Abstract

The reinsertion of the People's Consultative Assembly Decree (Tap MPR) into the hierarchical system of Indonesian statutory regulations through Law Number 12 of 2011 concerning the Formation of Legislative Regulations, has caused several problems, namely: 1) The position of the MPR Tap in the hierarchy of statutory regulations. Invitation; and 2) Which state institution should be given the authority to test the MPR Decree. The research results show that the position of the MPR Decree in the hierarchy of laws and regulations in Indonesia is in a "grey" position because after the amendment to Article 3 of the 1945 Constitution, the MPR no longer has the authority to form Decrees containing regulations that come into force. Where initially the Decree was a second-degree statutory regulation, but after the amendment to the 1945 Constitution, the Decree could no longer be issued as a statutory regulation. Meanwhile, in terms of the authority to review the MPR Decree, the authority for such review can be given to the Constitutional Court. If this has to be done, it can be done by making changes to the limitative formulation in the 1945 Constitution. This change could be in the form of adding the authority to review the MPR Decree on the 1945 Constitution by the Constitutional Court through legislative interpretation and/or judicial interpretation.Keywords: Hierarchy, Position of Tap MPR, Laws and Regulations.

Abstract

The causes of drug abuse among teenagers are due to internal factors and external factors. Internal factors, namely factors that come from a person, where the internal factors themselves consist of personality factors, family factors and economic factors. While external factors, namely factors that come from outside a person or teenager that affect the occurrence of drug abuse. External factors themselves consist of social factors and environmental factors. The objectives to be achieved from this service activity are to provide basic knowledge about the prevention of drug abuse practices among adolescents, especially in Pekanbaru City and provide an explanation of how dangerous drug abuse is for health and the legal sanctions that will be received. The method used in this service consists of three stages, namely the Preparation Stage, Implementation Stage and Evaluation Stage, while the conclusions resulting from this activity are that the partner community who at first before the counseling activities were carried out did not know in detail about the impact caused by drug abuse and the legal sanctions that would be received, after participating in the counseling, the partner community became aware and understood that the impact caused by drug abuse is very extraordinary and the threat of punishment that will be received due to drug abuse is also quite severe, so that the partner community feels that they must be more vigilant so that drug abuse does not occur, especially in the SMK Perbankan Riau

Abstract

Upaya pencegahan terhadap tindak kekerasan terhadap perempuan dapat dilakukan dengan beberapa cara, yaitu: 1) promotif dan 2) preventif (tindakan preventif dapat dilakukan dengan tiga cara: yaitu a) kampanye anti kekerasan terhadap perempuan; b) penyuluhan tentang pencegahan kekerasan terhadap perempuan dan c) pendidikan dan pelatihan). Adapun tujuan yang ingin dicapai dari kegiatan Pengabdian ini untuk memberikan pemahaman tentang perlindungan hukum terhadap perempuan dalam konteks hukum di Indonesia, dan memberikan penjelasan tentang pencegahan tindak pidana kekerasan terhadap perempuan, khususnya di Kota Pekanbaru. Metode yang digunakan dalam pengabdian ini terdiri dari tiga tahapan yaitu Tahap Persiapan, Tahap Pelaksanaan dan Tahap Evaluasi, sementara kesimpulan yang dihasilkan dari kegiatan ini adalah bahwa mitra yang pada mulanya sebelum dilakukan kegiatan penyuluhan belum mengetahui secara rinci mengenai dasar hukum perlindungan hukum terhadap perempuan serta tindakan pencegahan agar tidak terjadi tindak pidana kekerasan terhadap perempuan, setelah mengikuti penyuluhan tersebut, mitra menjadi tahu dan paham bahwa sebenarnya dasar hukum perlindungan hukum terhadap perempuan sudah termuat di dalam UUD 1945 dan bahkan di kongres PBB tahun 1994, selain itu juga mitra menjadi tahu tindakan pencegahan yang dapat dilakukan agar tidak terjadi tindak pidana kekerasan terhadap perempuan khususnya di Kota Pekanbaru

Abstract

The supervisory function of the Judicial Commission at that time was met with a lot of resistance from judges, which eventually led to the submission of a judicial review of Law No. 22/2004 on the Judicial Commission to the Constitutional Court, which the Constitutional Court granted. With the granting of the judicial review petition, the Judicial Commission's supervisory function over judges ceased to exist. This raises the question of whether the judges will be able to carry out their duties fairly without external supervision. Purpose Study: Can these judges still carry out their duties fairly without external supervision? If so, then what is the role of these dignified judges within the scope of judicial power in Indonesia? This article uses normative legal research that analyzes relevant secondary data related to the role of dignified judges within the scope of judicial power. This research concludes that a dignified judge is a judge who works professionally based on ethical integrity, moral integrity and intellectual integrity. In order for this to be done, it is necessary to have supervision, both internally and externally. This research shows that there are still many judicial mafias in Indonesia, one of which comes from the judges themselves. this shows that there are still judges who do not work professionally by ignoring ethical and moral values so that many decisions are made that harm justice in society
