Abstract

Drug abuse is a complex problem that requires a comprehensive solution. This includes how the concept is used in various aspects of tackling drug abuse. Justice in drug abuse eradication is a complex enigma, especially when the approach taken tends to be repressive and pays less attention to humanitarian aspects. Restorative justice is an alternative paradigm for handling drug abuse in Indonesia by linking it to the values of Pancasila. Restorative justice emphasizes recovery, reconciliation, and reintegration of offenders, victims, and society. This approach is in line with Pancasila values such as humanity, unity, and social justice. Restorative justice does not only enforce the law, but also pays attention to the social and psychological aspects involved in drug abuse cases. Applying restorative justice to the rehabilitation of drug addicts helps them overcome their addiction and become productive members of society again. Implementing restorative justice requires the cooperation of various stakeholders, including government, law enforcement, and local communities. This research aims to explore and understand the complexity of humanistic justice in the context of drug abuse treatment, as well as examine the definition and concept of humanistic justice in the context of drug abuse. This research uses an empirical juridical method, with interviews conducted at the Kediri City Attorney's Office and observation visits to post-rehabilitation drug abusers. Results of this study show that to overcome this, a comprehensive approach is needed that affects many aspects of life. The noble values of Pancasila provide a solid foundation in developing effective coping strategies.

Abstract

Abstrak: Rehabilitasi di Indonesia merupakan langkah penting dalam perawatan dan pemulihan pecandu narkotika dan korban penyalahgunaan narkotika, memperbaiki kondisi fisik, mental, dan sosialnya agar dapat berfungsi secara optimal dalam masyarakat. Berdasarkan Undang-Undang Narkotika Nomor 35 Tahun 2009, rehabilitasi dibagi menjadi dua jenis, yaitu rehabilitasi medis yang difokuskan pada perawatan untuk mengatasi ketergantungan narkotika, dan rehabilitasi sosial yang bertujuan untuk mengembalikan fungsi sosial pecandu. Tata cara pelaksanaan rehabilitasi diatur dalam peraturan perundang-undangan terkait seperti misalnya Surat Edaran Mahkamah Agung (SEMA) Nomor 04 Tahun 2010 yang memberikan pedoman mengenai indikasi dan kategori orang yang layak untuk mendapatkan rehabilitasi. Kewajiban untuk melakukan rehabilitasi sebagaimana diatur dalam Pasal 54 Undang-Undang Nomor 35 Tahun 2009 mencerminkan perlindungan hukum bagi pecandu dengan harapan dapat mengurangi dampak negatif narkotika dan mendukung proses pemulihan. Pengajuan permohonan rehabilitasi dapat dilakukan melalui penyidik, penuntut umum, atau hakim dan memerlukan penilaian oleh tim penilai terpadu serta putusan pengadilan mengenai tempat rehabilitasi yang tepat. Meskipun ada peraturan dan pedoman, tantangan dalam pelaksanaan rehabilitasi masih ada, termasuk kurangnya integrasi antara lembaga penegak hukum dan terbatasnya pilihan rehabilitasi. Upaya yang efektif diharapkan dapat meningkatkan kualitas rehabilitasi dan mendukung integrasi sosial pecandu narkoba. Reformasi hukum ini akan meningkatkan respons terhadap pecandu narkoba, termasuk mengakui pecandu narkoba sebagai korban yang membutuhkan rehabilitasi dan bukan hanya pelaku kejahatan, serta memberikan solusi yang lebih manusiawi dan efektif untuk penyalahgunaan narkoba.

Abstract

Arbitration is an independent, final and binding mechanism for resolving international commercial disputes within the framework of the WTO. There are two major international agreements on arbitration, namely the New York Convention and the ICSD Convention/Washington, which contains provisions in the form of "the law of arbitration”. Arbitration concerns several things, including party autonomy, competence, legal obligations, good ethics, efficiency, audit and modification, privacy and confidentiality, separation, limitation of judicial involvement, venue, and fair and impartial treatment. The advantages of arbitration include fast resolution, confidentiality, and freedom to choose arbitrators. However, there are also disadvantages that must be considered. For example, if the parties do not fulfill the requirements of the good faith rule, then the arbitral award will lose full legal force and effect. Therefore, the selection of arbitration as a method of dispute resolution must be done carefully by considering all relevant aspects and principles.

Abstract

Crimes of human trafficking still often occur to this day, even people who are supposed to be protectors of their wives are willing to sell their wives to other people with the aim of meeting their household needs. This makes it difficult for the government to provide protection to wives who are victims of human trafficking carried out by their husbands, because there could be wives who are unwilling to report their beloved husbands to law enforcement officials for what their husbands have done. In this research, normative legal research is used with a statutory approach, case approach, and conceptual approach. There are various efforts that can be made to provide legal protection to victims of human trafficking carried out by their beloved husband, including preventive and repressive efforts.
