Abstract

Tobacco Plain Packaging Act (TPPA) 2011 is one of the laws enacted by Australia which is opposed by tobacco producing countries because it requires plain packaging of cigarettes and other tobacco products. The purpose of this research are to find out the relevance of the TPPA 2011 promulgated by Australia to the trade provisions in the WTO, and to find out the legal consequences for WTO members that have bilateral relation with Australia. The specifications of this research is descriptive. The type of research is normative juridicial research. The approach method is statute approach, and case aprroach. The data collection technique is through the study of primary, secondary and tertiary legal material which are analyzed using qualitative methods. The first result is, TPPA 2011 is not relevant to the trade provisions in the WTO. The second result is the WTO members that have bilateral relation with Australia must be willing to comply with the TPPA 2011. Keywords: Australia; cigarette plain packaging;TPPA 2011.

Abstract

Land grabbing is taking or seizing other people's land for personal gain and causing losses to landowners. The lawsuit in Verdict Number 19/Pdt/G/2011/PN. Krw. Originated from the actions of the father of Defendants, who sold the Plaintiffs' land without any rights, as well as the activities of the Co-Defendants, who bought land from the father of Defendants without any rights. This action was very detrimental to the Plaintiffs. This article aims to analyze the activities of the Defendants and the Co-Defendants in tort and the consideration taken by the Panel of Judges in rejecting and or granting a tort lawsuit. This article results from normative juridical research using statutory and case approaches. The data used are secondary data, including primary legal materials, secondary legal materials, and tertiary legal materials, collected by literature study and then analyzed using qualitative analysis methods. Based on the research results, the actions committed by the Defendants and Co-Defendants were a tort, and the Panel of Judges partially granted the Plaintiff's claim.

Abstract

International trade law is one of subjects at Sekolah Tinggi Hukum Bandung (STHB) in semester VI. It provides some theories to be applied in the field, especially those related to international trade. Students must be able to apply the theories through case analysis. However, the problem found in the classroom is the students have difficulty understanding the materials so the learning outcomes are not satisfactory. This research is limited to the application of mind mapping models in international trade law and is limited to certain subjects, namely Class A students in semester VI at STHB for the Academic Year 2021/2022. The problems identified were related to the application of the mind mapping model in international trade law, and how much improvement in learning outcomes. This research is a Classroom Action Research (CAR). The approach is a mixed method. The research was conducted on a two-cycle CAR. The data used were from students of Class A.The data collection method is the observation method. The result of thisresearch is that the application of learning using the mind mapping model inthe international trade law course proved successful, and the increase inlearning outcomes was very high.

Abstract

 Ketidakjelasan sikap Indonesia untuk meretaliasi Korea Selatan atas tuduhan dumping yang dilontarkan Korea Selatan merupakan suatu pelemahan eksistensi Indonesia di dunia perdagangan internasional. Nyatanya, sampai sekarang tidak diketahui tindakan pasti yang dilakukan agar Korea Selatan melaksanakan putusan Panel DSB WTO. Tujuan penelitian ini adalah untuk menemukan penyebab menggantungnya proses retaliasi Indonesia terhadap Korea Selatan, dan untuk menemukan solusi tentang kepastian retaliasi Indonesia terhadap Korea Selatan. Metode penelitian yang digunakan adalah metode penelitian deskriptif. Metode pendekatan yang digunakan adalah metode pendekatan yuridis normatif. Berdasarkan hasil penelitian, putusan Panel yang merekomendasikan Korea Selatan untuk mengembalikan ketentuannya terhadap Indonesia tidak dipatuhi oleh Korea Selatan. Sebagai jalan terakhir adalah retaliasi. Tetapi, Indonesia tidak memanfaatkan kesempatan itu, sehingga Korea Selatan masih tetap pada pendiriannya. Sebagai akibatnya, putusan DSB WTO pun tidak terlaksana dengan efektif.AbstractObscurity of Indonesia decision to retaliate South Korea over South Korea’s dumping allegation is a weakening of Indonesia’s existence in the world of international trading. In fact, there have been unknowing action taken so South Korea implements the ruling of DSB WTO Panel. The aim of this research is to find the causes of the uncertainty of Indonesia’s retaliation process towards South Korea and to find a solution for Indonesia’s retaliation towards South Korea. The research method used is descriptive research. The approached method used is a normative judicial approach method. Based on the result of this research, the decision of Panel which recommends South Korea to improve its provisions for Indonesia unimplemented by South Korea. For the last remedy is retaliation. However, Indonesia did not take the opportunity, and South Korea is still on its decision. As a result, the DSB WTO ruling was not implemented effectively.

Abstract

The purpose is to discover the essence of Friday Prayer for women and provide several views regarding the right to worship for women. The background of this paper is based on the differences of views regarding Friday Prayer for women. These differences lead society to divisions that must be immediately prevented because possible to trigger various actions contrary to the law from certain groups who do not understand the essence of the problem. This paper is normative juridical research using an interdisciplinary approach. Field research is only a complement to support research results. The novelty of this paper presents different research on the substance of Friday Prayer considered essential but received less attention from the public and most researchers, namely Friday Prayer “for women”. The results show that the essence of Friday Prayer for women is sunnah (permitted/not prohibited), based on Surah Al-Jumu’ah verse 9 and hadiths that exclude the obligation of Friday Prayer for women. Besides that, the action that is committed by women to perform Friday Prayer is guaranteed by law. If someone prohibits or forces women to perform or not to perform Friday Prayer, that person has violated someone’s right and the law.

Abstract

Ketertiban umum merupakan salah satu bagian penting dalam tubuh hukum perdata internasional (HPI) karena ketertiban umum berkaitan dengan paham-paham asasi dan dasar-dasar HPI yang menyentuh sendi utama dan falsafah HPI yang sangat mendasar dan dalam. Tapi, belum ada pengertian yang seragam terhadap ketertiban umum, termasuk di Indonesia. Tulisan ini membahas tentang batasan-batasan konsepsi ketertiban umum dalam HPI di Indonesia dan bagaimana hakim menerapkan konsepsi ketertiban umum dalam menolak pemberlakuan kaidah hukum asing. Tulisan ini bersifat deskriptif. Tulisan ini merupakan hasil dari penelitian yuridis normatif dengan menggunakan metode pendekatan perundang-undangan. Data yang digunakan adalah data sekunder yang terdiri dari bahan hukum primer, bahan hukum sekunder, dan bahan hukum sekunder, yang dikumpulkan secara studi pustaka untuk kemudian dianalisis dengan menggunakan metode analisis kualitatif. Berdasarkan hasil penelitian, batasan-batasan konsepsi ketertiban umum dalam HPI Indonesia tetap mengacu pada Pancasila, dan hakim menerapkan konsepsi ketertiban umum dalam kasus HPI harus mengacu pada sumber-sumber hukum yang diakui di Indonesia untuk kemudian dijabarkan dalam pertimbangan putusan.

Abstract

The purpose of this paper is to analyse the similarities and differences in the perspectives of various institutions in Kuningan and Jakarta and examine these views from a human rights perspective. The background of this study is the issue of legal uncertainty surrounding interfaith marriages. On one hand, it is prohibited, and the other hand it is permitted but made difficult. This research is significant as it addresses the phenomenon of interfaith marriages, which the Indonesian government has ambiguously responded to. On one hand, such marriages are permitted but made excessively difficult; on the other hand, they are prohibited but ultimately recognized. This paper employs a sociological-juridical research methodology with a comparative approach. Fieldwork was conducted in two cities, Kuningan and Jakarta, using interviews with interfaith couples and officials from local RAO, CRSO, RC, and DC. The novelty of this paper lies in its identification of human rights violations based on empirical evidence. The comparative findings from the two cities reveal that the current legal framework governing marriage in Indonesia fails to reflect certainty and justice. Furthermore, interfaith marriage remains a significant and unresolved issue in the country.

Abstract

Freedom of religion is a fundamental human right that cannot be revoked by any authority, including the state. However, the reality demonstrates that acts of intolerance and discrimination persist, perpetrated not only by individuals within society but also by state officials and law enforcement officers against certain communities. These actions undermine the realization of religious freedom. The implementation of this right practically lacks adequate protection from the state. The core issue lies in the interpretation of human existence and the role of religion, and the understanding of religious freedom in Indonesia. This article seeks to deepen the comprehension of human existence and religion while uncovering the obscured dimensions of religious freedom in the Indonesian context. This study employs normative juridical research with an interdisciplinary approach, examining secondary data. The findings indicate that humans and freedom are inherently connected. Religion offers individuals freedom, while humans, in turn, embody sacred values. Religion is not a tool to secure basic services from the state. Indonesia must protect human rights so that everyone can practice religious freedom. Indonesia must foster an atmosphere of tolerance, while also promoting a high level of democracy to all sectors of society through self-reflection as individuals seek personal freedom.

Abstract

Introduction: The emergence of online transportation provides significant changes in various aspects of people's lives. But its success raises protests from several groups for the abolition of online transportation. The rapid technological development of land transportation that cannot be accommodated by Indonesian law can affect the certainty of law. Further, it can provide legal protection to related parties.Purposes of the Research:  This research aims to analyse the implication of online transportation as land transportation in Indonesia, and to recommend the accommodation of online transportation in Law Number 22 of 2009 on Road Traffic and Transportation to the Government of Indonesia.Methods of the Research: This research employed the normative juridical method by examining secondary data collected from library research using the statutory approach method analysed by qualitative technique.Results of the Research: The results show that the existence of online transportation as land transportation has positive implications for society such as the easier process, saving time, saves energy, can identify drivers, can track routes and vehicle locations, traffic monitoring, safety standards, lower costs, promos and discounts, efficient payment methods, and driver services. The other benefits are reducing the unemployment rate, increasing people's income, reducing the number of poverties, improving the people's welfare, and increasing the productivity of every institution and company. So, the government of Indonesia must accommodate online transportation in Law Number 22 of 2009 on Road Traffic and Transportation.

Abstract

This study examines the intricate social dynamics surrounding the legalization and rejection of same-sex marriage across various countries, particularly through the interplay of moral and ethical values, social norms, and formal state laws. Methodologically, this study adopts normative juridical research and relies on secondary sources of data, including primary, secondary, and tertiary legal materials. A comparative method is employed to contrast and contextualize diverse legal and socio-political perspectives. The data, collected through extensive library research, are analysed using a qualitative analytical framework. This study identifies two central points of focus. First, the factors that distinguish the perspectives of proponent and opponent countries regarding same-sex marriage. Second, the variables influencing the strengthening or weakening of support for same-sex marriage within different national and cultural contexts. Generally, proponent countries emphasize adherence to universal human rights instruments, including the recognition of same-sex marriage, while opponent countries often rely on contextual interpretations shaped by cultural and religious values. The findings of this study reveal five key factors that account for the differing perspectives on same-sex marriage: the enduring debate between universality versus relativity of human rights, differing ideological orientations, contrasting conceptions of the relationship between state and religion, varied constructions of moral benchmarks upheld by states, and the distinctive national legal frameworks adopted. In addition, five further determinants are identified as shaping the intensity of public and legal support: prevailing societal values (individualistic or communal), judicial decisions, the presence of civil society movements, the influence of public figures, and the broader national objectives pursued.
