Abstract

This research aims to determine the status of impurity of pigs and wild animals and the mechanism of their purification from the perspective of the Malikī school and the Shafi'ī school of thought. This research is a type of library research, namely research carried out by collecting data from books or literature from previous research. This research was carried out by collecting data from searches or other writings, both from primary data sources and secondary data sources, as well as other literature related to the impurity of pigs and wild animals and their purification mechanisms. The results of the research found are as follows: first, the Malikī school and the Shafi'ī school of thought differ regarding the impurity of pigs and wild animals. The Malikī School says that pigs and wild animals are pure animals when they are alive, but when they are dead they are still considered unclean, the Shafi'ī School says that pigs and wild animals are unclean animals whether they are alive or dead. Second, the Malikī school and the Shafi'ī school of thought differ regarding the mechanism for purifying pigs and wild animals. The Malikī School says that the mechanism for cleansing pigs and wild animals is to use water without requiring the number of splashes and the use of soil or dust, the Syafi'ī School says that the mechanism for cleansing pigs and wild animals is that they must be washed seven times, one of which is using soil or dust. It is hoped that the implications of this research will be useful information for the general public, especially in understanding the impurity status of pigs and wild animals and their purification mechanisms from the perspective of the Malikī and Shafi'ī schools of thought. This information is important to increase public understanding of fiqh rules related to cleanliness and purity in Islam.

Abstract

The results of this study found that the right of syuf'ah in general is the right of partners/partners (syafī') to forcibly take over what has been sold by their union partners in the form of immovable property or assets to third parties or new buyers by paying compensation. or costs in accordance with those incurred by the third party or the new buyer. Meanwhile, according to the Sharia Economic Law Compilation in general, syuf'ah rights are the rights of a legal object over another legal subject to take precedence in the transfer or transfer of ownership of an immovable object as a substitute for sulh. So far the guidelines mentioned in the KHES regarding syuf'ah rights are still limited to mentioning definitions, wisdom and a small part of the provisions of syuf'ah rights that exist in muamalah fiqh. There are still many other provisions of syuf'ah rights in muamalahfiqh that have not been absorbed (adopted) in KHES such as the provisions regarding Masyfū 'alaih which is one of the main topics of syuf'ah rights.

Abstract

This research seeks to ascertain the perspectives of the Maliki school and the Syafii school of thought on the validity of the badal hajj for individuals who have never performed the hajj. This research employs a qualitative methodology, utilizing comparative, normative, and conceptual approaches. The research findings revealed the following: firstly, the Maliki school of thought permits the implementation of the badal hajj for mubaddils who have never performed the hajj, and maintains that the hajj remains valid for the individual being replaced, despite some of their followers judging him as makruh. While Shafii school of thought, on the other hand, forbids the execution of the badal hajj on individuals who have never performed the hajj and declares the hajj invalid for the individual replacing them, as this action automatically transforms the hajj into a hajj Second, the similarities between the views of the Maliki school and the Shafii school of thought lie in their use of hadiths from 'Ibn 'Abbas, attributed to the Prophet PBUH. As for the differences, the Maliki school of thought uses general postulates, while the Shafii school of thought uses specific postulates regarding the badal hajj. After reading and studying, researchers are more likely to adopt the Shafii school's perspective due to their use of unique propositions for this particular problem. In the hadith, Rasulullah observed that he commanded a mubaddil to perform his own hajj before substituting it for someone else's. According to the ulama, the opinion of the Shafii school of thought is clear.
