Abstract

Pencatatan perkawinan bukan menjadi syarat sah perkawinan, tapi merupakan upaya untuk mewujudkan tertib administratif. Surat Pernyataan Tanggung Jawab Mutlak (SPTJM) yang ada pada Peraturan Menteri Dalam Negeri Nomor 9 Tahun 2016 merupakan upaya pemerintah untuk memberikan solusi terhadap masalah administrasi kependudukan, dimana masih banyak masyarakat yang tidak memiliki dokumen kependudukan. Berdasarkan kebijakan tersebut, masyarakat yang melakukan nikah di bawah tangan dapat membuat kartu keluarga dengan menggunakan SPTJM sebagai pengganti dari akta nikah. Sehingga penelitian ini bertujuan untuk mengetahui kedudukan pencatatan perkawinan setelah adanya Peraturan Menteri Dalam Negeri Nomor 9 Tahun 2016, serta akibat hukum yang timbul dari penggunaan SPTJM terhadap pasangan nikah di bawah tangan. Metode penelitian yang digunakan adalah normatif, dilakukan dengan cara meneliti bahan pustaka atau data sekunder ditambah dengan wawancara. Hasil penelitian yang perlu diperhatikan adalah SPTJM tidak mengesahkan terjadinya suatu perkawinan, melainkan hanya mempercepat proses pendataan administrasi kependudukan pada Dinas Kependudukan dan Catatan Sipil. Maka dari itu, pencatatan perkawinan penting agar masyarakat memiliki kepastian hukum atas status perkawinan mereka.

Abstract

Tourism village management plays a pivotal role in advancing sustainable development, particularly in rural areas endowed with rich biodiversity and natural resource potential. Ecological justice, which underscores equitable access to natural resources and shared responsibility in maintaining ecosystem balance, is a critical concept for ensuring sustainability in tourism village management. This study investigates the integration of ecological justice into tourism village management and examines the challenges and opportunities associated with its implementation. Utilizing a qualitative approach, the research explores strategies and policies that promote environmental sustainability while enhancing the welfare of local communities. The findings reveal that participatory approaches, environmental education, and policies rooted in local wisdom are essential for achieving ecological justice. The novelty of this study lies in its focus on ecological justice as a comprehensive framework that transcends economic considerations to incorporate ecological and social equilibrium. By proposing a model for sustainable tourism village management, this research contributes to the discourse on sustainable development, providing practical insights for policymakers and stakeholders in achieving long-term environmental and community welfare objectives.

Abstract

This study is expected to provide new contributions to the study of inheritance law, especially by highlighting how Muhammadiyah members respond to legal pluralism in Indonesia. This study can help explain how this modernist Islamic organization negotiates the inheritance law amidst the diversity of legal systems in force in Indonesia. This research used the non-doctrinal research method. The harmonization of inheritance wealth division in the Javanese society, especially in Jatinom, which is mostly affiliated with the Muhammadiyah organization, reflects an integration between local wisdom and religious teachings based on the maslahah principle. The wealth division before or after the decedent’s death aims to maintain family welfare, prevent conflicts, as well as guarantee the fulfilment of heirs’ rights. This practice is not only valid according to the Sharia but is also just and flexible, as it is adapted to the actual needs of the family. This is to create a harmony that pays attention to the family’s worldly and spiritual needs.
