Abstract

Disasters can destroy but also provide opportunities and triggers to rise and be resilient. Active-preventive efforts are needed to minimize the impact of disasters through reactivating local knowledge and developing its inheritance system as a momentum for community resilience in facing crises. This study aims to determine the local wisdom that can reduce the impact of earthquake disasters both in the pre-, during and post-earthquake disasters and their inheritance systems on Lombok Island. Local wisdom in the pre-disaster cycle in disaster mitigation activities through the physical form of buildings and settlement patterns, myths and traditional ceremonies and disaster beliefs. In disaster preparedness, organizing reserves for food insecurity in barn buildings. In disaster early warning through reading natural signs and notification of events through local languages and beating objects that make sounds. Local wisdom in the cycle when a disaster occurs in disaster response through the placement of evacuation and victim assistance in the center of the berugak multifunctional building and disaster relief activities through besiru as the spirit and value of community cooperation. Local wisdom in the post-disaster cycle in disaster recovery through the determination and willingness of the community to rise to normal conditions by working hard, patiently and sincerely. Local wisdom in rehabilitation activities normalizes life through trauma healing with traditional games. The development of modernization, globalization and needs causes the existence of local wisdom to depend on the level of functionality and inheritance efforts from social communities on Lombok Island. Most of the ways of inheriting local wisdom in the context of earthquake disaster management are carried out through the local wisdom inheritance system of vertical transmission inheritance.

Abstract

This study aims to analyze the role of the Indonesian Constitutional Court in carrying out its function as a stronghold of law enforcement in Indonesia after the reform era, as well as evaluate the extent to which this institution has succeeded in protecting human rights through its decisions. Methods: This research is categorized as normative legal research with a philosophical and analytical approach. The focus is on rational, critical, and philosophical analysis of the legal issues raised. The analytical descriptive method is used to describe the applicable legislation, legal theory, and positive law enforcement practices related to the problem under study. Results: The results show that the Indonesian Constitutional Court plays an important role in upholding the Constitution and social justice with a careful and balanced approach. Key decisions such as No. 18/PUU-V/2007, No. 75/PUU-XIII/2015, and No. 102/PUU-XXI/2023 highlight the importance of legislative autonomy, legal clarity, and certainty, as well as the presumption of innocence and prudence in political intervention. The application of Aharon Barak's theory of "proportionality," Lon Fuller's "legal certainty," and Alexander Bickel's "judicial restraint" provides insight into ensuring a balance between human rights, legal certainty, and the integrity of due process.

Abstract

The evolution of e-commerce due to digital transformation has introduced new issues in consumer protection, particularly concerning the efficacy of administrative penalties against digital enterprises. The primary issue in this study pertains to the ineffectiveness of administrative sanctions as stipulated in Law Number 8 of 1999 regarding Consumer Protection (UUPK), which remains anchored in the conventional transaction paradigm and has not adequately addressed cross-border and anonymous e-commerce practices. The objective of this research is to conduct a legal analysis of the efficacy of examine administrative punishments within the digital consumer protection framework, highlight normative and institutional obstacles to its execution, and propose alternative legislative changes for responsiveness. The methodology used is normative legal research using a regulatory and conceptual framework, supplemented by a study of secondary literature. The study's findings suggest the need to revise legislative regulations and enhance institutions by creating a digital oversight authority and developing a technology-driven integrated supervisory system. This change is crucial for guaranteeing legal stability and robust protection for consumers in the digital commerce age.

Abstract

This study aims to analyze and formulate a collaboration model between the Regional Government and the Community Protection Unit (Satlinmas) in developing the Kuta Mandalika tourist destination in Central Lombok Regency, West Nusa Tenggara Province. This study uses the collaborative theoretical framework of Ansell and Gash (2008) which emphasizes face-to-face dialogue, trust-building, and shared commitment, as well as the Pentahelix approach involving five main actors: government, academics, the business world, communities, and the media. The research method used is descriptive qualitative with data collection techniques through in-depth interviews, participant observation, and documentation studies. The results show that collaboration between the regional government and Satlinmas is still sectoral and has not been optimally integrated within the Pentahelix framework. Several inhibiting factors such as lack of institutional capacity, the absence of specific regulations governing the role of Satlinmas in the tourism sector, and weak cross-sectoral coordination are the main challenges. Therefore, this study recommends strengthening regulatory-based collaborative mechanisms, training the capacity of Satlinmas in tourism services, and establishing a cross-actor communication forum as a form of real implementation of Ansell and Gash's theory and the Pentahelix approach in developing sustainable tourism in the Mandalika area.
