Abstract

The Indonesian Constitution mandates that health must be the main thing in continuous sustainable development. Therefore, in order to create a good health law system, doctors must respect whatever the patient's choice is, because if informed consent has occurred, then the rights and obligations between the doctor and the patient arise. However, the position of informed consent becomes unclear when there is emergency treatment of patients in hospitals. The problem studied is how is the position of informed consent in emergency treatment of patients in hospitals in law in Indonesia and the United States? The research method used is normative. The results of the study show that the position of informed consent in emergency treatment of patients in hospitals in law in Indonesia and the United States is different. In the health law system in Indonesia, the position of informed consent in emergency treatment of patients in hospitals is considered given, so that doctors who perform medical actions in order to save lives or prevent disability of a person in an Emergency and/or disaster are exempt from claims for compensation. A different thing happens in the health legal system in the United States, where the position of informed consent in emergency patient care in hospitals remains very important in law, because the legal consequences if informed consent is not given, are that the medical action is considered an act of abuse (intentionally) against the patient which causes the doctor and hospital to become parties who can be held legally responsible if the patient feels disadvantaged.

Abstract

Hujan merupakan sumber utama air di tambang terbuka. Air hujan yang jatuh ke permukaan bumi umumnya ada yang langsung menuju ke badan sungai, ada juga yang masuk ke dalam tanah dan diserap oleh tumbuhan, dan ada juga yang masuk ke dalam tanah melewati sela-sela batuan dan tersimpan menjadi air bawah tanah. Karena aktivitasnya mempengaruhi bentuk topografi sehingga air hujan yang jatuh tidak sempat diserap oleh tanah dan langsung mengalir ke tempat-tempat yang rendah. Untuk mengatasi air limpasan tambang maka perlu dibuat kolam pengendapan untuk menampung air hujan sebelum dialirkan ke badan sungai. Kolam pengendapan ini memiliki pertimbangan luas dan dimensi yang sesuai agar bisa menampung air hujan yang jatuh. Untuk itu perlu dilakukan rencana kolam pengendapan untuk mengendapkan material sedimen sebelum dialirkan ke badan sungai sehingga memenuhi nilai baku mutu. Metode yang digunakan dalam penelitian ini adalah deskriptif kuantitatif, yaitu dengan mengumpulkan data primer dan data sekunder yang dapat digeneralisasikan di daerah penelitian. Berdasarkan rata-rata hujan – rata dengan periode ulang hujan selama 10 tahun maka didapat besarnya intensitas hujan adalah sebanyak 19,51mm/jam. Besarnya daerah tangkapan hujan yang dihitung dengan menggunakan ArcGis adalah sebesar 18,30Ha. Koefisien limpasan yang digunakan adalah 0,9 dengan pertimbangan permukaan daerah penelitian adalah lahan terbuka daerah tambang. Berdasarkan hasil perhitungan debit limpasan, maka diperoleh debit limpasan udara pada luas sedimen kolam Foxtrot sebesar 0,89 m 3 /jam. Luas kolam pengendapan yang akan dibuat adalah 1.105,23m 2 dengan volume sebesar 4.421m 3 . Kolam pengendapan dapat dibagi menjadi 3 kompartemen, bentuk kompartemen dibuat zigzag dengan tujuan untuk memperlambat debit aliran sehingga sedimen dalam air yang masuk ke kolam sedimen mempunyai waktu untuk mengendap. Abstract

Coronary artery perforation is a rare but potentially life-threatening complication of percutaneous coronary intervention (PCI). A 55-year-old male with a history of implanted stent on the left main ostium to the proximal left circumflex artery (LCX) and distal right coronary artery, and chronic total occlusion (CTO) on ostium left anterior descending (LAD). PCI was performed using a stiff wire to cross the CTO body in LAD. We performed an injection and confirmed the presence of extravasation. We successfully managed to stop the bleeding by placing the tips of floppy wire that were cut into pieces. A drainage pathway was made through thoracotomy for pericardial effusion. Angiography showed persisting extravasation at the wire insertion site. We then made our own covered stent. We implanted on the osteal LAD until proximal LCX. Repeated angiography showed no contrast extravasated from the perforation site, and the patient was stabilized and discharged.

Abstract

Background. Technological advances in healthcare, particularly the use of Information and Communication Technology (ICT), have led to the emergence of telemedicine, which provides remote medical and health services. This innovation has the potential to revolutionize healthcare delivery but also presents legal challenges related to its legitimacy and the protection of patient data. In Indonesia, the legal framework for telemedicine is still developing, raising questions about its legal certainty and compliance with regulations. Purpose. This study aims to analyze the legal certainty surrounding the implementation of telemedicine in technology-based health services in Indonesia, focusing on its regulatory framework and the legal protection of patient data. Method. This is a normative legal study using secondary data, analyzed descriptively. The study examines existing regulations, government policies, and case studies of telemedicine platforms in Indonesia to assess the legal status of telemedicine services. Results. The study finds that the legal certainty of telemedicine in Indonesia is not fully realized. While the theory of utilizing ICT in healthcare, such as telemedicine, is supported, practical implementation remains incomplete. Telemedicine services like Alodokter and HAlodokter exist, but their legal foundation is still lacking. The Government Regulation concerning telemedicine, mandated by Article 25, Section (5) of Law No. 17/2023 on Wellbeing, has not been issued, leaving gaps in the legal framework. Conclusion. The legal framework for telemedicine in Indonesia requires immediate development. A Government Regulation must be issued to address key issues such as business licensing, electronic signatures, doctor identity verification, and the rights and obligations of doctors and patients. This regulation will ensure that telemedicine services operate within a clear and legally secure framework.
