Abstract

Pelanggaran pilkadabisa terjadi dari awal perencanaan, persiapan, serta tahapan hingga perhitungan suara hasil pilkada. Pelanggaran pilkada adalah berupa pelanggaran administrasi dan pelanggaran pidana. Permasalahan tersebut berimplikasi pada daftar pemilih, hak memilih, dan perhitungan suara. Tidak terdaftarnya seseorang dalam daftar pemilih dapat berimplikasi terhadap hilangnya hak pilih sebagai masyarakat atau warganegara. Lalu daftar pemilih yang tidak terdaftar dapat dimanfaatkan untuk melakukan kecurangan yaitu penggelembungan suara untuk memenangkan paslon yang sudah terikat kerjasama. Melihat permasalahan diatas, dirumuskan suatu masalah yaitu bagaimana membangun citra masyarakat terhadap penyelesaian sengketa pilkada dalam upaya memperkuat legitimasi. Penelitian ini menggunakan metode penelitian yuridis normatif, digunakan dua pendekatan yaitu pendekatan perundang-undangan (Statute Approach) dan pendekatan kasus(CaseApproach). Sengketa Pemilu terbagi dua: sengketa dalam proses Pemilu dan sengketa pada tahapan akhir yaitu perselisihan hasil Pemilu.

Abstract

The Indonesian criminal justice system is still dominated by a retributive approach that focuses on punishment, even in handling minor crimes. This has led to overcrowded correctional facilities and a lack of effectiveness in achieving restorative justice. Restorative Justice (RJ) emerges as an alternative solution that prioritizes victim recovery, offender accountability, and community involvement in resolving cases. This study aims to analyze the implementation of RJ in resolving minor crimes, identify challenges in its application, and propose optimization strategies to enhance its effectiveness within Indonesia’s criminal justice system. Using a normative research method with a qualitative approach, this study examines existing legal regulations supporting RJ and explores case studies of its implementation in several regions. The findings indicate that RJ in minor crimes has been accommodated in several legal policies, such as Indonesian National Police Regulation No. 8 of 2021. However, obstacles remain, including limited understanding among law enforcement officials, a lack of public awareness, and the absence of comprehensive regulatory harmonization. Therefore, optimizing RJ requires strengthening legal policies, enhancing the capacity of law enforcement agencies, and increasing community participation in resolving disputes outside the formal judicial system. Effective RJ implementation is expected to create justice that focuses on restoration, reduce the burden on the criminal justice system, and ensure that law enforcement operates in a more humanistic and fair manner.

Abstract

The enhancement of judicial welfare represents a pivotal aspect in the attainment of a just and respectable legal system. A financially secure judiciary will be better positioned to fulfill its obligations in an impartial and ethical manner, eschewing the allure of corruption. The objective of this research is to examine the necessity of enhancing the welfare of judges in the context of a fair and dignified judiciary. The research method employed is a normative research method with a statute approach, which was analyzed using content analysis. The findings of this study indicate the necessity for action to improve the welfare of judges, including the implementation of salary and allowance increases, the provision of adequate facilities and infrastructure, and the establishment of legal protection for judges in the performance of their duties. Furthermore, it is imperative to consider the necessity of rigorous oversight of judges' ethical conduct and the provision of incentives for exemplary performance. The improvement of judges' welfare is expected to facilitate the creation of a conducive working environment for fair and dignified law enforcement. This will reinforce public trust in the judicial system, guarantee the protection of people's rights, and maintain the integrity and dignity of the judiciary in carrying out its function as the upholder of justice. This research will address the urgency of improving judges' welfare in order to realize a fair and dignified judiciary.
