Abstract

Wakalah is a concept in Islamic law that allows a person to appoint a representative or agent to carry out tasks or transactions on their behalf. A wakalah agreement is an agreement where the first party gives power or mandatory to the second party. It is impossible for each individual to handle all matters only by themselves. Therefore, Allah SWT has established rules about how the wakalah contract can be carried out, providing benefits for us. Wakalah comes from words “wakalah-yakilu-waklan”, which means submission or giving authority to a representative. Wakalah can be interpreted as handing over tasks that a person can carry out independetly to another person, so that the person carries out these tasks throughout his life. This paper aims to provide an in-depth analysis of wakalah from the perspective of Islamic law, as well as identifying the key aspects involved.

Abstract

Abstract Domestic violence is an act committed against a person, especially a woman, that causes physical, sexual, psychological suffering and misery, or domestic neglect. These actions include threats, coercion, or restrictions on freedom that are not in accordance with the law, which occur in the context of family life. According to Law No. 23/2004 defines domestic violence as any action that causes suffering or misery in the form of physical, sexual, psychological, or neglect of a person, especially women, within the scope of the household. Domestic violence can occur due to the low ability of family members to adapt to each other, so that family members who have power and strength tend to use domination and exploitation against weaker family members. Key words: domestic violence, criminal offenses, serious abuse Abstrak KDRT atau Kekerasan Dalam Rumah Tangga, merujuk pada perilaku yang menyebabkan penderitaan dan kesengsaraan pada seseorang, khususnya perempuan, baik secara fisik, seksual, psikologis, atau melalui penelantaran, dalam konteks kehidupan keluarga. Ini mencakup ancaman, penindasan, atau pembatasan kebebasan yang bertentangan dengan hukum. Menurut UU No. 23 Tahun 2004, KDRT didefinisikan sebagai segala tindakan yang menyebabkan penderitaan atau kesengsaraan, baik secara fisik, seksual, psikologis, atau melalui penelantaran, terhadap seseorang, terutama perempuan, di lingkungan rumah tangga. Faktor penyebab KDRT dapat berasal dari kurangnya kemampuan anggota keluarga untuk beradaptasi satu sama lain, yang menyebabkan anggota keluarga yang lebih kuat cenderung menggunakan dominasi dan eksploitasi terhadap yang lebih lemah.
