Abstract

This study examines the influence of education level and social status on determining the Dui Pappenre value and its implications for family finances in Bugis traditional marriages. Using a qualitative method with a case study approach, this study analyzes the financial impact of high Dui Pappenre values on the economic stability of men's families and the financial management strategies of young couples after marriage. The results show that high Dui Pappenre values impose a significant financial burden, causing decreased liquidity, increased debt, and reduced family investment capacity. Young couples implement financial management strategies, including detailed budgeting, spending priorities, systematic debt repayment efforts, and improving financial literacy. This study emphasizes the importance of a balance between preserving cultural traditions and family economic well-being and recommends constructive dialogue to adjust Dui Pappenre values to be more realistic with current economic conditions

Abstract

The factors of the region governance review of Barru regency to actualize good governance and clean government are the region the government have not applied the equity properly and optimally, uphold the rule of law, worked effectively, effectiveness, and accountability, and formulated and implemented the strategic vision. This study is expected to explain, find, and describe the regional governance review in Barru Regency to actualize for good governance and clean government in the implementation of regional autonomy.

Abstract

This study examines the performance of Intelligence and Security Unit of Pare-pare Police Resort in anticipating potential security threats during the 2024 Regional Elections using the early detection strategy in order to figure out the effectiveness of the strategy and its suitability with applicable provisions. Utilising both normative and empirical approach, this study analyses the laws and regulations using field observations. The findings of this research shows that the Intelligence and Security Unit has implemented a comprehensive strategy following applicable laws and regulations but it still faces challenges in the digital era. Increasing the capacity of big data analysis, social media monitoring, and information-sharing mechanisms among institutions are needed to anticipate security disturbances in the future election. This strategy has the potential to be a model for other regions in Indonesia, although it still requires continuous improvement and adaptation of technology.

Abstract

The evolution of e-commerce due to digital transformation has introduced new issues in consumer protection, particularly concerning the efficacy of administrative penalties against digital enterprises. The primary issue in this study pertains to the ineffectiveness of administrative sanctions as stipulated in Law Number 8 of 1999 regarding Consumer Protection (UUPK), which remains anchored in the conventional transaction paradigm and has not adequately addressed cross-border and anonymous e-commerce practices. The objective of this research is to conduct a legal analysis of the efficacy of examine administrative punishments within the digital consumer protection framework, highlight normative and institutional obstacles to its execution, and propose alternative legislative changes for responsiveness. The methodology used is normative legal research using a regulatory and conceptual framework, supplemented by a study of secondary literature. The study's findings suggest the need to revise legislative regulations and enhance institutions by creating a digital oversight authority and developing a technology-driven integrated supervisory system. This change is crucial for guaranteeing legal stability and robust protection for consumers in the digital commerce age.

Abstract

Pelaksanaan Program Nasional Sertifikat Hak Atas Tanah di Kabupaten Barru, tujuan dari penelitian ini adalah untuk mengetahui Proses dan Tahapan Pelaksanaan Program Nasional Pertanahan Sertifikat di Kabupaten Barru. Dari penelitian ini dapat diketahui kendala-kendala yang dihadapi oleh pemerintah khususnya Badan Agraria dan Tata Ruang Badan Pertanahan Nasional Kabupaten Barru dalam mewujudkan peraturan perundang-undangan untuk mendukung tertib administrasi pertanahan. Abstract

This research aims to understand and analyze the legal aspects of breach of contract in motor vehicle financing agreements (A Case Study of Decision 6/Pdt.G.S/2022/PN Pre). This study employs a normative legal research method with a case study approach. The research findings indicate that as a legal consequence or sanction for a debtor who commits a breach of contract, they are liable to pay damages, have the agreement canceled, bear the risk transfer, and cover litigation costs. Based on the above description, it can be concluded that a breach of contract results in legal rights and obligations arising from a contractual relationship. In Indonesian law, there are two methods for resolving breach of contract disputes, namely through litigation and non-litigation pathways. Non-litigation dispute resolution involves methods like consultation, negotiation, mediation, or conciliation outside the court. In contrast, litigation is a dispute resolution process conducted in a court of law. As seen in the case of Decision 6/Pdt.G.S/2022/PN Pre, it was resolved through litigation, where the plaintiff, PT. BFI Finance Indonesia, Tbk Branch Parepare, sued Desy for alleged breach of the motor vehicle financing agreement

Abstract

Penelitian ini membahas dasar hukum, implementasi, kelemahan, dan urgensi regulasi khusus mengenai amnesti dan abolisi oleh Presiden Republik Indonesia. Penelitian menggunakan metode normatif dengan analisis dokumen hukum serta literatur terkait, menemukan bahwa ketiadaan regulasi khusus menyebabkan potensi penyalahgunaan kewenangan dan ketidakpastian hukum. Hasil penelitian menekankan pentingnya pembentukan undang-undang khusus yang mengatur parameter objektif, mekanisme pengawasan, dan keterlibatan publik guna memperkuat prinsip negara hukum dan keadilan substantif. Model regulasi baru yang dipaparkan memberikan kontribusi teoretis dan praktis terhadap pengembangan hukum tata negara di Indonesia.

Abstract

The UN's principal mission is to promote international stability and peace. To that end, the UN established the Security Council, its governing body with last say on the subject. The United States, Russia, China, and France—the five most militarily competent nations—are veto-wielding permanent members of the United Nations Security Council. The fundamental objective of this research is to determine the impact of veto power on the function of the United Nations Security Council in maintaining global peace and security. In that case, will we be attempting to have a lex expert on the right to veto? This work is classified as normative research. The results showed that the veto did not improve the Security Council's performance. The ability to veto decisions made by the Security Council on how to address critical international crises means that the council isn't always effective. Legal rules should be put in place to ensure that the right to veto as a controller is not misused and fulfils its original purpose. The power to reject a resolution in situations involving crimes against humanity or genocide is an important part of the veto system, as is the two-year limit on each non-permanent member's use of the veto, and the limitation of veto use to a single case if discussed consecutively in Security Council meetings.

Abstract

This study analyses the use of foundations as mechanisms for financial diversion and highlights the legal shortcomings in the regulation of foundations in Indonesia, leading to insufficient oversight and public accountability. Recent incidents, including the Aksi Cepat Tanggap Foundation (ACT) and the PPATK's disclosures regarding 176 philanthropic institutions, suggest that certain foundations function as front organisations to conceal or misdirect funds from unclear sources. This study utilises a normative juridical methodology, employing statutory, conceptual, and case approaches. It focusses on examining Law Number 28 of 2004 concerning Foundations, its derivative laws, and the management practices of social funds in charitable organisations. The findings of the study reveal that foundation supervision in Indonesia is insufficient, as the supervisory body provides guidance without audit authority, and external oversight by the Ministry of Law and Human Rights and the Ministry of Social Affairs is restricted to administrative functions lacking substantive audits. Agency fragmentation, insufficient consequences, and the lack of public disclosure requirements increase the likelihood of legal form misuse. The supervisory system necessitates reform via the alteration of foundational rules, the implementation of digital public audits, and the strengthening of fiduciary obligations and good governance principles within positive law. This research highlights the necessity of integrating legal standards with social norms to establish governance defined by transparency, accountability, and integrity, thereby restoring public trust in non-profit organisations in Indonesia
