Abstract

The rule on dividing joint property and wealth between a husband and a wife is based on the customary law (‘urf) which divides half of those wealth for each. This rule is also determined in UU No 1/1974 (Code of Mariage). Actually, ‘urf is only a kind of consideration in defining the law and that should not be opposed to any rules.

Abstract

This study aimed to explore the efforts that Muslim families can take to prevent digital age risks and make education a tool of child protection in the digital age. This research used a literature research approach or literature study primarily on literature published within the last seven years. This research delineates six key findings: (1) the critical role of integrating Islamic values in education to navigate digital challenges, (2) the necessity of wise parental supervision in monitoring children's digital engagement, (3) the importance of educating children on digital security, (4) the challenges inherent in maintaining online safety for children, (5) the imperative of collaboration between parents and educators in digital age child protection, and (6) the centrality of education and digital literacy for both parents and children as foundational to child protection strategies in the digital landscape. The results are expected to guide Muslim families, educators, and other stakeholders on how education can be an effective protection tool for children in this digital age. By combining religious values, wise education, and the active role of parents, Muslim families can best protect their children in this rapidly evolving digital world.

Abstract

This article explores the underlying factors contributing to early divorce in the city of Tasikmalaya, with a specific focus on couples who ended their marriages within the first five years. The aim of this study is to identify and analyze the main triggers of early divorce based on the perspectives of individuals who have directly experienced it. The research employs a qualitative method through in-depth interviews with three participants who went through early divorce. In addition, a literature review of academic and religious references supports the findings. The results indicate that early divorce is generally caused by couples’ unpreparedness in facing the challenges of married life, a lack of understanding regarding marital roles and responsibilities, poor communication, and financial pressures. A significant factor is the absence of sufficient knowledge, emotional maturity, and readiness prior to marriage, which increases the vulnerability to conflicts in the early years of marriage. This issue is often exacerbated by societal tendencies to prioritize the ceremonial aspects of weddings over the substantive preparation for family life. While Islam permits divorce under certain conditions, it remains an act that is disliked by Allah SWT. Therefore, to prevent early divorce, it is crucial to strengthen the foundations of marriage through comprehensive premarital education—emotionally, spiritually, and financially—in order to build a harmonious and resilient family characterized by sakinah, mawaddah, and rahmah.

Abstract

The concept of gender justice is often understood from contradictory perspectives. In religion, this issue is notably found in the division of inheritance rights. The interpretation of gender justice in inheritance is polarized between textual and contextual patterns, with approaches that are difficult to reconcile. This paper aims to construct a new meaning of gender justice in inheritance. This theme is examined through qualitative research, literature review design, and analysis based on theories of justice and equality. The research results conclude that the reinterpretation of gender justice in inheritance distribution is implicitly contained. Although there is gender inequality in inheritance distribution, this inequality demonstrates justice. The implications of this research are expected to provide an understanding that equality is not synonymous with justice, so when the distribution of inheritance between men and women is unequal, it does not necessarily mean it is unfair.

Abstract

Abstrak: Memperoleh pendidikan merupakan salah satu hak anak. Pada masa pandemi Covid-19, proses pembelajaran di sekolah dilakukan secara daring (online). Dalam proses ini, terjadi beberapa kasus kekerasan terhadap anak. Oleh karena itu, penelitian ini bertujuan untuk mengetahui bagaimana pemenuhan hak-hak pendidikan anak dan bagaimana perlindungan anak dari tindak kekerasan pada masa pandemi Covid-19 dalam perspektif Undang-Undang Nomor 23 Tahun 2002 tentang Perlindungan Anak, khususnya pasal 50 dan 54. Metode yang digunakan dalam penelitian ini adalah metode deskriptif dengan pendekatan kuantitatif. Pengumpulan data dilakukan dengan cara penyebaran angket melalui google form, yang disebarkan via whatsapp. Subjek yang digunakan pada penelitian ini adalah orang tua siswa Sekolah Dasar/Madrasah Ibtidaiyah Kota dan Kabupaten Tasikmalaya dengan mengambil 227 responden. Hasil penelitian menunjukkan bahwa pemenuhan hak-hak anak dalam bidang pendidikan pada masa pandemi Covid-19, pada jenjang pendidikan SD/MI di Kota dan Kabupaten Tasikmalaya, sangat baik dengan perolehan nilai rata-rata yang termasuk kategori sangat tinggi. Namun, perlindungan anak dari tindakan kekerasan, baik fisik maupun psikis, belum sepenuhnya terpenuhi. Meskipun dengan jumlah kasus yang tidak terkategori tinggi, tindakan kekerasan terhadap anak dalam bentuk apapun, merupakan sesuatu yang tidak dibenarkan dan harus dicegah. Abstract: Obtaining education is one of the rights of children. During the Covid-19 pandemic, the learning process in schools was carried out online. In this process, several cases of violence against children occurred. Therefore, this study aims to find out how to fulfill children's education rights and how to protect children from violence during the Covid-19 pandemic in the perspective of Law Number 23 of 2002 concerning Child Protection, particularly articles 50 and 54. The method used is used in this research is a descriptive method with a quantitative approach. Data collection was carried out by distributing questionnaires via a google form, which was distributed via WhatsApp. The subjects used in this study were the parents of students of the Elementary School / Madrasah Ibtidaiyah Kota and Tasikmalaya Regency by taking 227 respondents. The results showed that the fulfillment of children's rights in the education sector during the Covid-19 pandemic, at the SD / MI education level in the City and District of Tasikmalaya, was very good with the acquisition of an average score which was in the very high category. However, child protection from acts of violence, both physical and psychological, has not been fully fulfilled. Even with the number of cases that are not categorized as high, acts of violence against children in any form are something that is not justified and must be prevented.

Abstract

This study aims to explore the anti-corruption values in Surah Al-Fatihah and its implications for national education. Surah Al-Fatihah contains moral principles, such as honesty, integrity, justice, and trustworthiness, which can be the basis for character education in efforts to prevent corruption. This study uses a library research method by analyzing the interpretation of Al-Fatihah and literature related to anti-corruption education and Islamic values in the education system. The analysis is carried out through a textual and contextual approach to explore the meaning of Al-Fatihah verses and their relevance to the formation of individual characters with integrity. The results of the study show that the values in Surah Al-Fatihah can be integrated in education through the Islamic Religious Education (PAI) and Civic Education (PKn) curriculum. Case-based learning strategies and the creation of an integrity school ecosystem can also strengthen anti-corruption awareness from an early age.

Abstract

This study aims to find a method of Islamic parenting styles, as an effort to prevent violence against children in schools. With the literature study method, verses from the Quran and Hadith are studied to obtain a formulation of Islamic parenting in Islamic families. The formulation is then applied as an effort to protect children in the school environment. The research found that parenting in Islamic families is carried out as early as possible before a child is born. The parenting style not only includes physical and intellectual aspects, but also includes emotional and spiritual aspects. The verses of the Quran and Hadith hint at the values of education in the Islamic family which include aspects of “aqidah”, worship, and morals. The Quran also mentions that parenting should be done by giving role model and teaching wisdom to children. These educational values can shape children into a piety person, has the nature of “ihsan” and “istiqomah” and far from any violence attitudes. Children are also educated to not only be individual children, but also to have concern for others. With comprehensive aspects of education through Islamic parenting in Islamic families, children are educated to become individuals of character and noble character. Thus, acts of violence against children in schools can be prevented.
