Abstract

Trademark Disputes are disagreements about the use of trademarks by two business entities and involve related government agencies as co-defendants. In case number 705 K/Pdt.Sus-HKI/2023, where the Plaintiff is Benny Sujono and the Defendant is Ruben Samuel Onsu, it is known that both parties hold different certificates registered under the trademark 'Bensu' for similar goods, causing public confusion and various other damages. The research method used by the author is descriptive, with a juridical-normative approach. The data used is sourced from laws and other national regulations related to trademarks. Additionally, the study utilizes Commercial Court Decisions and Supreme Court Cassation Rulings, as well as other supporting literature. The results of the study show that Indonesian positive law stipulates that the first registrant is the party entitled to the trademark (first to file) with all its legal protections. Based on the decision number 705 K/Pdt.Sus-HKI/2023, the cassation appeal by the appellant was rejected by the Supreme Court, making the Commercial Court's decision correct, without error, and legally binding. Thus, the use of the 'Bensu' trademark, according to the court's decision, belongs to the defendant. Sengketa merek merupakan sebuah perselisihan tentang penggunaan merek oleh dua pelaku usaha dan menyertakan instansi pemerintahan terkait sebagai turut tergugat.Dalam perkaranomor 705 K/Pdt.Sus-HKI/2023 antara Penggugat yaitu Benny Sujono dan Tergugat yaitu Ruben Samuel Onsu,diketahui bahwa keduanya memiliki sertifikat berbeda yang terdaftar sebagaimerek dagang “Bensu” untuk barang sejenis,yang mengakibatkan kebingungan pada masyarakat serta banyak kerugian lainnya.Metode penelitian yang penulis gunakan bersifat deskriptif, dengan tipe yuridis – normatif.Data yang digunakan bersumber pada Undang – Undang dan Peraturan Negara lainnya terkait merek.Selain itu menggunakan Putusan Pengadilan Niaga dan Putusan Kasasi Mahkamah Agung.serta literatur pendukung lainnya. Dari hasil penelitian diketahui Hukum positif Indonesia menjelaskan bahwa pendaftar pertama merupakan pihak yang berhak atas merek (first to file) dengan segala perlindungan hukumnya. Berdasarkan putusan nomor 705 K/Pdt.Sus-HKI/2023, permohonan kasasi yang dilakukan pemohon kasasi ditolak oleh Mahkamah Agung sehingga menjadikan putusan pengadilan niaga merupakan putusan yang benar tanpa kekeliruan dan berkekuatan hukum tetap. Dengan demikian penggunaan merek “Bensu” sesuai dengan putusan pengadilan milik tergugat.

Abstract

The introduction above shows that this study has the aim of comprehensively analyzing from a progressive legal perspective in the case of copyright infringement of Ari Bias Versus Agnez Mo. This research is a qualitative study with a descriptive approach, namely an approach that has special characteristics, namely using descriptive sentences in explaining one by one the main topics used in this study. Abstract

Copyright is an essential instrument within the Intellectual Property Rights (IPR) system, providing legal protection for works of art, literature, and science, including the economic and moral rights of the creator. In Indonesia, copyright regulation has evolved from Law No. 6 of 1982 to Law No. 28 of 2014, which affirms that copyright arises automatically based on the declarative principle and grants creators exclusive rights to exploit, use, and derive economic benefits from their works. This study employs a normative legal method by examining primary, secondary, and tertiary legal materials, including relevant legislation and court decisions. Copyright protection plays a crucial role in ensuring that creators receive recognition, control, and economic benefits from their works. The use of artistic works for commercial products without permission, such as the silhouette sketch of the “Tugu Selamat Datang” by PT Martina Berto Tbk, constitutes a violation of the creator’s economic and moral rights. Law No. 28 of 2014 emphasizes that copyright arises automatically once a work is realized, so any adaptation or use of a work still requires permission from the rights holder. The analysis indicates that copyright protection is vital for preventing unilateral exploitation of artistic works, ensuring legal certainty for creators, and promoting compliance within the creative industry
