Abstract

Penelitian ini membahas Dalam konteks pembagian hukum waris ketika ahli waris meninggalkan utang, penelitian ini mengkaji tentang kepastian hukum. Proses pembagian warisan bisa jadi rumit, apalagi jika ahli waris mempunyai hutang yang harus dibayar. Menemukan hambatan hukum dan solusi untuk memastikan distribusi warisan yang adil dalam menghadapi tanggung jawab keuangan ahli waris adalah tujuan utama dari penelitian ini. Dengan mengkaji putusan pengadilan terkait serta peraturan perundang-undangan terkait, penelitian ini menerapkan metodologi hukum normatif. Temuan studi ini menunjukkan bahwa ketika utang harus dilunasi, kepastian hukum seputar pembagian warisan menjadi lebih rumit. Memprioritaskan pembayaran utang, bagaimana utang mempengaruhi klaim ahli waris atas sebagian warisan, dan akibat hukum bagi ahli waris yang bukan pihak yang berhutang hanyalah beberapa kekhawatiran yang muncul. Dengan demikian, penelitian ini memberikan kontribusi terhadap pemahaman tentang kepastian hukum dalam pembagian warisan dengan adanya hutang pewaris, sekaligus memberikan rekomendasi untuk perbaikan sistem hukum yang dapat mengakomodasi situasi ini dengan lebih adil dan efisien.

Abstract

This research analyses the implementation of judges' decisions on law enforcement of taxation crimes in Indonesia and identifies ideal criminal law policies to achieve legal certainty. The method used is normative juridical with analytical descriptive approach, which is supported by the theory of judicial power, theory of legal certainty, and theory of law enforcement. The results show that the ultimum remedium principle has not been fully applied consistently, with some serious tax offences going directly to the criminal realm even though administrative mechanisms are still possible. Conversely, some other offences are resolved administratively, even though the criminal elements have been fulfilled. This inconsistency suggests the need for uniform technical guidelines to reduce differences in legal interpretation. This research is an integration of restorative justice principles in Indonesian tax law, which allows offenders to settle tax liabilities along with penalties before being subject to criminal sanctions. This approach balances the recovery of state losses and the deterrent effect for offenders, while supporting sustainable taxpayer compliance. This research recommends the preparation of pretrial guidelines and harmonization of regulations to improve legal certainty in tax cases in Indonesia.

Abstract

Alleged malpractice cases are currently under significant scrutiny due to the biased or unclear legal regulations governing them. This is because the legal regulations governing the qualifications for malpractice are not clearly stated. This malpractice cannot be viewed from a single scientific perspective, but also from a legal perspective. The research questions addressed in this study are the forms of medical malpractice crimes and how to apply criminal liability to medical personnel who commit malpractice to achieve justice. In this study, the author uses the theory of justice and the theory of responsibility as analytical tools. The research method in this thesis is normative juridical legal research using a statute approach, case approach, conceptual approach, and analytical approach sourced from primary legal materials consisting of the 1945 Constitution of the Republic of Indonesia, the Criminal Code, the Criminal Procedure Code, Law Number 29 of 2004 concerning Medical Practice, the Indonesian Code of Medical Ethics and existing case studies, secondary legal materials consisting of books, research results, articles and tertiary legal materials from libraries, articles and websites. The results of this study conclude that the forms of medical malpractice crimes are basically acts of medical personnel committed with errors in the form of intent or negligence that are contrary to professional standards, service standards, operational procedure standards, and legal obligations and medical personnel can only be punished if proven to have committed errors in the form of intent or negligence that cause harm to patients and there is no justification or excuse. However, in law enforcement practices, the application of criminal liability to medical personnel still tends to prioritize the protection of the medical profession over the protection of patients as victims. The suggestion in this study is that the government and lawmakers need to make more specific and comprehensive regulations regarding the crime of medical malpractice in legislation, especially by providing clear boundaries regarding the differences between medical risks, medical negligence, and medical malpractice and law enforcement officials, especially investigators, prosecutors, and judges, need to apply a more substantive justice-oriented approach in handling medical malpractice cases

Abstract

  This study highlights the gap between strict regulation and the reality of court decisions, and seeks an ideal law enforcement model for individual and corporate actors. The formulation of the problem in the research in this paper is how the application of legal sanctions against perpetrators of forest burning crimes in the criminal justice system and how the ideal concept of the application of legal sanctions against perpetrators of forest burning crimes in the criminal justice system in Indonesia. The study used a normative juridical approach that emphasizes literature research. In this study used is the approach of legislation, conceptual approach, case approach, and the source of legal materials used are primary, secondary and tertiary legal materials used qualitative analysis. Based on the results of the study showed that the criminal justice system in Indonesia has formulated the threat of layered sanctions for perpetrators, both individuals and corporations, in the form of imprisonment and fines. However, in practice, the application of these sanctions still faces a number of obstacles, such as weak coordination between law enforcement agencies, evidence of intentional elements, and law enforcement against intellectual or corporate actors which is often not optimal. Therefore, a progressive and comprehensive optimization of the law is needed, including the use of scientific evidence and strict sanctions to recover environmental losses

Abstract

This research examines the legal liability of shareholders who refuse to contribute capital when a company increases its capital, potentially disrupting the company's financial stability and harming creditors and third parties. Using normative juridical research with statutory and conceptual approaches, this study analyzes the legal construction of capital contribution obligations and the forms of legal accountability. The findings indicate that the obligation to contribute capital is essentially a right that shareholders may exercise, yet under certain circumstances it may give rise to legal liability when performed in bad faith and causing harm to the company. Refusal to contribute capital not only results in share dilution but may also trigger legal accountability, including exceptions to limited liability through the piercing the corporate veil doctrine. Therefore, it is necessary to strengthen regulations in the articles of association and shareholders' agreements to prevent disputes and ensure legal certainty.

Abstract

This article analyzes the paradigm shift in the prosecution of criminal cases under the Electronic Information and Transactions Law (ITE Law), from a retributive-formal orientation toward a restorative-proportional orientation within the Indonesian criminal justice system. The urgency of this study arises from the fact that the implementation of the ITE Law has frequently generated legal issues, including multiple interpretations, the criminalization of expression, and tensions between reputation protection, freedom of expression, and legal certainty. The second amendment to the ITE Law through Law Number 1 of 2024 was explicitly motivated by the need to address interpretive ambiguities and controversies within society, while Constitutional Court Decision Number 105/PUU-XXII/2024 further narrows the interpretation of several important provisions, particularly Article 27A, Article 45 paragraph (4), Article 28 paragraph (2), and Article 45A paragraph (2). This research employs a normative juridical method using statutory, conceptual, case-based, and limited comparative approaches grounded in the principle of restorative justice. The research findings indicate that the prosecution of ITE Law cases can no longer be interpreted merely as the transfer of cases to court after the fulfillment of formal legal elements; rather, it constitutes a substantive selection process that considers victims’ interests, loss recovery, proportionality, social impact, and the protection of constitutional rights. This article contributes by formulating a limited restorative prosecution model for ITE Law cases, namely by providing opportunities for the termination of prosecution based on reconciliation only in cases with interpersonal characteristics, where no serious public harm arises and where the requirements of Prosecutor’s Regulation Number 15 of 2020 are fulfilled.

Abstract

State-Owned Enterprises (SOE) cannot be separated from the role of the board of directors. However, decisions made by directors in good faith and with due care are frequently drawn into the realm of criminal law whenever state financial losses occur. In fact, losses in the business context do not necessarily constitute negligence or abuse of authority as stipulated under the Anti-Corruption Law, but may instead result from ordinary business risks or business losses. In this context, the Business Judgment Rule (BJR) doctrine emerges as a form of legal protection for directors, aimed at preventing the criminalization of bona fide business decisions. This research aims to examine the form of criminal liability of BUMN directors in corruption cases in Indonesia and to analyze the extent of legal certainty in the application of the Business Judgment Rule doctrine to decisions made by BUMN directors in corruption cases. The research employs a normative juridical legal research method. It applies several approaches, namely the statutory approach, conceptual approach, comparative approach, and case approach. The findings indicate that in the application of the Business Judgment Rule doctrine to decisions made by BUMN directors in corruption cases, directors’ decisions should not be subject to legal challenge, as the governance of BUMN corporate organs remains governed by the Company Law and the State-Owned Enterprises Law. Consequently, state losses arising from directors’ business decisions cannot be attributed to personal criminal liability. If shareholders—represented by the state—consider themselves to have suffered losses, legal remedies may be pursued through civil litigation by filing a claim before the court. As a recommendation, this study emphasizes the need for comprehensive regulations governing the application of the Business Judgment Rule doctrine in practice, in order to minimize disparities in judicial decisions and to ensure legal certainty for directors in their efforts to generate value and benefits for the corporation

Abstract

Financing the placement of Indonesian Migrant Workers (PMI) abroad still faces the problem of unclear schemes, cost transparency, and potential losses for PMI. The existence of legal certainty in financing that is fair, transparent, and guarantees the protection of PMI rights in accordance with laws and regulations. The legal norm has not been fully implemented consistently in the field, so a study is needed on the legal certainty of financing in order to realize the placement of PMI that is fair and protected. The method used in this study is normative legal research conducted as an effort to obtain the necessary data in connection with the problem. Data used with secondary data and tertiary legal materials. In addition, primary data is also used as supporting secondary data legal materials. For data analysts conducted by the method of qualitative juridical analysis. The results of the study that the arrangement of financing the placement of Indonesian Migrant Workers (PMI) has actually been regulated comprehensively in law No. 18 of 2017 and its Implementing Regulations, but the legal certainty is not optimal due to regulatory inconsistency, weak implementation of cost transparency, and ineffective implementation of zero cost policy and the principle of Employer Pays, especially in destination countries such as Saudi Arabia, Malaysia, and Singapore. Therefore, it is necessary to strengthen legal certainty through harmonization and codification of financing regulations, affirmation of transparent and binding Employer Pays principles, integrated digital supervision, and strengthening law enforcement through cross-agency coordination such as BP2MI, the Ministry of manpower, the Indonesian National Police, the Attorney General's Office of the Republic of Indonesia, and the Financial Services Authority
