Abstract

The results of interviews at the Children's and Women's Empowerment Service which were carried out were aimed at proving that violence that occurs against children and women can be motivated by poor finances, our daily habits, our country's social system which is still patriarchal, and the existence of psychological and mental disorders towards perpetrators of violence against children and women. This research is based on quantitative data based on our interviews at D3AKB which will strengthen the data that will be included in this research.

Abstract

Abstract This study aims to examine the implementation of caning punishment reviewed based on Islamic legal philosophy, as in Islam caning punishment is a punishment for perpetrators of criminal acts where the aim is to provide a deterrent effect for the perpetrators of the crime, the formulation of the problem in this study is how is the implementation of caning punishment in Aceh? And how is the implementation of caning punishment reviewed from Islamic legal philosophy, the research method used in this study is normative legal research. The results of this study are Caning punishment in the review of Islamic legal philosophy can be seen from various perspectives that include the values of justice, welfare, and the main purpose of the application of the punishment itself. In Islam, the law has a very strong basis both in the Qur'an and the hadith, which emphasizes the balance between justice and mercy. Caning punishment, which is included in the category of hudud (punishment clearly stated in the text of the sharia), serves to enforce religious rules while providing a deterrent effect on perpetrators of crimes.Kata Kunci: Hukum Cambuk, Hukuman, Filsafat Hukum Islam Keywords: Caning law, punishment, Islamic legal philosophy

Abstract

ABSTRACT:Fatwa (al-Ifta') has an important role in the lives of Muslims as a form of solution to problems that were not encountered in the past. In Islam, fatwas function as legal guidelines resulting from the ijtihad of the mufti, based on the main sources of law, namely the Qur'an and Hadith. The research method used is normative juridical. This study aims to explain the meaning, legal basis, urgency, and influence of fatwa in building a modern society. The results of the study show that fatwa is not only limited to the aspect of worship, but also covers the fields of muamalah, social, political, and economic. Fatwa has a non-binding nature, but its role in solving the problems of modern life is very significant, especially in answering the challenges of the ever-evolving times.Keywords: Fatwa, Al-Ifta', Ushul FiqhABSTRAKFatwa (al-Ifta’) memiliki peranan penting dalam kehidupan umat Islam sebagai bentuk solusi atas persoalan-persoalan yang tidak dijumpai pada masa sebelumnya. Dalam Islam, fatwa berfungsi sebagai pedoman hukum yang dihasilkan dari ijtihad para mufti, berdasarkan sumber hukum utama, yaitu Al-Qur’an dan Hadis. Metode penelitian yang digunakan yakni yuridis normatif. Kajian ini bertujuan untuk menjelaskan pengertian, landasan hukum, urgensi, serta pengaruh fatwa dalam membangun masyarakat modern. Hasil kajian menunjukkan bahwa fatwa tidak hanya terbatas pada aspek ibadah, tetapi juga mencakup bidang muamalah, sosial, politik, dan ekonomi. Fatwa memiliki sifat tidak mengikat, tetapi perannya dalam menyelesaikan permasalahan kehidupan modern sangat signifikan, khususnya dalam menjawab tantangan zaman yang terus berkembang.Kata Kunci: Fatwa, Al-Ifta’, Ushul Fiqh

Abstract

This study aims to determine the extent of the political participation of young voters in the city of Medan and the role of the General Elections Commission (KPU) in socializing new prospective voters in the 2020 Medan City Pilkada and to find out how Siyasah views political participation in the post-conflict local election. regional election. This research uses the type of empirical juridical legal research. Empirical legal research is a type of legal research that analyzes and examines the work of law in society. The data used in this study come from primary data sources and secondary data sources. Data collection techniques used are by conducting interviews and observations. The data analysis technique used is a qualitative data analysis technique. The results of this study indicate that the participation of first-time voters has increased because the KPU of Medan City has evaluated and conducted socialization well and optimally so as to be able to increase the participation of first-time voters, which was originally only 25.38%. in 2015, now it has increased to 45.80% in 2020. Based on the study of siyasah on political participation in the 2020 regional election for the mayor of Medan, it is in accordance with the concept offered by siyasah at all.
