Abstract

Artikel ini bertujuan untuk membantu pembaca memahami crowdfunding efek dan potensinya sebagai pengganti perdagangan saham tradisional untuk usaha kecil, menengah, dan besar (UMKM). Jenis penelitian ini adalah kualitatif-deskriptif melalui metode kepustakaan. Pasca Pandemi COVID-19, pemerintah berusaha meningkatkan perekonomian masyarakat secara umum. Mayoritas penduduk Indonesia beragama Islam, yang berarti mayoritas pemilik UMKM juga beragama Islam. UMKM membutuhkan modal usaha untuk membiayai operasinya. Scurities crowfunding syari’ah atau urun dana sekuritas syariah menjadi salah satu opsi pendanaan alternatif yang tersedia bagi UMKM untuk digunakan sebagai startup atau dalam proyek-proyek pembangunan ekonomi nasional. Urun dana efek merupakan metode alternatif berinvestasi melalui platform online bagi para investor dan pemilik usaha (UMKM) yang memiliki rasa tanggung jawab etis (ta'awun) yang tinggi. Urun dana efek yang sesuai dengan syariah harus mematuhi hukum Islam berdasarkan Al Qur'an dan Sunnah. Kegiatan tersebut harus sesuai dengan Dewan Pengawas Syariah (DPS) dan mematuhi PJOK Nomor 57/POJK.04/2020 tentang Penawaran efek melalui layanan urun dana berbasis teknologi informasi dan DSN-MUI Nomor 140/DSN-MUI/VIII/2021 tentang Penawaran efek syariah melalui layanan urun dana berbasis teknologi informasi. Potensi crowdfunding syari'ah sebagai alternatif pendanaan investasi cukup besar bagi UMKM. Hal ini diharapkan dapat memperkuat UMKM dan memperkuat usaha-usaha bisnis muslim sehingga dapat meningkatkan pertumbuhan ekonomi nasional.

Abstract

This study examines the comparison of authority between the Judicial Commission of the Republic of Indonesia (KY) and the Consiglio Superiore della Magistratura (CSM) of Italy in maintaining judicial independence and accountability. KY is primarily responsible for overseeing the ethics and conduct of judges and proposing the appointment of Supreme Court justices. However, its authority is limited, as the final decision regarding disciplinary sanctions against judges remains with the Supreme Court. In contrast, the CSM of Italy holds broader powers, including the appointment, promotion, transfer, and disciplinary actions of judges, making it more effective in ensuring an independent and accountable judiciary. This study employs normative legal research with a comparative approach, analyzing primary data in the form of legislation and court decisions, as well as secondary data from legal literature and journals. The findings indicate that the CSM system is more effective in safeguarding judicial independence and accountability than KY Indonesia. Therefore, Indonesia can learn from the CSM's practices to strengthen KY's role and authority in enhancing the integrity and independence of the judiciary in Indonesia.

Abstract

The employee turnover rate in a company is a separate problem that is considered very important to be addressed by a company. There are many factors that cause employee turnover. The higher the employee turnover rate, the lower the effectiveness and efficiency that occurs in an organization. In this study, leadership factors, work environment and performance are the main factors that will be observed. Based on observations that in this company, namely PT. Automobil Jaya Mandiri, there is a fairly high employee turnover rate every month. This is especially true in the sales department where there is often a very significant employee turnover every month. Leadership in this company is felt to need to be evaluated. A fairly good work environment also requires several evaluations to reduce employee turnover. Good performance evaluation is essential to reduce employee turnover.
