Abstract

Abstrak Studi ini mengkaji peran Dewan Perwakilan Rakyat Daerah (DPRD) Jawa Timur dalam menyusun, memberlakukan, dan mengawasi Peraturan Daerah (Perda), yang berfungsi sebagai instrumen hukum penting dalam pemerintahan daerah. Harmonisasi Perda dengan peraturan nasional dan proses legislasi yang tepat sangat penting untuk menciptakan undang-undang yang efektif, sah, dan selaras dengan kebutuhan masyarakat. Sementara proses harmonisasi sering diabaikan, kegagalan untuk memenuhi prosedur ini menimbulkan risiko ketidakpastian hukum dan potensi pembatalan Perda. Studi ini berfokus pada mekanisme untuk memberlakukan Perda dan kekuatan hukum peraturan yang belum mengalami harmonisasi. Temuan menggarisbawahi bahwa harmonisasi merupakan langkah penting dalam memastikan kepastian dan stabilitas hukum, serta dalam mencegah konflik kebijakan antara pemerintah daerah dan pusat.

Abstract

Domestic violence (DV) is a multidimensional issue that encompasses legal, social, and cultural aspects. Although regulations such as Law Number 23 of 2004 on the Elimination of Domestic Violence have been enacted, in reality, the implementation and protection for victims remain weak. Many DV cases are resolved informally due to strong social norms and patriarchal cultural values, especially in certain regions of Indonesia. This article examines the effectiveness of family mediation approaches from an Islamic perspective as an alternative resolution for domestic violence. In Islam, mediation or tahkim is viewed as a peaceful solution grounded in the values of justice, compassion, and victim protection. Through a normative juridical approach and qualitative analysis, this article highlights that Islamic mediation can serve as a resolution instrument that not only reconciles but also ensures the safety and rights of victims—provided it is conducted by competent mediators who understand victim protection principles. Therefore, synergy between Islamic law and positive law is essential to achieving justice and preventing recurring violence within families.

Abstract

The Constitutional Court Decision No. 46/PUU-VIII/2010 has brought significant legal reforms regarding the recognition of children born outside of marriage. Previously, such children were legally affiliated only with their mothers, as stipulated in Article 43 paragraph (1) of Law Number 1 of 1974 on Marriage. Through this ruling, the Court affirmed that children born out of wedlock who can be proven to have a biological relationship with their father are also entitled to legal civil recognition, including inheritance rights. This study aims to examine the legal implications of the decision on inheritance rights of children born out of wedlock and its practical implementation within the Indonesian legal system. Using a normative juridical approach, the research analyzes secondary data through literature reviews of statutory regulations, legal doctrines, and relevant court decisions. The findings indicate that although the Constitutional Court’s ruling provides greater justice for out-of-wedlock children to claim inheritance rights, its implementation faces obstacles, particularly in proving biological relationships and reconciling with religious norms. Therefore, legal harmonization and a comprehensive understanding by law enforcement officials are needed to ensure the equitable and just fulfillment of the rights of children born out of wedlock
