordance with the objectives of the welfare state itself. However, in the development of policy regulations that were originally intended and needed in carrying out governmental duties, in fact their implementation cannot be separated from the problems of conflicts with other legal norms and other legal problems. This paper wants to answer an important question, namely; "What is the basis for government action to issue policy regulations and why policy regulations, theoretically and in practice, cannot be categorized as statutory regulations?". The conclusion that can be drawn from this paper is related to the large "space for movement" held by the government and the positions in the judicial field to make policy regulations. For this reason, it is necessary to recommend Supreme Court to issue a Supreme Court Regulation which regulates technical proceedings related to the review of policy regulations. Delegating the authority to review policy regulations to become the authority of the State Administrative High Court (PT TUN) is a strategic step that can be developed by the Supreme Court of the Republic of Indonesia. Abstract

Indonesia as a state of law, has written and unwritten rules as an abstract form of legal protection for the community, while concrete legal protection, one of which, is protected from the target of crime and from the potential of becoming a criminal. One important and fundamental aspect of this problem lies in the process of transforming the noble values ​​of law through a legal education. Here the model used in legal education largely determines the realization of legal awareness. This article tries to give a little description of the relationship between them qualitatively, especially on the basis of the fact that legal education is the most rational method for shaping students legal awareness. The relationship between the variables of legal education and the variable of legal awareness of students is very significant. The object of legal education must reach school students. Legal education is not the only indicator of student legal awareness, but it is qualitatively clear that with the earlier, frequent and increasingly broad range of legal education activities carried out by professional communicators, accompanied by increasingly sophisticated, simple, smart, standard communication techniques: safe, real, quick, practical, effective, imaginative fun, award, problem solving oriented, with gender perspective, prioritize the best interests of students, and provide space to appreciate students rights.It is believed that legal education will have a greater impact on the formation of student legal awareness. Abstract

ABSTRACTThe practice of illegal logging is not a standing apart form of crime. There are many factors and aspects bounding it. In the context of this decision, the examination of the case and the final decision should not just rely on the provision of the forestry law, but also employ the marine criminal law since the crime utilizes cruise ship or the like. But it was not evident in the decision of District Court of Labuha. Even its criminal aspects of the marine criminal law tend to be forgotten by the panel of judges who investigate and adjudicate a quo case.Keywords: illegal logging, corporate crime, the marine criminal law. ABSTRAKPraktek illegal logging bukan menjadi bagian dari bentuk kejahatan semata karena terdapat berbagai macam faktor yang melingkupinya. Dalam kerangka putusan pengadilan dalam kajian ini diperoleh bahwa putusan hanya berdasarkan atas hukum kehutanan, padahal seharusnya hakim juga bisa mengunakan hukum kejahatan kelautan karena adanya kapal yang digunakan untuk melakukan kejahatan. Akan tetapi hal tersebut belum terlihat dalam putusan Pengadilan Negeri Labuha sehingga aspek kejahatan sebagaimana yang tertuang dalam hukum kejahatan kelautan dilupakan oleh panel hakim untuk melakukan investigasi lebih mendalam dalam dapat diajudikasikan dalam proses peradilan atas kasus tersebut.Kata kunci: pembabatan hutan, kejahatan korporasi, hukum kejahatan kelautan

Abstract

The marriage agreement is regulated in Article 29 of Law Number 1 of 1974 concerning Marriage which essentially states that a marriage agreement must be made with a notarial deed, or with a written agreement ratified by the Marriage Registrar, before the marriage takes place or at the time the marriage takes place and The Marriage Agreement shall come into force since the marriage was held, and cannot be changed, unless from both parties there is an agreement to change and the change does not harm a third party. Based on the Decision of the Constitutional Court Number 69/PUU-XIII/2015, the Court is of the opinion that the implementation of the marriage agreement is not limited to being carried out only at or before the marriage is held, but also during the marriage contract, the marriage agreement can be executed by husband and wife upon mutual agreement.

Abstract

The promulgation of laws has been stipulated in Law Number 12 of 2011 concerning Guidelines for the Promulgation of Laws, which has been changed post enactment of Law Number 13 of 2022 on Second Amendment of  Law Number 12 of 2011, one of which is the application of the Regulatory Impact Analysis (RIA) and the Rule, Opportunity, Capacity, Communication, Interest, Process Method, and Ideology (ROCCIPI) as the basis for the Establishment of Legal Products in e Academic Manuscript of the Bill of Law/Regional Regulation.  Integrating the methods into Academic Manuscripts is incorrect considering that it serves as the justification (philosophical, sociological, and juridical) which is academic or scientific in nature upon the conclusion of Laws and Regional Regulations. (RIA) is an analysis method of policies that acts as a companion to academic manuscripts called the RIA Statement. This is interesting to study of how is the development of the RIA and ROCCIPI in promulgating laws? How do the techniques for preparing academic manuscripts pre and post the enactment of Law Number 13 of 2022 concerning the Second Amendment to Law Number 12 of 2011 compare? Media pembelajaran Biologi tentang cara hidup hewan dan tumbuhan di sekolah dasar saat ini masih banyakmengunakan metode pembelajaran secara konvensional karena terbatasnya alat peraga yang dibutuhkan, haltersebut membuat banyak siswa kurang maksimal dalam menyerap materi yang diberikan, atas dasar itulahyang mendasari pembuatan Game Edukasi ini, sebagai media pembelajaran dengan tujuan memudahkan gurudalam menyampaikan materi dan meningkatkan penyerapan materi oleh siswa sekolah dasar.Metodologi penelitian yang digunakan dalam penelitian ini adalah dengan mengumpulkan data dari obyek danmengunakan landasan literatur dengan mempelajari teori-teori dari buku, internet maupun tulisan-tulisan yangdapat membantu masalah dengan menguji kebenaran dari penelitian.Dari hasil penelitian ini adalah sebuah metode pembelajaran berupa Game Edukasi yang dibuat mengunakanMacromedia Flash 8 , Game Edukasi ini dapat digunakan sebagai pendukung metode pembelajaran yang sudahada khususnya pada mata pelajaran Biologi tentang cara hidup hewan dan tumbuhan.Kata Kunci : Metode Pembelajaran, Game Edukasi, animasi Flash, Macromedia Flash.

Abstract

The transparency and integrity of electoral processes are of paramount importance for the health of a democracy. They prevent corruption and ensure fairness. Many ASEAN countries have implemented strict campaign finance regulations with the aim of enhancing transparency and reducing financial influence in politics. However, the effectiveness of these policies depends on the existence of appropriate oversight mechanisms and the specific characteristics of the local political context. This research examines the impact of campaign finance restrictions on electoral transparency in ASEAN, identifies challenges, and highlights effective practices. It also offers recommendations for policy improvements. This research employs a comparative methodology and thematic analysis to examine the similarities and differences in campaign finance restrictions across the Association of Southeast Asian Nations (ASEAN). It utilises data from documents to identify policy patterns and impacts. This research examines the impact of campaign finance restrictions in ASEAN, offering new insights and data on the influence of such regulations on electoral outcomes. It also provides recommendations for enhancing transparency and integrity in elections. This article examines the efficacy of campaign finance restrictions in enhancing electoral transparency and integrity in Indonesia. The findings indicate that, despite the restrictions' objective of curbing undue influence in the electoral process, their implementation continues to encounter substantial obstacles, including inadequate oversight and a dearth of information disclosure. The research underscores the necessity for regulatory reform and the fortification of oversight mechanisms as pivotal strategies to attain elections that are more equitable and transparent.

Abstract

Mekanisme upaya administratif dalam penyelesaian sengketa pemilihan kepala daerah (Pilkada) di Indonesia telah diatur secara regulatif, namun implementasinya masih menghadapi berbagai hambatan teknis dan kelembagaan yang mempengaruhi efektivitasnya. Penelitian ini bertujuan untuk menganalisis optimalisasi mekanisme administratif dalam penyelesaian sengketa Pilkada, terutama terkait dengan efektivitas, efisiensi, dan kepastian hukum. Metode penelitian yang digunakan adalah pendekatan hukum normatif dengan analisis perundang-undangan dan literatur terkait hukum administrasi serta keadilan elektoral. Hasil penelitian menunjukkan bahwa mekanisme administratif lebih cepat dibandingkan jalur peradilan, terutama dalam menangani pelanggaran teknis dan prosedural. Namun, mekanisme ini kurang memberikan kepastian hukum akibat ketidakjelasan prosedur dan tumpang tindih kewenangan antar lembaga. Implikasi penelitian ini menunjukkan perlunya reformasi regulasi untuk memperjelas prosedur administratif, peningkatan kapasitas lembaga penyelenggara pemilu, serta penguatan transparansi dan akuntabilitas dalam proses penyelesaian sengketa. Penggunaan teknologi informasi juga direkomendasikan untuk mempercepat proses administratif dan meningkatkan kepercayaan publik terhadap hasil Pilkada. Abstract

 This research examines the legal certainty surrounding the time limits for resolving disputes over the results of Village Head elections through the State Administrative Court. The absence of clear regulations on the deadlines and mechanisms for addressing these disputes has led to various issues, including legal uncertainty, inequality in treatment, and perceptions of injustice among stakeholders. To address these concerns, this study adopts a normative juridical approach, relying on an extensive literature review of legal principles, norms, doctrines, and regulations. The findings reveal that disputes regarding Village Head election results must be submitted within three days of receiving notification or a formal decision from the Regent or Mayor. The State Administrative Court (PTUN) is then required to issue a ruling within 14 working days from the date the case is officially recorded in the case register. Moreover, the court’s decisions are final and binding, meaning no further legal actions or appeals are permitted. This process ensures that disputes arising from Village Head elections are resolved definitively and conclusively, providing a legally certain outcome while upholding the principles of justice and fairness in election-related matters.

Namun, mekanisme ini kurang memberikan kepastian hukum akibat ketidakjelasan prosedur dan tumpang tindih kewenangan antar lembaga. Implikasi penelitian ini menunjukkan perlunya reformasi regulasi untuk memperjelas prosedur administratif, peningkatan kapasitas lembaga penyelenggara pemilu, serta penguatan transparansi dan akuntabilitas dalam proses penyelesaian sengketa. Penggunaan teknologi informasi juga direkomendasikan untuk mempercepat proses administratif dan meningkatkan kepercayaan publik terhadap hasil Pilkada.
