Abstract

Perjanjian kontrak kerja, yang mengatur hak dan kewajiban masing-masing pihak, merupakan hubungan hukum penting antara pekerja dan pengusaha. Namun, ada halnya ketika perjanjian tersebut dapat gagal yang menyebabkan salah satu pihak mengalami kerugian. Untuk menghindari kegagalan dan menjaga hubungan kerja yang sehat dalam situasi seperti ini, penting untuk menyelesaikan perselisihan. Ada dua cara penyelesaian sengketa, yaitu non-litigasi (seperti negosiasi dan mediasi) dan litigasi atau melalui jalur hukum (seperti pengadilan). Sangat penting untuk memahami upaya hukum yang dapat ditempuh oleh pihak yang dirugikan dalam penyelesaian sengketa wanprestasi perjanjian kerja. Para pihak dapat membangun hubungan profesional yang kuat, saling menguntungkan, dan berkelanjutan melalui tindakan pencegahan yang tepat, seperti membuat perjanjian yang jelas, berkomunikasi secara terbuka, mengawasi kinerja, dan bekerja sama untuk menyelesaikan sengketa. Dengan demikian, penulis melakukan analisis terhadap kasus wanprestasi perjanjian kerja dengan metode penelitian hukum normatif agar dapat memberikan pemahaman yang lebih mendalam tentang penerapan hukum perdata dan implikasi hukumnya.

Abstract

The Constitutional Court (Mahkamah Konstitusi) plays a crucial role in safeguarding the constitution and upholding the principles of constitutional democracy in Indonesia. However, its credibility and integrity have been seriously questioned following the issuance of Constitutional Court Decision No. 90/PUU-XXI/2023, which addresses the minimum age requirement for presidential and vice-presidential candidates. This ruling sparked widespread controversy due to its perceived political interests and alleged violations of judicial ethics by several justices, particularly Chief Justice Anwar Usman, who was found by the Constitutional Court’s Honorary Council (MKMK) to have breached impartiality due to a family conflict of interest involving one of the candidates favored by the decision. This study employs a normative legal research method using both statutory and conceptual approaches to critically analyze the role of judicial ethics in maintaining the independence of the Constitutional Court, and to evaluate the legal and sociological implications of ethical violations on the legitimacy and validity of the Court's decision. The analysis shows that while the ruling remains legally valid and binding in accordance with Article 24C of the 1945 Constitution and the Constitutional Court Law (UU MK), which affirms the final and binding nature of Constitutional Court decisions, its moral and social legitimacy is significantly undermined due to unethical practices that contradict the principles of integrity, transparency, and accountability. Ethical violations in the decision-making process not only tarnish the personal reputation of the justices involved but also erode public trust in the institutional independence of the Constitutional Court. In modern constitutional legal systems, procedural legality cannot be separated from constitutional morality. The continued function of the Constitutional Court as the protector of citizens' constitutional rights and the guardian of constitutional supremacy is heavily dependent on the legitimacy derived from public trust. Abstract

The development of artificial intelligence (AI), particularly big data-based generative models, has created new challenges in copyright protection. This research examines the regulatory gap in Indonesian law regarding the use of copyrighted works as training data in AI model training, focusing on normative analysis and a case study of Kadrey Vs. Meta Platforms Inc. The research method used in this article is normative law, conducted by examining the legal norms contained in laws and regulations. The results of this study demonstrate that the widespread use of unauthorized creative works has the potential to violate the economic and moral rights of creators, while also opening up debate regarding the application of the principle of fair use in the context of modern AI. In Indonesia, the unclear definition of creator, the status of AI-generated works, and the lack of regulations regarding dataset transparency and permission mechanisms exacerbate the existing legal vacuum. This research concludes that Indonesia needs comprehensive legal reform to regulate the use of copyrighted works in AI training. Thus, regulatory updates are urgently needed to ensure that technological advancements do not diminish legal protection for creators and the national intellectual property ecosystem.
