Abstract

This study aims to examine the protection and registration of YouTube content as a productive asset through the perspective of istislah in Islamic law. The research method used is a literature review and legal analysis focusing on regulations in Indonesia, including Law Number 28 of 2014 on Copyright, Law Number 6 of 2023 on the Stipulation of Government Regulation in Lieu of Law on Job Creation, and Government Regulation No. 24 of 2022 on the Creative Economy. The results show that YouTube content has great potential to become a valuable asset with strong legal protection. Existing regulations in Indonesia allow YouTube content copyright to be automatically protected and used as fiduciary collateral. The copyright registration process involves several steps ensuring that creators have physical proof of their works, which is crucial for resolving legal disputes. This protection aligns with the principle of istislah in Islamic law, emphasizing public welfare and encouraging innovation and creativity. The conclusion of this study is that legal protection and registration of YouTube content as a productive asset not only protect creators' rights but also promote the growth of the creative economy. With this protection, creators can maximize the value of their content as a source of income and long-term investment. The perspective of istislah provides an ethical and legal foundation to support this policy, ensuring that its benefits are felt by the wider community.

Abstract

This study aims to analyze the legal aspects of the staple food arisan system implemented in Bangun Rejo Village, Tanjung Morawa District, and how the Al-Maslahah perspective as one of the theories of Islamic legal determination applies to the staple food arisan practice. Staple food arisan is a socio-economic activity often carried out by the community with the aim of helping to meet basic needs affordably, although in its implementation it can give rise to potential legal issues related to the discrepancy between the value of goods, clarity of contracts, price changes, and its management system. This study was conducted using an empirical juridical method, namely one that examines based on field data through interviews or observations and supported by related legal literature. The approach used is a sociological approach and a conceptual approach. The results of this study indicate that the staple food arisan practice in Bangun Rejo Village provides considerable benefits to the community, such as making it easier for people to meet basic needs and can foster a sense of togetherness among fellow human beings. However, from an Islamic legal perspective, this practice must be given more attention, especially in determining the contract which must be clear, equal in price value, and avoid elements that have the potential to cause uncertainty and loss. Thus, the principle of Al-Maslahah can be used as a basis for improving the basic food arisan system so that it can continue to provide benefits in accordance with Islamic principles.

Abstract

Makalah ini menganalisis akuntabilitas BPOM atas distribusi sirup anak yang terkontaminasi zat beracun, dengan menggunakan kerangka maqashid syariah. Studi ini sebagian besar didasarkan pada kasus sirup yang terkontaminasi etilen glikol dan dietilen glikol baru-baru ini. Studi ini bertujuan untuk mengkaji pelaksanaan tugas BPOM dalam menjaga distribusi sirup anak yang terkontaminasi zat berbahaya, dan untuk menilai kesesuaian tindakan BPOM dari sudut pandang maqashid syariah. Pendekatan penelitian yang digunakan adalah yuridis normatif, yang menggabungkan studi literatur yang melibatkan pemeriksaan berbagai sumber hukum, aturan, dan kebijakan yang berkaitan dengan pengawasan obat dan makanan, termasuk peraturan perundang-undangan yang relevan, peraturan BPOM, dan rekomendasi internasional terkait keamanan obat. Studi ini menunjukkan bahwa meskipun BPOM telah menerapkan penarikan produk dan penyebaran informasi kepada publik, kekurangan dalam sistem pemantauan dan komunikasi masih ada, yang melemahkan efektivitas upaya mereka. Temuan studi ini menyoroti perlunya BPOM meningkatkan sistem pemantauan dan transparansi dalam mengelola insiden produk farmasi yang terkontaminasi. Hal ini menggarisbawahi perlunya kolaborasi antara BPOM dan Lembaga Perlindungan Konsumen Swadaya Masyarakat (LPKSM) untuk membangun sistem yang lebih aman dan responsif dalam menangani risiko kesehatan, sekaligus memastikan bahwa langkah-langkah yang diterapkan selaras dengan maqashid syariah dalam menjaga kehidupan dan kesehatan masyarakat.

Abstract

This research is motivated by the practice of using the banner "everything for 35,000" in retail businesses, where in reality not all goods are sold at that price. This condition indicates a discrepancy between the information conveyed and the practice in the field, thus potentially causing misunderstandings and losses for consumers. This study aims to analyze legal protection for consumers regarding this practice based on the perspective of the Compilation of Sharia Economic Law (KHES) and Law Number 8 of 1999 concerning Consumer Protection. This study uses an empirical juridical method with a statutory and conceptual approach. Data were obtained through observation, interviews, and literature studies, then analyzed qualitatively. The results of the study indicate that the use of the banner is a promotional strategy but contains information that is not entirely true. This practice has the potential to violate consumers' rights to correct, clear, and honest information as regulated in Article 4 letter (c), and is contrary to the obligations of business actors in Article 7 letter (b). In addition, this practice also has the potential to violate Article 8 paragraph (1) letter (f), Article 9 paragraph (1) letter (a) and Article 10 letter (a). From the perspective of KHES, this practice is not in line with the principles of honesty, transparency, and good faith as stipulated in Article 21 letters (g) and (j), and contains elements of tadlis as stipulated in Article 29 paragraph (1). Thus, the discrepancy in the price claims of the goods has the potential to conflict with the provisions of positive law and Islamic economic law, so that business actors are required to convey price information clearly and not misleadingly to ensure consumer protection.
