Abstract

In the era of globalization, the escalation of family conflict occurs significantly in various variations and impacts, ranging from divorce to physical and psychological violence even murder. This requires seriousness in finding the right resolution in order to maintain family resilience. This research becomes very important to reveal the right resolution by referring to fiqh-based resolution because fiqh itself is used as a legal framework rooted in Islamic teachings that are relevant in resolving conflicts in the family context. Researchers used a literature review with a qualitative approach to analyze various literature sources related to family conflicts and their resolution. The results showed that the escalation of conflict in the global era with its various variants found its resolution by understanding and applying the principles of fiqh-based resolution in the form of holistic Islamic teachings. The real implication of fiqh-based resolution is that it helps build a harmonious and mutually supportive family environment and is key to resolving family conflicts effectively and sustainably.

Abstract

Deviant behavior in sexual orientation, known as lesbian, gay, bisexual, and transgender, which is more commonly referred to as LGBT, has had a negative impact on social security in society. This is the result of the globalization of LGBT, and the lack of public knowledge about LGBT, religious, and state norms. This study aims to polarize religious laws and then compare them with state norms and laws on preventive patterns of LGBT behavior. The analysis used in this study is a descriptive-analytical method, namely carefully describing preventive patterns of LGBT behavior which are embodied in one source of Islamic law, namely sunnah and its explanations and state law which is embodied in the Criminal Code (KUHP). Based on the results of this study, it was found that there were differences in preventive patterns of LGBT behavior in the perspective of fiqh sunnah and the perspective of Indonesian state law. Preventive patterns of LGBT behavior from the perspective of fiqh sunnah are more assertive in prohibiting the daily behavior of family members which will stimulate a person's psyche to deviate sexual behavior. As for Indonesian state law, preventive measures are looser and less comprehensive. This study recommends that the Criminal Code law be revised again using the applicable mechanism by taking into account the Islamic religious norms embodied in fiqh sunnah.

Abstract

This study explores the political and judicial rights of non-Muslims in Muslim-majority countries, focusing on their categorization, rights, obligations, and limitations as discussed by Islamic scholars. The findings reveal that non-Muslims, particularly ahl al-dhimmah, enjoy significant civil protections, religious freedoms, and the right to maintain their own judicial systems for personal matters. However, certain restrictions exist, such as the obligation to pay jizyah and limitations on holding primary leadership positions, which serve to preserve the social, ideological, and legal order of the Islamic state. The study demonstrates that Islam balances minority rights with the moral and political framework of governance, providing a nuanced understanding of coexistence in historical and contemporary Muslim societies.

Abstract

One form of the local wisdom of the archipelago's ulamas in grounding the noble values of Islamic religious teachings, is the dissemination of the concepts and content of the hadiths of One form of local wisdom of the archipelago's scholars in grounding the noble values of Islamic teachings is the dissemination of the concepts and content of the traditions of the Prophet Muhammad ﷺ in Javanese language, modified with Arabic style and written in beautiful poetic strokes. The combination of these concepts is considered cooler, more interesting, and more familiar to the ears and souls of those who receive it from the Javanese community. This study aims to explore the concept of hadith thought of Abu Muhammad Al Hajawi and to determine the quality of the hadiths that are expressed in the form of Sekar Cempoko poems. The data analysis technique in this research is content analysis, in which researchers study and analyze the concept of Al Hajawi's hadith thinking. The results of this study show that Al Hajawi conveys the noble values of the prophet's traditions not with the original text but by translating them into the language of the local community and then making them more attractive by decorating them with literary art in the form of poems. As for the typology of the quality of the traditions that are highlighted in his verses in this manuscript, not all of them are categorized as sahih and hasan, there are some weak and even false hadith that he implies in some of his verses.
