Abstract

Ketersediaan tanah di Indonesia memang sedikit dibandingkan kebutuhan yang harus dipenuhi terlebih lagi negara dalam hal ini harus memperhatikan kesejahteraan rakyatnya dengan membangun fasilitas umum salah satunya, tentunya erat kaitannya dengan fungsi sosial. Untuk memenuhi ketersedian tanah tersebut dengan cara melakukan pengadaan tanah. Pengadaan tanah mengedepankan kepentingan pembangunan dan kepentingan masyarakat dengan memperhatikan keadilan bagi masyarakat. pro kontra pelaksanaan pengadaan tanah masih sering terjadi bahkan pengadaan tanah, kurangnya komunikasi antara pemerintah dan masyarakat, maka perlu penyempurnaan apa yang dimaksud kepentingan umum serta pengadaan tanah dapat berlaku adil kepada masyarakat. UUCK menyempurnakan ketentuan pengadaan tanah, terutama berkaitan dengan pengertian kepentingan umum dan pelaksanaan tahapan pengadaan tanah. Penelitian ini adalah penelitian normatif, menggunakan pendekatan konsep, analisis dan perundang-undangan. Kesimpulan dari permasalahan ini yaitu, Kepentingan umum adalah kepentingan bangsa, negara, dan masyarakat. Pasca UUCK terdapat 4 perubahan substansi yaitu konsultasi publik, penyelesaian status objek tanah, pelaksanaan langsung oleh instansi terkait untuk objek luas kurang dari 5 hektar dan jangka waktu pelaksanaan pengadaan tanah.KATA KUNCI: Pengadaan tanah, UUCK, Kepentingan The availability of land in Indonesia is indeed small compared to the needs that must be met, moreover the state in this case must pay attention to the welfare of its people by building public facilities, one of which is of course closely related to social functions. To meet the availability of land by carrying out land acquisition. Land acquisition prioritizes development interests and community interests by paying attention to justice for the community. pro contract implementation of land procurement still occurs frequently, even land procurement, lack of communication between the government and the community, so it is necessary to improve what is aimed at the public interest and land procurement can be fair to the community. The UUCK regulates land acquisition provisions, especially those relating to the definition of public interest and the implementation of land acquisition stages. This research is normative research, using conceptual, analytical and regulatory approaches. The conclusion from this problem is, the public interest is the interest of the nation, state and society. Abstract

BPJS is an entity that functions as the organizer of social security programs, structured as a public legal entity. Any policy issued by the Government is not always smooth or free from obstacles as desired by the Law. The current issue faced by BPJS is related to the outstanding BPJS contributions from employers or businesses. The purpose of this writing is to determine the position of the BPJS contribution arrears in relation to State Finance. The methodology used in this journal writing is Normative Methodology. Regarding State Finance, a fundamental aspect is the contribution from the State Budget (APBN) as stated in Law No. 17 of 2003 concerning State Finance. The connection with the arrears of BPJS Employment contributions is that when these contributions are not paid by employers or businesses, it leads to indirect losses to State Finance, because when BPJS Employment was established, the State had initial capital sourced from the APBN placed in BPJS Employment according to Law Number 24 of 2011 from the APBN. Therefore, in relation to the arrears of BPJS Employment contributions, the relevant authorities in the legal field can assist BPJS Employment in recovering State finances.
