Abstract

Legal effort constitutes protected right by the law aimed to seek the truth and justice. Legal effort consist of the First Instance Court, Appeal, Supreme Court Appeal, and Cotemplation Review to the Supreme Court. By the existence of decision number 34/PUU-XI/2013 born phenomenon related to how the legal guarantee of the parties. Antasari Azhar’s caserelated to Contemplation Review to Supreme Court and Supreme Court decided to refuse that Comtemplation Review. The Supreme Court should be the final decision, but by the Contitutional Court’s decision ring about problem about the legal assurance on the Contemplation Review. The aims of this research are to seek the basic consideration of Constitutional Court in deciding the case number 34/PUU-XI/2013 and to seek the implication of the decision taken by the Constitutional Court to the principle of legal assurance and to seek the follow up of the decision number 34/PUU/XI/2013 to the Indonesian Judicature. Research used is also called normative or literature legal research. Because using the literature as a major cornerstone in conducting this research. The result of this research consist of, first: the basic consideration of Constitutional Court deciding lawsuit number 34/PUU-XI/2013 was based on sense of justice and human right. Second: implication of Constitutional Court number 34/PUU-XI/2013 to the legal assurance did not affect the void of the legal assurance as the court decision if had permanen legal power, it has legal assurance. Third: the follow up of the decision of Constitutional Court number 34/PUU-XI/2013 was that regulation formulation technically on the proposing the new proof (novum) and the space time of proposing legal effort of Contemplation Review must be made by a concrete regulation. Suggestions of the writer consist of, first: to the legislator should amend the articles existed in KUHAP which has been judicial review by Supreme Court. Second: to the legislator should make clear regulation in which kind of the new proof (novum) could be proposed to Contemplation Review more than one. Third: the proposal of Contemplation Review should be stated the limitation and space time given in order to create legal assurance, justice and usefull.Keywords : Juridical Analysis – Decision Constitutional Court - KUHAP

Abstract

Law enforcement occurred in Indonesia does not reflect the values ​​of justice expected by the public, so was born the concept of progressive law to resolve the problem. This study examines: First, the cause of law enforcement in Indonesia does not reflect the values ​​of justice; second, the role of the concept of progressive law enforcement in solving the problems that occurred in Indonesia. The results of this study concluded: First, the cause of law enforcement did not indicate the value of justice is: (i) law enforcement officers who put forward the procedural aspects, (ii) the existence of discrimination by law enforcement and (iii) the law as can be bought. Second, the role of the concept of progressive law in law enforcement in Indonesia is a progressive law concept is not just enforce the rule of law itself, but the law must be enforced are the values ​​of justice contained in the sound of formal rules and the values ​​of justice in society.

Abstract

The reinsertion of the People's Consultative Assembly Decree (Tap MPR) into the hierarchical system of Indonesian statutory regulations through Law Number 12 of 2011 concerning the Formation of Legislative Regulations, has caused several problems, namely: 1) The position of the MPR Tap in the hierarchy of statutory regulations. Invitation; and 2) Which state institution should be given the authority to test the MPR Decree. The research results show that the position of the MPR Decree in the hierarchy of laws and regulations in Indonesia is in a "grey" position because after the amendment to Article 3 of the 1945 Constitution, the MPR no longer has the authority to form Decrees containing regulations that come into force. Where initially the Decree was a second-degree statutory regulation, but after the amendment to the 1945 Constitution, the Decree could no longer be issued as a statutory regulation. Meanwhile, in terms of the authority to review the MPR Decree, the authority for such review can be given to the Constitutional Court. If this has to be done, it can be done by making changes to the limitative formulation in the 1945 Constitution. This change could be in the form of adding the authority to review the MPR Decree on the 1945 Constitution by the Constitutional Court through legislative interpretation and/or judicial interpretation.Keywords: Hierarchy, Position of Tap MPR, Laws and Regulations.

Abstract

Dalam membuat suatu peraturan, khususnya peraturan yang dibuat oleh Pejabat Tata Usaha Negara, seringkali terdapat kesalahan dalam pembuatannya. Hal ini disebabkan ketidaktahuan dan kurangnya pengetahuan Pejabat Tata Usaha Negara dalam membuat suatu kebijakan berdasarkan wewenang jabatan yang melekat kepadanya. Padahal antara peraturan yang satu dengan peraturan yang lainnya terdapat perbedaan, baik itu dari segi fungsi maupun peruntukannya. Penelitian ini tergolong pada jenis penelitian hukum normatif, dimana penulis akan mengkaji dan menelaah berbagai sumber literatur, misalnya buku-buku, jurnal-jurnal, makalah-makalah, majalah, koran dan lain sebagainya yang berkaitan dengan objek penelitian. Pada penelitian ini penulis merumuskan beberapa permasalahan, antara lain: 1) Apakah perbedaan antara Peraturan Perundang-undangan, Peraturan Kebijakan dan Keputusan? 2) Asas dan norma hukum apa saja yang dapat digunakan dalam pembuatan Peraturan Perundang-undangan, Peraturan Kebijakan dan Keputusan? Hasil penelitian menunjukan bahwa Pertama, perbedaan antara peraturan perundang-undangan, peraturan Kebijakan, dan keputusan adalah jika dilihat pada materi muatannya, maka pada peraturan perundang-undangan materi muatannya itu bersifat mendasar dimana ditujukan untuk warga masyarakat, pada peraturan kebijakan itu materi muatannya lebih ditujukan kepada suatu organ pemerintahan lain yang berada dibawahnya ataupun berada pada tingkatan yang sama, sedangkan materi muatan pada keputusan itu biasanya bersifat konkret dan individual (tidak ditujukan untuk umum). Kedua, asas dan norma hukum administrasi negara yang dapat digunakan dalam pembuatan peraturan perundang-undangan, peraturan Kebijakan, dan keputusan adalah; 1) asas negara hukum dan demokrasi, 2) asas kedaulatan dan kekuasaan atau kewenangan publik, 3) asas opportunitas, 4) asas het vermoeden van rechtmatigheid atau asas pre sumtio justae causae, 5) asas perubahan, pencabutan dan pembatalan keputusan tata usaha negara, 6) asas jabatan, 7) asas netralitas dalam pembuatan keputusan, 8) asas larangan menyalahgunakan kewenangan.

Abstract

The 2024 simultaneous elections mark a significant milestone as they combine the selection of the President, Vice President, Legislative Members, and Regional Heads for enhanced effectiveness and efficiency. However, this innovative approach also presents a host of challenges. This article employs a normative legal research methodology, utilizing both statutory and conceptual frameworks. Data collection involved a comprehensive literature review of relevant laws and regulations pertaining to elections. The findings of this study reveal that the democratic process of simultaneous elections is far from flawless. Instances of power abuse by the DPR and prevalent money politics practices continue to persist. Such misconduct occurs among participants, organizers, and voters, ultimately undermining the intended goals of enhancing democracy and upholding human rights values through the implementation of simultaneous elections.

Abstract

The causes of drug abuse among teenagers are due to internal factors and external factors. Internal factors, namely factors that come from a person, where the internal factors themselves consist of personality factors, family factors and economic factors. While external factors, namely factors that come from outside a person or teenager that affect the occurrence of drug abuse. External factors themselves consist of social factors and environmental factors. The objectives to be achieved from this service activity are to provide basic knowledge about the prevention of drug abuse practices among adolescents, especially in Pekanbaru City and provide an explanation of how dangerous drug abuse is for health and the legal sanctions that will be received. The method used in this service consists of three stages, namely the Preparation Stage, Implementation Stage and Evaluation Stage, while the conclusions resulting from this activity are that the partner community who at first before the counseling activities were carried out did not know in detail about the impact caused by drug abuse and the legal sanctions that would be received, after participating in the counseling, the partner community became aware and understood that the impact caused by drug abuse is very extraordinary and the threat of punishment that will be received due to drug abuse is also quite severe, so that the partner community feels that they must be more vigilant so that drug abuse does not occur, especially in the SMK Perbankan Riau

Abstract

Upaya pencegahan terhadap tindak kekerasan terhadap perempuan dapat dilakukan dengan beberapa cara, yaitu: 1) promotif dan 2) preventif (tindakan preventif dapat dilakukan dengan tiga cara: yaitu a) kampanye anti kekerasan terhadap perempuan; b) penyuluhan tentang pencegahan kekerasan terhadap perempuan dan c) pendidikan dan pelatihan). Adapun tujuan yang ingin dicapai dari kegiatan Pengabdian ini untuk memberikan pemahaman tentang perlindungan hukum terhadap perempuan dalam konteks hukum di Indonesia, dan memberikan penjelasan tentang pencegahan tindak pidana kekerasan terhadap perempuan, khususnya di Kota Pekanbaru. Metode yang digunakan dalam pengabdian ini terdiri dari tiga tahapan yaitu Tahap Persiapan, Tahap Pelaksanaan dan Tahap Evaluasi, sementara kesimpulan yang dihasilkan dari kegiatan ini adalah bahwa mitra yang pada mulanya sebelum dilakukan kegiatan penyuluhan belum mengetahui secara rinci mengenai dasar hukum perlindungan hukum terhadap perempuan serta tindakan pencegahan agar tidak terjadi tindak pidana kekerasan terhadap perempuan, setelah mengikuti penyuluhan tersebut, mitra menjadi tahu dan paham bahwa sebenarnya dasar hukum perlindungan hukum terhadap perempuan sudah termuat di dalam UUD 1945 dan bahkan di kongres PBB tahun 1994, selain itu juga mitra menjadi tahu tindakan pencegahan yang dapat dilakukan agar tidak terjadi tindak pidana kekerasan terhadap perempuan khususnya di Kota Pekanbaru

Abstract

This study examines the emergence of the empty box phenomenon in regional elections in Indonesia and its implications for democratic principles and institutional balance. Following Constitutional Court Decision No. 100/PUU-XIII/2015, the trend of empty box candidacies has consistently increased from the 2015 to 2024 elections. Employing a normative juridical approach, this paper analyzes statutory regulations and Constitutional Court rulings to assess the democratic legitimacy and institutional equilibrium affected by uncontested elections represented by the empty box phenomenon. The findings of this study conclude that the empty box serves as a control mechanism to uphold democratic principles, fostering the development of an inclusive and competitive democracy. However, this phenomenon also poses risks of weakening governmental institutions, such as diminishing legislative oversight over the executive, increasing the potential for abuse of power, undermining governmental legitimacy, and giving rise to the threat of autocratic legalism. In addition, the victory of the empty box in regional elections leads to the necessity of conducting re-election, which ultimately imposes a financial burden on regional budgets. Ideally, such budget allocations should support regional development programs and public service delivery
