Abstract

The principles of equality of control rights and utilization of land rights, to become plantations which are a source of prosperity for all Indonesian people. to obtain a right to land which gives a mandate to the state to maintain a balance with the authority given to the state in the administration, regulation, management and supervision for the purpose of maximizing the prosperity of the people, thereby ensuring the certainty of fair business opportunities for large business actors, medium and small as well as community use of land for plantations by preventing monopolistic practices.This research has a normative legal nature in the form of written positive legal provisions that are applied to legal events in concreto in society, so that in the research there is always a combination of two stages of study. The first stage, the normative approach (library research) is an approach carried out based on primary legal materials or using secondary data including principles, rules, norms and legal rules contained in laws and other regulations. The second stage is the application of in concreto events in order to achieve the predetermined goals. Obtaining data through secondary data in the form of legal and primary materials through interview techniques is carried out directly by conducting structured in-depth interviews.

Abstract

One form of wealth for the Indonesian nation is that the existence of Indigenous Law Communities (MHA) are recognized and respected as The rights of the MHA to natural resources, land, and forests have not been clearly regulated in a single legislation, but the MHA's control over customary forests is evident. Several customary forests in Kerinci Regency have been officially designated as customary forests based on the Decree of the Minister of Environment. The control of customary forests requires the recognition and affirmation of the MHA through Regional Regulations based on Law Number 41 of 1999 concerning Forestry. However, the Kerinci MHA, as the rightful owners of customary forests, have not yet received protection and recognition through Regional Regulations, which could threaten their sustainability. The research method used is empirical juridical. The research results show that customary forests in Kerinci Regency have been designated as customary forest areas or rights forests as stated in the Ministerial Decree, which recognizes the existence of the MHA as the rightful owners based on the Decree of the Regent of Kerinci. Although the Regent's Decree does not provide adequate explanations about the status, structure, and customary institutions managing the customary forests, it indirectly acknowledges the existence of the MHA entitled to the customary forests. Meanwhile, regulations on customary forest management should also be adjusted to facilitate protection mechanisms for the MHA. As the region with the most customary forests in Jambi Province, it is hoped that the Kerinci Regency Government can draft Regional Regulations concerning Indigenous Law Communities so that customary forests can be preserved and sustained for future generations.

Abstract

The rights of the Indigenous Communities to natural resources, land, and forests have not been explicitly regulated in a single legislative act, yet the control of the Indigenous Law Communities  (abbreviated as ILC) over customary forests is established. The customary forests in Kerinci Regency have been officially designated as customary forests based on the Minister of Environment and Forestry Decree, which the local ILC manages based on the Decree of the Regent of Kerinci. The control of customary forests requires recognizing and confirming the ILC through Regional Regulations  based on Law No. 41 of 1999 on Forestry. The sustainability of the ILC, as the rightful holders of customary forest rights, can be threatened if not recognized by the Regional Government. The research method employed is empirical juridical. The research findings indicate that the customary forests in Kerinci Regency have been designated as customary forest areas or proprietary forests as stipulated in the Minister of Environment and Forestry's Decree, with the recognition of each ILC right holder's existence based on the Decree of the Regent of Kerinci. Although the Regent's Decree does not adequately explain the status, structure, and customary institutions managing the customary forests, it implicitly acknowledges the existence of the ILC entitled to them. As a region with the most significant number of customary forests in Jambi Province, it is expected that the Kerinci Regency Government can draft regulations concerning the ILC.

Abstract

For the community, this conflict can result in loss of livelihoods, increased poverty rates, and divisions within the community. On the other hand, for the government, land conflicts can reduce the legitimacy and trust of the community in the authorities, especially if they are considered incapable of resolving problems fairly. Prolonged conflicts can also disrupt the investment climate, leading to development delays and slowing economic growth at the local level. Therefore, it is expected to see the extent to which the implementation of policies has been carried out by the local government regarding the transmigration land conflict in Gambut Jaya Village, and how to solve the problem for the welfare of the farming community. This research is a qualitative research, which involves the process of action to overcome problems by explaining the research object in detail and in depth. The goal is to achieve a more comprehensive understanding and make generalizations about the variables that influence a phenomenon or social reality. Implementation of Local Government Policy on Transmigration Land Conflicts in Gambut Jaya Village: Communication. All forms of efforts have been made, both formally and informally. Formally, the community has tried to the Local Government, even discussing it in the Regent's meeting room. At the beginning, it was concluded that an integrated team had been formed to measure the promised land, but because it was hampered by the regional election process, the promise was forgotten again, so that the transmigrant community returned to empty hopes. If formal efforts were unsuccessful, in the end the transmigrant community took non-formal routes, namely by taking action. Various levels of government have taken action, both from the Regent, Governor, and ATR/BPN Jambi, but it did not produce any results at all, all that was obtained was promises that were not fulfilled

Abstract

Tujuan penelitian untuk menjelaskan tentang kebijakan pemerintah terhadap status tenaga honorer dalam peraturan perundang-undangan dan implementasi dan dampak kebijakan status tenaga honorer. Kemudian metode penelitian berupa penelitian yuridis empiris dengan pendekatan perundang-undangan, pendekatan konseptual dan penegakan kasus sehingga pengumpulan bahan hukum berupa bahan hukum primer, bahan hukum sekunder dan bahan hukum tersier. Analisis bahan hukum berupa pengumpulan bahan hukum pemahaman bahan hukum interprestasi bahan hukum Analisis terhadap konflik norma dan rekomendasi untuk penyempurnaan. Adapun hasil penelitian ini yaitu kebijakan pemerintah terhadap status tenaga honorer dalam peraturan perundang-undangan adalah menghapus tenaga honorer dan mengalihkannya menjadi Pegawai Pemerintah dengan Perjanjian Kerja bertujuan menciptakan birokrasi yang profesional melalui penerapan sistem merit berbasis kualifikasi dan kinerja. Keberhasilan kebijakan ini bergantung pada konsistensi pelaksanaan regulasi, kepatuhan hukum, dan koordinasi antara pemerintah pusat dan daerah diperlukan guna menjamin kejelasan status tenaga honorer dan implementasi dan dampak kebijakan status tenaga honorer adalah meskipun kebijakan ini membawa dampak positif seperti penataan sistem kepegawaian yang lebih tertib, penyetaraan hak antara PNS dan PPPK, serta efisiensi anggaran pemerintah, implementasinya juga menimbulkan sejumlah tantangan serius, seperti meningkatnya angka pengangguran, ketidakpastian sosial bagi tenaga honorer yang telah lama mengabdi, serta risiko penyalahgunaan kekuasaan dalam proses seleksi PPPK. Oleh karena itu, diperlukan kebijakan pendukung dan pelaksanaan yang transparan, adil, serta bertahap agar transisi menuju sistem ASN yang lebih profesional dapat dilakukan tanpa mengorbankan hak dan kesejahteraan para tenaga honorer.

Abstract

Regional Spatial Planning (RTRW) serves as a guideline for policy development, including long-term regional development plans, medium-term regional development plans, industrial development plans, and investment implementation in the region Law Number 15 of 2019. The establishment of the RTRW in the form of regional regulations (PERDA) provides a strong legal basis for regional governments to direct development, maintain environmental sustainability, prevent conflicts due to overlapping land use, and support sustainable economic growth without neglecting ecological aspects, as well as creating a balance between development and environmental preservation. In an effort to achieve the goals of the state, national development is carried out by all components of the nation and in its implementation there have been two changes to the spatial planning policy of Jambi province since the enactment of Jambi provincial regulation number 9 of 1993The Jambi Province spatial planning plan is no longer in line with regional, economic, political, and environmental developments, resulting in a decline in the quality of space in the Jambi Province region. The research method used is normative juridical, namely a study that focuses on legal norms, legal principles, and legal systems related to the issues discussed. The research findings show that changes in the spatial planning of mining areas in Jambi Province are the result of a complex interaction between internal and external factors, including economic, policy, environmental, social, and the dynamics of national spatial planning law. Internal factors such as the potential for large coal resources, limited logistics infrastructure, and the need for mining infrastructure development have driven changes in the spatial structure and spatial patterns of the region. Furthermore, enforcing compliance with spatial planning is key to directing mining activities to comply with sustainability principles and applicable laws.
