Abstract

Today cloning has become “the hottest topic” in biotechnology and biomedical studies. The earliest opening questions about human cloning are: Will human cloning become normative on this planet? This seems to be a very simple question, but it is not enough to answer yes or no, it requires deep thinking. The purpose of this research is to analyze the issue of human cloning from the perspective of natural law, legal positivism, and utilitarianism. This research uses an interdisciplinary approach to explore different perspectives in answering the issue at hand. The results show that from the perspective of natural law, human cloning shows that humans have transcended their nature as creatures created by God and instead want to step over God as the creator of all life. While in the perspective of legal positivism, if cloning is done without going through a legal marriage process and can use eggs and any cells other than sperm from the husband and wife concerned, it is very clear that cloning of humans is contrary to or violates positive law in Indonesia (Health Law and Government Regulation on Reproductive Health). Then in the perspective of utilitarianism, the goal of Utilitarian theory can indeed be achieved because cloning can in fact avoid humans from distress or suffering, but this is only for some individuals because cloning does not provide benefits or happiness in a broad scope or in this case society as a whole, especially the lower middle class.

Abstract

Nowadays, there are still many cases in the community about the practice of buying and selling land based on debt and credit, which causes unbalanced fulfillment of the rights and obligations of the parties who make it, and causes losses to one party, especially the party who transfers his land rights. Not infrequently there are also many Notary officials who are involved in the making of a sale and purchase binding agreement based on debt and credit, as in the example of a case decided by the Surabaya District Court with case number 198/Pdt.G/2019/PN.Sby. The purpose of this study is to determine the position of the deed of sale and purchase binding agreement based on debt and credit in terms of the principle of proportionality and to determine the role of notaries in protecting the interests of the rights and obligations of the parties to the agreement. The research method is normative juridical method using statute approach, and case approach. From the research it can be concluded that the position of the deed of sale and purchase binding agreement based on debt and credit is proven to violate the legal principle of proportionality and Notary as a public official has an important role in ensuring protection for the rights and obligations that may arise from agreements made by the parties involved.

Abstract

Penelitian ini bertujuan untuk memberikan perbandingan persyaratan mengenai bakal calon Presiden dan Calon Wakil Presiden sudah tercantum didalam pasal 6a Ayat 2 Undang-Undang Dasar 1945 yang masih sering menimbulkan pro dan kontra terkait aturan ini karena dinilai mengurangi hak seseorang untuk mencalonkan diri sebagai Presiden dan Wakil Presiden, sehingga diperlukan pembaharuan hukum. Peneltian ini menggunakan jenis penelitian hukum normatif. Dalam hasil yang diteliti menyatakan bahwa Apabila kita menggunakan metode yang sama dengan negara brazil yaitu dengan memperoleh kemenangan sebesar 50% + 1 suara menjadi syarat kemenangan Calon Presiden dan Wakil Presiden, maka hal ini memicu terjadinya gelombang 2 pemilihan suara dan pasti akan menambah biaya pemilu yang sangat besar sekali. Jika dikontekstualkan dengan pengaturan di Indonesia saat ini, maka pasal 6A ayat (3) telah mengatur bahwasanya untuk dilantik menjadi seorang Presiden, seorang kandidat harus mendapatkan suara sebesar 50 persen dari jumlah suara dalam pemilu dengan sedikitnya 20 persen suara di setiap provinsi yang tersebar di lebih dari setengah jumlah provinsi di Indonesia.
