Abstract

This study aims to examine the transformation of defense law in the digital age and advanced technology, focusing on the impact of technological advancements on national defense policies and regulations. With the rapid development of technology, particularly cyber threats that cross territorial boundaries, national defense legal systems face new challenges that require updates to regulations and policies. Through a literature review, this research identifies that traditional defense law needs to be revised to include protection of critical infrastructure, regulation of technology-based defense, and management of digital threats. Advanced technologies such as artificial intelligence, big data, and the Internet of Things provide opportunities to strengthen defense systems, but they also pose ethical and legal challenges, particularly regarding privacy, human rights, and accountability in the use of technology in military operations. The study also emphasizes the importance of international collaboration in addressing global transnational cyber threats. As a recommendation, countries need to urgently update their defense law regulations and strengthen international cooperation to maintain global security, while ensuring the use of defense technology aligns with international law principles and human rights.

Abstract

State Houses or Official Residences are also classified as State Property, all of which are legally obtained from the State Budget. Members of the Indonesian National Armed Forces (TNI) who are granted Official Residences must maintain and preserve the buildings so that the utilization of State Property can carry out all TNI duties and functions without changing the ownership status. This is in accordance with TNI Commander Regulation No. 49 of 2015 concerning the Utilization of State Property in the form of land and buildings within the TNI. The type of research used in this thesis is normative juridical research. Normative juridical research examines the law from an internal perspective, with the object of research being legal norms. The approaches used are the legislative approach, the conceptual approach, the case approach, and the comparative approach with several countries. The results of this study show that the Occupancy Permit (SIP) is essentially a temporary administrative permit, so it cannot be equated with land rights such as a right-of-use certificate. Therefore, legally, a right-of-use certificate has greater legal force than an SIP. However, in practice, there is often a conflict between legal certainty (certificates) and the sense of justice of the community (long-term residents with SIPs). This happened because the residents had occupied the official residences for a long time and felt they had moral and historical rights to the dwellings. The court's decision affirming the validity of the right-of-use certificates reflects a positive legal orientation that emphasizes legal formalities over sociological aspects.

Abstract

Permasalahan penyelesaian Perbatasan Darat Indonesia-Malaysia, Indonesia-Papua Nugini dan Indonesia-Timor Leste hampir tidak jauh berbeda. Permasalahan tersebut antara lain kondisi medan dilapangan, akses jalan, bahasa masyarakat setempat, transportasi, cuaca yang sering berubah-ubah serta Sarana dan prasarana. Permasalahan pertama antara lain 1) Bagaimana kebijakan pemerintah dalam pengamanan wilayah perbatasan di darat ?. Jenis penelitian yang akan digunakan dalam tesis ini yaitu yuridis normatif yang mengacu kepada norma-norma hukum yang ada dalam Perundang-Undangan. Pendekatan yang digunakan yaitu Pendekatan Undang-Undang dan Pendekatan Konseptual serta data yang diperoleh yaitu data sekunder yang terdiri dari bahan hukum primer, bahan hukum sekunder dan bahan hukum tersier. Untuk menganalisis data menggunakan analisis kualitatif. Hasil penelitian ini menunjukan bahwa permasalahan perbatasan antara Indonesia – Malaysia yang masih terdapat perdagangan illegal skala kecil dan besar, Indonesia-Papua Nugini terdapat akses yang sulit ditempuh serta gangguan dari Organisasi Papua Merdeka dan permasalahan perbatasan Indonesia-Timor Leste masih terdapat budaya (Culture) setempat yang menetapkan patok perbatasan menurut nenek moyang mereka. Untuk mengatasi masalah-masalah tersebut Pemerintah RI menggunakan kebijakan berupa regulasi / Peraturan Perundang-Undangan serta mengundang tokoh adat di masing-masing perbatasan untuk sama-sama menyelesaikan permasalahan tersebut.
