Abstract

Technological advances have had a changing impact on social life, especially the use of the internet which makes everything limitless so that anyone can access things easily, including children. Several things that are on the internet are then accessed by children without parental supervision, which is one of the factors that makes a child a perpetrator of a crime. Various criminal acts are committed by children, including children as perpetrators of premeditated murder. In cases of premeditated murder committed by children, there are several provisions that differentiate those committed by adults, all of this is related to the judge's decision in the end. Law Number 23 of 2002 concerning Children becomes the legal basis in addition to the Criminal Code and Criminal Procedure Code when a child is the perpetrator of a criminal act of premeditated murder. This research focuses on discussing policies regarding the crime of children as perpetrators of premeditated murder. The research method used is normative legal research and uses a statutory approach (statue approach) and conceptual approach (conceptual approach).

Abstract

Background: Contemporary criminal justice systems are increasingly challenged to balance punitive measures with rehabilitative goals, particularly in culturally diverse and legally pluralistic societies. While secular models, such as those found in Norway, emphasize rights-based rehabilitation, Islamic-majority countries like Malaysia and Indonesia navigate complex intersections between religious ethics and secular legal frameworks. Purpose: This study aims to investigate how secular and Islamic approaches to rehabilitative justice are operationalized across three jurisdictions—Norway, Malaysia, and Indonesia—and to identify pathways for integrating ethical, institutional, and empirical insights into a cohesive, context-sensitive reform model Methods: Employing a qualitative-comparative design, the research combines normative legal analysis, socio-legal investigation, and thematic content analysis. Primary sources include national legal documents, prison policies, international reports, and expert interviews Results: Findings reveal that Norway’s secular rehabilitative system achieves strong empirical outcomes through individualized, rights-based practices; Malaysia partially integrates Islamic ethical principles into correctional programs with measurable, though uneven, success; while Indonesia’s fragmented legal system relies largely on grassroots religious initiatives without formal institutional integration, resulting in persistently high recidivism Implication: The study contributes both theoretically and practically by demonstrating that ethical pluralism—rather than creating fragmentation—can enrich rehabilitative justice if systematically integrated. For policymakers, the findings suggest the need to embed both secular human rights and religious ethical commitments into penal reform strategies, particularly in Muslim-majority and legally hybrid societies. Originality: This article advances the literature by offering one of the few cross-jurisdictional, empirically grounded comparative studies that bridge secular and Islamic rehabilitative frameworks, challenging binary understandings and proposing an integrative, ethically robust model for justice reform

Abstract

Penelitian ini mengkaji peran linguis forensik dalam penyidikan tindak pidana pencemaran nama baik, khususnya dalam konteks interpretasi linguistik terhadap ujaran yang diduga mencemarkan nama seseorang. Pencemaran nama baik merupakan tindak pidana yang substansinya berbasis pada bahasa, baik dalam bentuk tulisan, lisan, maupun komunikasi digital. Dalam konteks hukum, pembuktian niat jahat (mens rea), identifikasi pelaku, serta makna ujaran menjadi aspek kunci yang sering kali membutuhkan keahlian linguistik. Penelitian ini menggunakan pendekatan hukum normatif dengan jenis doctrinal legal research, serta mengintegrasikan pendekatan konseptual, kasus, dan perundang-undangan. Hasil penelitian menunjukkan bahwa linguis forensik memiliki peran strategis dalam mengidentifikasi penulis anonim melalui analisis sidik jari linguistik, membuktikan intensi pelaku dengan menganalisis struktur dan makna ujaran, serta memberikan keterangan ahli di persidangan sebagai alat bukti yang sah sebagaimana diatur dalam Pasal 184 ayat (1) KUHAP. Linguis forensik juga berperan dalam menafsirkan ujaran bermakna ganda seperti sarkasme, eufemisme, dan ironi yang sering digunakan untuk menyamarkan fitnah sebagai kritik. Penelitian ini merekomendasikan penyusunan pedoman operasional analisis linguistik forensik serta integrasi peran ahli bahasa dalam revisi KUHAP agar proses penyidikan dapat lebih akurat, objektif, dan adil.

Abstract

Background: The criminal responsibility of minors remains a pressing issue in contemporary legal studies because it lies at the intersection of justice, child protection, and societal security. Purpose: The aim of this paper is to critically analyze the legal and conceptual foundations of juvenile criminal responsibility, with particular attention to international human rights standards and comparative practices across jurisdictions. Methods: the study adopts a doctrinal and critical comparative approach, examining statutory frameworks, judicial interpretations, and scholarly debates while integrating insights from developmental psychology. Findings: The results reveal substantial inconsistencies in the age of criminal responsibility, limited compliance with the UN Convention on the Rights of the Child, and inadequate consideration of psychological maturity in determining culpability. Theoretical and Practical Implications: the study contributes to debates on the relationship between law, developmental science, and human rights in shaping juvenile justice frameworks. Practically, the findings underscore the need for policies that integrate restorative justice principles, prioritize rehabilitation over punitive measures, and harmonize domestic laws with international standards. Originality/Novelty: The originality of this research lies in its interdisciplinary critique that combines legal analysis, psychological insights, and human rights frameworks to propose an evidence-based recalibration of juvenile criminal responsibility .

Abstract

Analyzing the position or legal status of illegitimate children from a Civil Law perspective and analyzing whether or not illegitimate children have the right to inherit from their biological father. Theoretically, the results of this research can be useful and contribute ideas to society in understanding what is meant by the relationship with the legal position of illegitimate children in the concept of civil law. Practically, it can provide input for legal practitioners so that it can be used as a basis for thinking in terms of the legal position of illegitimate children in the concept of civil law. The first research result obtained is to know the position of illegitimate children in a civil law perspective which is divided into 2 (two), namely children who are born out of wedlock, but can be recognized in an authentic way and children who are born out of wedlock but cannot be recognized. The second research result is that illegitimate children who have received recognition from their biological father have the right to inherit from their biological father based on Constitutional Court Decision Number 46/PUU-VIII/2010 which decides that Article 43 Paragraph (1) of the Marriage Law which must then be read with "children born out of wedlock only have a civil relationship with their mother and their mother's family and with a man as their father who can be proven based on science and technology and/or other evidence according to law to have a blood relationship, including a civil relationship with their father's family ”. However, the distribution measurement still refers to the Civil Code.
