Abstract

Abstrak Pendaftaran merek merupakan aspek yang sangat penting dalam melindungi kekayaan intelektual, khususnya bagi pelaku Usaha Mikro, Kecil, dan Menengah (UMKM) di sektor batik, yang menghadapi tantangan persaingan pasar dan risiko pelanggaran merek. Penelitian ini bertujuan untuk menganalisis urgensi pendaftaran merek bagi pelaku batik UMKM di Kota Surakarta sebagai upaya melindungi produk, meningkatkan daya saing, dan menciptakan kepercayaan konsumen. Metode penelitian yang digunakan adalah pendekatan yuridis normatif dengan data primer dari wawancara dan data sekunder berupa dokumen hukum. Hasil penelitian menunjukkan bahwa tingkat kesadaran pelaku UMKM batik terhadap pentingnya pendaftaran merek masih rendah, meskipun manfaatnya signifikan, seperti mencegah pemalsuan merek batik dan memperkuat identitas produk di pasar nasional maupun internasional. Hambatan utama meliputi kurangnya kesadaran pelaku UMKM tentang merek, mahalnya biaya pendaftaran serta kurangnya sosialisasi dari Dinas Koperasi, UMK dan Perindustrian Kota Surakarta. Oleh karena itu, diperlukan adanya edukasi dan sosialisasi serta dukungan pemerintah, termasuk fasilitasi merek gratis agar mendorong pelaku UMKM Kampung Batik Laweyan Kota Surakarta untuk mendaftarkan merek dagangnya serta memberikan perlindungan hukum demi keberlanjutan usaha mereka. Abstract Trademark registration is a very important aspect in protecting intellectual property, especially for Micro, Small, and Medium Enterprises (SMEs) in the batik sector, which face the challenges of market competition and the risk of trademark infringement. This study aims to analyze the urgency of trademark registration for batik SMEs in Surakarta City as an effort to protect products, increase competitiveness, and create consumer confidence. The research method used is a normative juridical approach with primary data from interviews and secondary data in the form of legal documents. The results show that the level of awareness of batik SME players of the importance of trademark registration is still low, although the benefits are significant, such as preventing counterfeiting of batik brands and strengthening product identity in national and international markets. The main obstacles include the lack of awareness of SME players about trademarks, the high cost of registration and the lack of socialization from the Surakarta City Cooperative, SME, Industry Office. Therefore, there is a need for education and socialization as well as government support, including free trademark facilitation in order to encourage SME players of Kampung Batik Laweyan Surakarta to register their trademarks and provide legal protection for the sustainability of their businesses. Abstract

Royalty payments for songwriters are very important to protect economic rights and maintain the ecosystem of the Indonesian Music Industry. But in its implementation, payment of song royalties is often ignored by Singers and Event Organizers. For example, in the case of copyright infringement experienced by Ari Bias who claimed to have never received royalty payments for the use of the song “Bilang Saja” sung by Agnes Monica for 20 years. This case reflects the weak legal protection of the economic rights of songwriters in Indonesia, especially in the distribution of royalties from Performers and National Collective Management Institutions (LMKN). This research uses a normative juridical method with a statutory approach and literature study, and uses secondary data as material for analysis. The results showed that although Law Number 28 of 2014 concerning Copyright has clearly regulated the payment of royalties to songwriters, its implementation has not been running optimally. Lack of awareness from Singers and Concert Organizers, not allocated budget for Performers to pay royalties to Songwriters and weak law enforcement are the main challenges. It is necessary to strengthen the royalty distribution mechanism, the active role of the state and the awareness of the Performers in guaranteeing the economic rights of Songwriters. This study is expected to contribute to the renewal of the copyright protection system in Indonesia.

Abstract

Music concerts as a form of public performance often use copyrighted works in the form of songs produced by creators. Law Number 28 of 2014 concerning Copyright and Government Regulation Number 56 of 2021 have explicitly regulated the obligation of every party that uses songs or music for commercial purposes to pay royalties to creators, copyright holders, and neighboring rights owners. Event organizers are responsible for ensuring that every song used in a concert has obtained permission from the creator or rights holder through a royalty payment mechanism. However, in practice, many event organizers still ignore this obligation, resulting in violations of the economic rights of songwriters. This study uses a normative juridical method with a legislative and literature study approach, as well as secondary data for analysis. The results of the study show that although Law Number 28 of 2014, Government Regulation Number 56 of 2021, Decree of the Minister of Law and Human Rights of the Republic of Indonesia Number: HKI.2.OT.03.01.02 of 2016, and LMKN Decree Number: 20150512KM/LMKN -Pleno/Tarif Royalti/2016 clearly regulate the payment of royalties to songwriters, their implementation has not been maximally effective. Lack of legal awareness, production cost considerations, minimal supervision and law enforcement, the assumption that royalties are already included in artists' payments, and administrative processes that are considered difficult pose challenges to royalty payments. Therefore, it is necessary to strengthen law enforcement, increase awareness, and promote collaboration between the government, LMKN, and entertainment industry players so that royalty payments can run smoothly
