Abstract

Youth activities in Jimpitan Village in RT 03 RW 03, Batu Jaya, Batu Ceper, Tangerang City are gathered in a forum known as PIKKR (Center for Information, Counseling, Youth Communication). Based on the results of the interview, it is known that the problem faced by the PIKKR youth group is the productivity of the adolescent group in developing and optimizing existing resources. The purpose of implementing this PKM is to empower and develop the potential of PIKKR in the development of Jimpitan Village. Empowerment and development are carried out in the form of design training. The method was carried out with Participatory Action Research (PAR) to the PIKKR youth group. Based on the PKM that has been implemented, it can be concluded that, first, participants' interest in exploring design, participants' understanding of adobe illustrator applications, and understanding of the use of pathfinders show a positive trend. However, in terms of interest in studying adobe illustrator applications shows doubts. Second, participants already understand the basics and theories in the design. Third, participants can already practice these design theories by making design samples. As for the advice given, first, a special space was created that can be used as a design practice for PIKKR teenagers. Second, there are continuous follow-up activities, in the form of advanced training and intensive mentoring.

Abstract

This research aims to identify and analyze the problems of insider trading in capital market practices in Indonesia. This research is normative legal research. Legal materials consist of primary and secondary legal materials obtained through literature study. The approach used includes a statutory regulatory approach. Based on the results of the discussion, it is known that first, Law Number 8 of 1995 concerning Capital Markets (UUPM) still has several weaknesses. Article 95 does not explain who is meant as an employee of the issuer. Apart from that, UUPM has a legal loophole to reach insider trading which is based on misuse of information to carry out transactions. UUPM only regulates insider trading that occurs as a result of violations of obligations. Second, the law enforcement process for insider trading violators in Indonesia is still considered very weak. Third, POJK Disgorgement is one of the government's efforts to deal with insider trading. These efforts include examination, investigation, evidence, dispute resolution, and imposition of sanctions. Researchers provide suggestions including, first, strengthening the role of OJK in terms of supervision. Second, the formation of a special unit consisting of several institutions to handle and resolve insider trading practices so that they are effective and efficient. Third, increasing understanding and education related to POJK Disgorgement in the community. Keywords: Problems; Insider Trading; Capital Market

Abstract

Maraknya kasus kekerasan terhadap anak khsusunya kekerasan seksual yang terjadi di wilyah Kunciran Indah, tujuan kegiatan sosialisasi ini dilakukan guna memberikan informasi kepada masyarakat Kelurahan Kunciran terkait program Perlindungan Anak Terpadu Berbasis Masyarakat dan informasi Undang-Undang Tindak Pidana Kekerasan Seksual. Dengan adanya penyuluhan kegiatan tersebut diharapkan seluruh elemen masyarakat yang ada di wilayah Kunciran dapat aktif dalam melindungi anak jika terjadi kekerasan khsusunya kekerasan seksual di wilayah Kunciran Indah kota Tangerang

Abstract

Introduction: Indigenous peoples are an order of society that existed even before the Indonesian nation was born. The Indonesian state recognizes the existence of indigenous peoples and their rights. The legal protection of indigenous peoples is the responsibility of the state as mandated by the constitution and other relevant laws and regulations regarding the management of natural resources. However, there are still conflicts between indigenous peoples, the government, and companies that have received management permits from the government.Purposes of the Research: This study aims to review and provide a policy model formulation regarding the protection of indigenous peoples in the context of environmental conservation.Methods of the Research: Researchers use normative legal research methods that examine through a statutory approach and a case approach. Legal materials are obtained through literature studies, both primary and secondary legal materials that are relevant to the problem under study.Results of the Research: The results show that currently the arrangements that are a form of recognition and protection of indigenous peoples are still scattered in many laws and regulations. Even though it has been regulated, the arrangement is still not enough, so a policy model for the protection of indigenous peoples is needed that also firmly provides protection in the context of preserving the environment. Because in fact indigenous peoples and the environment are an inseparable part.

Abstract

Penelitian ini bertujuan untuk mengidentifikasi dan menganalisis problematika kebijakan masa jabatan kepala desa dalam tinjauan pembatasan kekuasaan. Penelitian ini merupakan penelitian hukum normatif yang bersifat perspektif. Bahan hukum dalam penelitian ini meliputi bahan hukum primer dan sekunder, yang diperoleh melalui studi kepusatakaan. Bahan hukum primer meliputi peraturan perundang-undangan yang relevan dengan penelitian ini. Bahan hukum sekunder meliputi buku-buku, jurnal-jurnal, serta referensi – referensi lainnya yang memiliki relevansi dengan penelitian ini. Pendekatan dalam penelitin in meliputi pendekatan perundang-undangan. Berdasarkan hasil pembahasan diketahui bahwa Pertama, perpanjangan masa jabatan kepala desa berpotensi terjadinya penyempitan ruang demokratisasi dan prinsip konstitualisme. Kedua, membuka potensi ruang kejenuhan di dalam lingkungan desa dan membuka berbagai macam problematika di desa. Ketiga, kebijakan tersebut sebagai salah satu tindakan mempersempit ruang demokrasi dan memperluas kekuasaan yang bertentangan dengan prinsip konstitualisme. Peneliti menyarankan, pertama, adanya reformulasi kebijakan perpanjangan masa jabatan kepala desa. Kedua, memperkuat pengawasan dalam alokasi dana desa. Ketiga, optimalisasi peran penegakkan hukum terpadu terhadap penegakkan dan pengawasan pemerintahan di Desa.

Abstract

Penelitian ini bertujuan untuk menganalisis problematika penegakan hukum humaniter internasional dalam konflik Israel dengan Palestina. Penelitian ini merupakan penelitian hukum normatif, yang bersifat preskriptif. Bahan hukum yang digunakan adalah bahan hukum primer dan sekunder, yang pengumpulan datanya melalui studi kepustkaan. Pendekatan yang digunakan adalah pendekatan perundang-undangan dan pendekatan kasus. Berdasarkan hasil dari penelitian ini, diketahui bahwa, pertama, berbagai macam upaya perdamaian telah dilakukan untuk menyelasaikan konflik ini, diantaranya melalui perjanjian Oslo dan beberapa Konfrensi Tingkat Tinggi (KTT), namun hasilnya masih belum berjalan dengan baik. Ketiadaan otoritas tertinggi yang kekuasaannya diatas negara dan masyarakat internasional yang dapat memaksa semua pihak yang terlibat dalam konflik ini untuk menaati hukum humaniter internasional menjadi salah satu penyebabnya. Kedua, adanya hak veto selalu menjadi penghalang utama dari resolusi-resolusi perdamaian yang dibuat. Mahkamah Pidana Internasional (ICC) memiliki kewenangan mengadili kejahatan perang, namun ICC mengalami kesulitan karena tidak semua negara menjadi anggotanya, karena kekuasaan ICC masih terbatas kepada negara anggotanya saja. Saran yang diberikan dalam penelitian ini diantaranya, pertama, menggunakan upaya penegakan melalui mekanisme yurisdiksi universal, mengingat penegakan melalui ICC masih memiliki keterbatasan, serta negara lain yang tidak terlibat dalam konflik ini bisa mengadili para pelaku. Kedua, mengoptimalkan diplomasi oleh organisasi internasional, khususnya organisasi Kerja Sama Islam (OKI), dan Dewan Kerja Sama Teluk (GCC).

Abstract

The principle of effective occupation is often used to justify territorial claims based on physical and administrative control; in practice, the application of this principle tends to conflict with fundamental norms in international law such as self-determination and the prohibition of colonization. This article examines the practice and principle of effective occupation that is often used to legitimize territorial claims. This article use normative research with a prescriptive legal approach by analyzing international treaties, international customary law, principles of international law, court decisions, and expert opinions. The Namibia Advisory Opinion and the Western Sahara case illustrates how the principle of effective occupation has marginalized the sovereignty and fundamental rights of indigenous populations. These actions violate peremptory norms, which safeguard human dignity and uphold non-derogable principles such as the prohibition of unlawful occupation and the self-governance of communities. The study’s findings highlight the urgent necessity for a robust legal framework governing territorial claims to ensure they respect fundamental rights and adhere to the foundational principles of international law. This would help prevent the misuse of effective occupation as a justification for territorial expansion while protecting the rights of vulnerable communities.

Abstract

Criminal law policy regulating minor crimes is an urgent issue that needs resolution. The Restorative justice approach in the contextualization of Samagama Sutta is a relevant reference for future research. Resolving cases by prioritizing peace and victim recovery is an appropriate step for out-of-court settlements. Restorative justice as a criminal procedure can be applied through dialogue or deliberation, resulting in an agreement that does not harm either the victim or the perpetrator. This study aims to identify a model of the Restorative justice approach in resolving minor crimes within the context of the Samagama Sutta. This research employs normative legal research, also known as doctrinal research, which involves examining literature and secondary data, including primary, secondary, and tertiary legal materials. The data collection method used is library research, which involves collecting, identifying, classifying, and analyzing data for citation purposes. The data analysis follows the Peter Mahmud Marzuki model. The study results indicate that minor criminal cases should be resolved outside the court by seeking peaceful solutions through agreements between perpetrators and victims. Penal mediation, from a philosophical perspective, applies the win-win solution principle. It serves as an alternative to criminal case resolution that is simple, fast, and cost-effective. This approach aligns with the Samagama Sutta, which emphasizes the relationship between perpetrators and victims through the dispute resolution method (adikarana samatha), ensuring that peace efforts occur as early as possible.
