Abstract

Penelitian ini bertujuan untuk membahas penjelasan fanatisme suporter sepak bola dalam perspektif hadis. Metode penelitian ini menggunakan pendekatan kualitatif dengan menerapkan metode deskriptif-analitis dengan kajian kepustakaan dan teknik analisis data ditempuh melalui tahapan klasifikasi, dan interpretasi. Hasil penelitian menunjukkan bahwa Indonesia merupakan salah satu negara dengan basis suporter sepak bola terfanatik dan terloyal di dunia. Hal tersebut di landasi karena banyaknya klub sepak bola di Indonesia. Besarnya basis suporter yang dimiliki Indonesia menimbulkan hal dilematis, karena selain mendatangkan dampak postif juga menimbulkan dampak negatif. Penelitian ini menyimpulkan bahwa fanatisme itu adalah suatu sikap yang dapat merugikan, maka dalam Islam melarang umatnya untuk senantiasa tidak menyukai hal yang belebih-lebihan. Penelitian ini diharapkan memiliki manfaat bagi pengembangan ilmu pengetahuan umum dalam bidang olahraga serta ilmu sosial dan khazanah pengetahuan Islam khususnya dalam bidang kajian hadis.

Abstract

This study examines the phenomenon of child labor in South Kalimantan, focusing on the underlying economic and social factors that drive children into the workforce. The research employs a qualitative approach, utilizing interviews and field observations in Banjarmasin and Martapura. Findings indicate that child labor is primarily driven by economic hardship, with children engaging in various jobs such as street vending, entertainment, and market labor to support their families. Despite legal protections, many children face difficulties in accessing education due to their work commitments. The study highlights the urgent need for government intervention, emphasizing policies that balance economic support for families while ensuring children's right to education. The implications of this research suggest a more comprehensive social protection strategy and increased public awareness to address child labor effectively.

Abstract

The advancement of digital technology has generated new forms of wealth known as digital assets, which possess economic value and can be inherited such as cryptocurrency wallets, monetized accounts, and cloud-based data. However, the legal system in Indonesia, both in Islamic law and in national positive law, has yet to explicitly regulate the inheritance mechanisms of these digital forms of property. This paper addresses the central issue of how digital assets are positioned within inheritance law from the perspectives of Islamic jurisprudence and Indonesian positive law, and how the absence of legal regulation affects legal certainty and the protection of heirs. This research employs a qualitative methodology with a normative and conceptual approach, incorporating the study of classical Islamic legal texts, national legislation, and global digital platform policies. The findings indicate that digital assets can be classified as māl mutaqawwim, lawfully inheritable wealth based on the objectives of Islamic law (maqāṣid al-syarīʿah), particularly within the framework of ḥifẓ al-māl (protection of property). Nonetheless, the absence of technical provisions in the Compilation of Islamic Law (KHI), the Civil Code, and the Electronic Information and Transactions Law (ITE Law) creates legal uncertainty, impeding access and execution of digital inheritance by heirs. Therefore, a responsive and adaptive legal formulation is urgently needed to ensure justice and legal certainty in the inheritance of digital assets.

Abstract

Dr. Muhammad Yusuf al-Qaradhawi is a famous scholar who was born in western Egypt in 1926. He studied at al-Azhar University and productively wrote many works in various fields using the al-'Adl method as one of the significant contributions to the advancement of science. The al-'Adl method is a concept based on the Qur'an and Sunnah with a strong methodological framework and is able to produce a logical balance model (al-Tazawun) according to the size, scale of the tasyri' spirit and human ratio. Al-'Adl is a characteristic of al-Qaradhawi's view with an emphasis on the priority of actions that are in line with the Qur'an and its evidence, participating in opening up thinking, correcting its methodology and laying a strong foundation for the development of fiqh as the will of the Qur'an. This research uses a literature study method with a qualitative approach to examine the al-'Adl method and its application in the context of contemporary family law. The results of the study show that al-Qaradhawi provides answers to various problems of Islamic family law in the form of contemporary fatwas using the ijtihad al-'Adl method in his book entitled Hadyul Islam Fatawi Muashirah. Some of the issues that are of concern in this study include: The law of dowry and its wisdom, the law of marrying a former mother in law whose child has not been intimate with, the problem of the amount of inheritance, inheritance for disobedient children, and the amount of milk that prohibits marriage. al-'Adl reflects the alignment of Islamic law with the spirit of justice and balance.
