Abstract

This research aims to identify and analyze the problems of insider trading in capital market practices in Indonesia. This research is normative legal research. Legal materials consist of primary and secondary legal materials obtained through literature study. The approach used includes a statutory regulatory approach. Based on the results of the discussion, it is known that first, Law Number 8 of 1995 concerning Capital Markets (UUPM) still has several weaknesses. Article 95 does not explain who is meant as an employee of the issuer. Apart from that, UUPM has a legal loophole to reach insider trading which is based on misuse of information to carry out transactions. UUPM only regulates insider trading that occurs as a result of violations of obligations. Second, the law enforcement process for insider trading violators in Indonesia is still considered very weak. Third, POJK Disgorgement is one of the government's efforts to deal with insider trading. These efforts include examination, investigation, evidence, dispute resolution, and imposition of sanctions. Researchers provide suggestions including, first, strengthening the role of OJK in terms of supervision. Second, the formation of a special unit consisting of several institutions to handle and resolve insider trading practices so that they are effective and efficient. Third, increasing understanding and education related to POJK Disgorgement in the community. Keywords: Problems; Insider Trading; Capital Market

Abstract

Konsep keadilan restoratif atau sering kali dikenal sebagai restorative justice adalah suatu pendekatan alternatif penyelesaian perkara pidana yang bertujuan untuk memulihkan ataupun mengembalikan penyelesaian perkara kepada keluarga dan masyarakat, sehingga penyelesaiannya tidak hanya berujung kepada sanksi pidana penjara. Konsep keadilan restoratif saat ini banyak dibicarakan dalam bidang hukum pidana Indonesia, tetapi jauh sebelum itu, hukum Islam sudah mengatur serta menerapkan konsep tersebut dengan cara al-islah atau perdamaian. Oleh karena itu, penelitian ini ditujukan sebagai pendeskripsian persamaan dan perbedaan konsep restorative justice dalam hukum pidana Indonesia dengan hukum pidana Islam yaitu tergantung jenis perkara, pengganti kerugian dan terkait umur. dan menarik kesimpulan konsep restorative justice dalam hukum pidana Indonesia lebih sesuai digunakan dalam penyelesaian perkara tindak pidana dengan berbagai macam suku, budaya, karakter dan agama. Pada penulisan artikel ini menggunakan metode kualitatif dan pendekatan komparatif untuk mengetahui perbandingan dari kedua konsep keadilan tersebut.

Abstract

In Indonesia , there is a Consumer Protection Law as an effort to guarantee consumer protection in online transactions, especially in e-commerce. This research aims to examine muamalah's legal views regarding consumer rights amidst the widespread use of e-commerce. This research is normative legal research which includes a statutory approach (statue approach) and a case approach, which in obtaining legal materials is carried out through literature study. Based on the research results, it is known that the practice of e-commerce in the business world is seen as a form of digitalization of buying and selling which according to Islamic sharia is permitted provided that it follows sharia principles and applicable legal regulations, especially in fulfilling consumer rights and protection. Researchers will examine Islamic legal views on e-commerce transactions and find out how consumer rights are fulfilled in the e-commerce system.

Abstract

This research analyzes the urgency of regulating Artificial Intelligence in supporting the national defense system. This research is a perspective normative legal research. The approaches used include the Legislation approach and the comparative approach. Legal materials consist of primary and secondary legal materials. Legal materials are obtained through library studies. Analysis of legal materials is done through deductive syllogism. Based on the discussion results, it is known that first, the use of Artificial Intelligence in strengthening the national defense system is increasingly developed by countries worldwide. Second, Indonesia still needs to be more optimal in using Artificial Intelligence technology to enhance the national defense system. Third, Indonesia still needs laws and regulations that specifically regulate the use of Artificial Intelligence in the national defense system. Researchers provide suggestions, including, first, forming laws and regulations that specifically restrict the use of Artificial Intelligence in the national defense system. Second, strengthening the position of institutions that specifically handle and are responsible for using Artificial Intelligence in the national defense system. Third, enhancing the capacity and capability of human resources in utilizing Artificial Intelligence in the national defense system. Fourth, prioritize Artificial Intelligence in national defense by allocating the special defense budget.
